1. Sources of Law: Precedent and Statutory Interpretation | 法律渊源:先例与法律解释

Ratio decidendi is the legal reason for a court’s decision – the binding principle that must be followed by lower courts. Think of ‘Ratio’ as the ‘Reason’ that forms the core of a judgement.

判决理由是法院作出裁决的法律原因——是下级法院必须遵循的具有约束力的原则。可把“Ratio”想象成构成判决核心的“理由(Reason)”。

Obiter dicta means ‘things said by the way’. These are comments made by a judge that are not essential to the decision and create persuasive, not binding, precedent. Picture obiter statements orbiting around the central ratio, just as the word ‘obiter’ sounds like ‘orbit’.

Stare decisis is the doctrine that courts should ‘stand by what has been decided’. Lower courts must follow the precedents set by higher courts in the same hierarchy. Remember ‘Stare’ = ‘Stay’ with the existing decision.

2. Actus Reus and Mens Rea | 犯罪行为与犯罪意图

Every criminal offence (except strict liability) requires two building blocks: the actus reus – the guilty act, and the mens rea – the guilty mind. A simple equation helps: Crime = Actus Reus + Mens Rea. Actus reus can be a voluntary act, a failure to act (omission) where a duty exists, or a state of affairs.

Mens rea covers different levels of fault. Intention can be direct (defendant’s aim or purpose) or oblique (a virtually certain consequence that the defendant foresaw). Recklessness means taking an unjustified risk that the defendant was aware of. Mnemonic: ‘Mens’ relates to ‘mental’ – what was in the defendant’s head.

3. Causation: Factual and Legal Cause | 因果关系:事实原因与法律原因

To establish causation, the prosecution must prove both factual and legal causation. Factual causation uses the ‘but for’ test: but for the defendant’s conduct, would the harm have occurred? If the answer is no, factual causation is made out. The famous case is R v White, where the defendant’s poison was not the cause of death because the victim died of a heart attack before the poison took effect.

Legal causation requires that the defendant’s act was an ‘operating and substantial’ cause of the consequence. The chain of causation can be broken by a novus actus interveniens – a new intervening act that is free, voluntary and informed. However, the thin skull rule means the defendant must take the victim as they are found: if the victim has a pre-existing weakness that makes the harm more serious, the defendant is still fully liable (R v Blaue).

4. Strict Liability | 严格责任

Strict liability offences do not require proof of mens rea for at least one element of the actus reus. The defendant can be guilty even if they acted reasonably or did not intend to commit the offence. These crimes are usually regulatory or quasi-criminal, such as selling alcohol to underage customers or polluting a river. Think: ‘Strict’ means no mental escape – only the act matters.

严格责任犯罪不要求证明犯罪行为中至少一个要素的犯罪意图。即使被告行为合理或无主观意图,仍可能被定罪。这类犯罪通常是监管类或准刑事犯罪,例如向未成年人售酒或污染河流。记住:“严格”意味着没有心理抗辩空间——只看行为。

5. Murder and Manslaughter Overview | 谋杀与误杀概述

Murder is the unlawful killing of a reasonable creature in being under the King’s peace with malice aforethought, express or implied. Malice aforethought means an intention to kill or cause grievous bodily harm (GBH). The mnemonic ‘MA = Intention to Kill or GBH’ keeps the core mental element clear.

谋杀是指在国土安宁状态下非法杀害一个有理性存在的生命体,并具有明示或暗示的恶意预谋。恶意预谋指的是杀人或造成严重身体伤害(GBH)的意图。用助记短句“恶意预谋 = 故意杀人或致重伤”锁定核心心理要件。

Manslaughter is a less culpable form of homicide and is divided into voluntary and involuntary manslaughter. Voluntary manslaughter occurs when a partial defence (diminished responsibility or loss of control) reduces murder to manslaughter. Involuntary manslaughter covers unlawful act manslaughter and gross negligence manslaughter, where death is caused without the malice aforethought needed for murder.

误杀是一种罪责较轻的杀人形式,分为自愿误杀和非自愿误杀。当部分抗辩事由(如减轻责任或失控)将谋杀降为误杀时,就构成自愿误杀。非自愿误杀包括非法行为误杀与重大过失误杀,其死亡结果并非出于谋杀所需的恶意预谋。


6. Voluntary Manslaughter: Partial Defences | 自愿误杀:部分抗辩事由

Diminished responsibility, governed by s2 Homicide Act 1957, requires an abnormality of mental functioning arising from a recognised medical condition that substantially impairs the defendant’s ability to understand conduct, form rational judgement or exercise self-control, and provides an explanation for the killing. Memory aid: ‘DR = medical mind, impaired control, causal link.’

减轻责任(依据《1957年杀人法》第2条)要求存在因公认的医学状况导致的精神功能异常,这严重削弱了被告理解行为、作出理性判断或实施自我控制的能力,并且该异常为杀人行为提供了原因。记忆小窍门:“DR = 医学心理 + 控制削弱 + 因果关系”。

Loss of control, established by ss54–55 Coroners and Justice Act 2009, replaced the old defence of provocation. The defendant must lose self-control due to a qualifying trigger (fear of serious violence, things said or done of an extremely grave character, or a combination), and a person of the same age and sex with normal tolerance would have reacted similarly. Picture ‘LOC’ as ‘Loss Of Control’ – literally snapping under pressure.

失控抗辩(依据《2009年验尸官与司法法》第54–55条)取代了旧的激怒抗辩。被告必须因合格触发因素(对严重暴力的恐惧、属于极端严重性质的言行,或两者结合)而失去自控,且同等年龄和性别、具有正常容忍度的人也会有类似反应。可把 “LOC” 视觉化为 “Loss Of Control”——在压力下理智崩断。


7. Involuntary Manslaughter: Unlawful Act and Gross Negligence | 非自愿误杀:非法行为误杀与重大过失误杀

Unlawful act manslaughter (also called constructive manslaughter) arises when the defendant commits an intentional unlawful act that is objectively dangerous and causes death. The key cases are R v Lamb (the act must be a crime, not a joke) and DPP v Newbury (dangerousness tested against the reasonable person). Recall: ‘UAM = Crime + Danger + Causation of Death.’

非法行为误杀(也称推定误杀)发生在被告故意实施了一个客观上危险且造成死亡的非法行为时。关键判例是 R v Lamb(行为必须是犯罪,而非玩笑)和 DPP v Newbury(以正常合理人的标准判断危险性)。记忆口诀:“UAM = 犯罪 + 危险 + 导致死亡”。

Gross negligence manslaughter requires a duty of care, a breach of that duty, and gross negligence so serious as to be criminal, causing death. The test from R v Adomako looks at whether the defendant’s conduct fell far below what could reasonably be expected. Create a story in your mind: ‘A doctor (duty) ignores a clear danger (breach), behaving so badly (gross) that a patient dies.’
