1. Duty of Care: The Caparo Three-Stage Test | 注意义务:卡帕罗三阶段检验公式

The ‘Caparo test’ is the modern formula for establishing a duty of care in negligence. It asks whether a duty exists by applying three sequential questions.

Stage one – Foreseeability: Was it reasonably foreseeable that the defendant’s conduct could cause harm to someone in the claimant’s position?

Stage two – Proximity: Was there a sufficient relationship of proximity (in time, space, or relationship) between the claimant and defendant?

2. Breach of Duty: The Reasonable Person Test | 违反义务:合理人标准公式

Breach is determined by comparing the defendant’s conduct with that of the reasonable person. The formula encapsulates the objective standard plus any relevant adjustments.

违反义务是通过将被告的行为与合理人的行为进行比较来确定的。该公式概括了客观标准以及任何相关调整项。

The basic standard: The reasonable person is an ordinary, prudent individual who takes reasonable care for their own and others’ safety. The defendant is judged against this objective measure, ignoring their personal idiosyncrasies.

Adjustments: If the defendant professes a special skill (e.g. a surgeon), the standard becomes that of a reasonably competent professional in that field – the Bolam test. Learners are judged against the standard of a reasonably competent person attempting the same task (Nettleship v Weston). Children are judged against the standard of a reasonable child of the same age (Mullin v Richards).

Additionally, when assessing breach, courts weigh the risk factors: likelihood of harm, seriousness of potential harm, cost and practicality of precautions, and any social utility of the defendant’s conduct.

3. Causation in Fact: The ‘But For’ Test | 事实因果关系:“若非”检验公式

Causation in fact requires the claimant to prove that the harm would not have occurred ‘but for’ the defendant’s breach. This simple counterfactual formula filters out irrelevant causes.

Formula: But for D’s breach, would C have suffered the loss? If NO → causation established.

In multiple-cause scenarios, the courts may apply the material contribution test (where a breach materially contributed to the harm, as in Bonnington Castings) or the material increase in risk test (as in Fairchild, for industrial disease cases where the ‘but for’ test is impossible to satisfy).

4. Causation in Law: Remoteness of Damage | 法律因果关系:损害遥远性公式

Once factual causation is established, the damage must not be too remote. The remoteness test limits liability to harm of a type that was reasonably foreseeable.

Formula: Liability exists only if the kind of damage suffered was a reasonably foreseeable consequence of the defendant’s negligence (The Wagon Mound No 1). The exact extent or precise manner of occurrence need not be foreseeable, but the type of harm must be. The ‘thin skull’ rule is an exception: a defendant must take their victim as they find them, so if personal injury of that type is foreseeable, the defendant is liable for the full extent of the injury, even if it is amplified by a pre-existing vulnerability.

Under the Occupiers’ Liability Act 1957, an occupier owes a ‘common duty of care’ to all lawful visitors. The duty formula derives from s.2(2) and has been refined by case law.

Formula: Duty = Occupier + Premises + Lawful visitor + Damage caused by state of premises.

The duty is to take such care as is reasonable in all the circumstances to see that the visitor is reasonably safe in using the premises for the purposes for which they are invited or permitted. Children must be expected to be less careful, and a person exercising a calling must appreciate and guard against any special risks ordinarily incident to it.

6. Occupiers’ Liability: Trespassers (OLA 1984) | 占有人责任:侵入者公式(1984 年法案)

Protection for trespassers under the 1984 Act is more limited and governed by a three-part formula in s.1(3).

Formula: Duty arises if (a) occupier is aware of the danger or has reasonable grounds to believe it exists; (b) knows or has reasonable grounds to believe a trespasser is in, or may come into, the vicinity of the danger; and (c) the risk is one against which, in all the circumstances, the occupier may reasonably be expected to offer some protection.

If those three limbs are satisfied, the duty is to take such care as is reasonable to see that the trespasser does not suffer injury by reason of the danger. Warnings and discouragement are relevant to reasonableness.

7. Assault and Battery: Intentional Torts Formulae | 恐吓与殴打:故意侵权公式

Assault and battery are distinct trespasses to the person, each with a simple element formula.

恐吓与殴打是对人身的两种不同故意侵权,各有简单的要素公式。

Assault formula: Act + Causes claimant to apprehend immediate + unlawful force + Intent (or reckless). The claimant must reasonably believe that force is about to be inflicted; words alone can suffice, and silence may sometimes constitute an act.

恐吓公式:行为 + 使原告担忧即将遭受 + 非法暴力 + 故意(或轻率)。原告必须合理相信暴力即将施加;仅凭言辞即可构成,沉默有时亦可认定为行为。

Battery formula: Direct + intentional (or reckless) + application of unlawful force + without consent. Force need not be hostile, and the unwanted touching of any part of the person, clothing, or something closely associated is sufficient.

Defences such as consent, self-defence, and lawful arrest may negate liability.

8. Murder: Actus Reus and Mens Rea Formula | 谋杀罪:犯罪行为与犯罪意图公式

Murder is a common-law offence with a settled formula: the unlawful killing of a reasonable person under the Queen’s Peace with malice aforethought.

谋杀是普通法中的犯罪,其公式固定:在女王治下非法杀害一个具有理智的人,且伴有恶意预谋。

Actus reus: Unlawful killing (by act or, in limited cases, omission where a duty exists) + a reasonable creature in being (a living human being independent of the mother) + under the King’s/Queen’s Peace.

Mens rea: Malice aforethought, which means intention to kill or intention to cause grievous bodily harm (GBH). Direct intention (purpose) or oblique intention (where death or GBH is a virtually certain consequence of the defendant’s act and the defendant appreciates that) suffices.

9. Voluntary Manslaughter: Diminished Responsibility Formula | 非自愿误杀(自愿误杀):减轻责任公式

Where murder is established, a defendant may reduce liability to voluntary manslaughter by proving diminished responsibility under s.2 Homicide Act 1957 as amended by s.52 Coroners and Justice Act 2009.

Formula: Abnormality of mental functioning + arising from a recognised medical condition + which substantially impaired D’s ability to understand the nature of their conduct, form a rational judgment, or exercise self-control + which provides an explanation for the killing.

The abnormality need not be the sole cause but must be a significant contributory factor; intoxication alone is not a recognised medical condition, but an underlying condition such as depression combined with alcohol dependency may be.

10. Theft: The Definitional Formula (Theft Act 1968, s.1) | 盗窃罪:定义公式(《1968 年盗窃法》第 1 条)

Theft is defined by a statutory formula that merges actus reus and mens rea elements. Section 1(1) Theft Act 1968 creates the overarching definition.

Formula: Theft = Dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it.

The actus reus consists of appropriation (any assumption of the rights of an owner, including later assumption where initially innocent), property (includes money, real property, personal property, things in action, and other intangible property), and belonging to another (possession, control, or any proprietary right). The mens rea consists of dishonesty (assessed first by the ordinary standards of reasonable and honest people, and secondarily by whether the defendant realised their conduct was dishonest by those standards – the Ivey test) and intention permanently to deprive (treating the property as one’s own regardless of the owner’s rights).

11. Defences: General Formulae for Self-Defence and Intoxication | 抗辩:自我防卫与醉态通用公式

Many criminal offences can be negated by defences whose structures can be reduced to practical formulas.

许多刑事犯罪可因抗辩而否定,这些抗辩的结构可简化为实用公式。

Self-defence (and defence of another/prevention of crime) formula: Honest belief in the need to use force + reasonable force in the circumstances as the defendant honestly believed them to be. The force must not be disproportionate; however, in the ‘agony of the moment’ the jury must not judge with the benefit of hindsight. Excessive force removes the defence, reducing a murder charge to voluntary manslaughter if the defendant used excessive but genuine force.

Intoxication: Voluntary intoxication is usually no defence to crimes of basic intent, as recklessness suffices. For crimes of specific intent, evidence of voluntary intoxication may be used to show the defendant lacked the required mens rea. Involuntary intoxication (e.g. spiked drink) provides a defence if the defendant lacked mens rea as a result, even for basic intent offences, provided they were not reckless in becoming intoxicated.
