Law is a set of rules created by the state to regulate behaviour in society. It is enforceable through sanctions such as fines, imprisonment, or compensation. Unlike moral or social norms, legal rules are binding on all members of a community and are applied by courts in a systematic way.

In the English legal system, law comes from two principal sources: Parliament-made statute law and judge-made common law. Statute law, also known as legislation, is created through Acts of Parliament and takes precedence over other sources. Delegated legislation, such as statutory instruments, is made by bodies given authority by an Act of Parliament.

3. The Criminal Justice System | 刑事司法体系

A criminal offence is an act prohibited by the state that carries a punishment. The burden of proof lies on the prosecution, and the standard of proof is ‘beyond reasonable doubt’. The aim of criminal law is to punish wrongdoing, deter crime, rehabilitate offenders, and protect the public.

Actus reus can be a positive act, an omission where there is a duty to act, or a state of affairs. Mens rea refers to the mental element, such as intention, recklessness, or gross negligence.

6. Defences in Criminal Law | 刑事辩护理由

Even when the elements of an offence are present, a defendant may raise a full or partial defence. Self-defence is a full defence if the force used was reasonable and necessary. The defendant’s belief in the need for force is judged subjectively, but the reasonableness of the force is assessed objectively.

7. Tort Law: The Duty of Care | 侵权法:注意义务

Tort law deals with civil wrongs that cause harm or loss to another. The most common tort is negligence, which requires the claimant to prove that the defendant owed them a duty of care, breached that duty, and caused foreseeable damage. The ‘neighbour principle’ from Donoghue v Stevenson established that we must take reasonable care to avoid acts that could foreseeably injure others.

Breach occurs when the defendant fails to meet the standard of a reasonable person, and causation is proved using the ‘but for’ test and the concept of remoteness of damage.

8. Contract Law: Formation and Breach | 合同法:合同的成立与违约

A legally binding contract requires an offer, acceptance, consideration, and an intention to create legal relations. An offer is a clear statement of terms on which the offeror is willing to be bound. Invitations to treat, such as goods on a shelf, are not offers but invitations to negotiate.

9. Human Rights and the Law | 人权与法律

The Human Rights Act 1998 incorporated the European Convention on Human Rights into UK law. It obliges public authorities to act compatibly with Convention rights, including the right to life (Article 2), freedom from torture (Article 3), the right to a fair trial (Article 6), and respect for private and family life (Article 8).

In civil cases, the County Court handles small claims and fast-track matters, while the High Court deals with complex cases.
