The courts consider factors including the wording of the statute, the subject matter, and the severity of the penalty. Defences such as duress and those based on the specific statutory wording may apply, but the defence of due diligence is usually only available where the statute expressly provides for it.

The key non-fatal offences are regulated largely by the Offences Against the Person Act 1861. Assault is causing the victim to apprehend immediate unlawful force, while battery is the actual infliction of that force. Assault occasioning actual bodily harm (s.47 OAPA 1861) requires a common assault or battery that causes ‘actual bodily harm’, defined broadly as any hurt or injury calculated to interfere with the health or comfort of the victim (R v Miller). Malicious wounding or inflicting grievous bodily harm (s.20) requires a wound or really serious harm, with mens rea of intention or recklessness as to some harm. The more serious offence under s.18 (wounding or causing GBH with intent) demands specific intent to cause grievous bodily harm or to resist arrest. Consent, self-defence, and lawful correction may operate as defences.

The concept of ‘dishonesty’ is assessed according to the Ivey v Genting Casinos test: what the defendant genuinely knew or believed and whether the conduct was dishonest by the standards of ordinary decent people. Robbery (s.8) is theft committed by using force or putting or seeking to put any person in fear of being then and there subjected to force. Criminal damage, under the Criminal Damage Act 1971, involves destroying or damaging property belonging to another, intentionally or recklessly.

An offer may be terminated by revocation, rejection, lapse of time, or death. Acceptance must be unqualified and communicated to the offeror, except where the postal rule applies (Adams v Lindsell); under this rule, acceptance takes effect when the letter is posted, provided it was reasonable to use the post. In modern contexts, electronic communications are governed by the time of receipt rather than the time of sending.

Consideration is the ‘price’ of the promise – each party must provide something of value. It must be sufficient but need not be adequate; the court does not inquire into the economic equivalence of the exchange. Past consideration is not good consideration (Roscorla v Thomas), unless an implied request at the time of the act can be found (Lampleigh v Braithwait). Performance of an existing public duty does not normally amount to good consideration unless something extra is provided. Part-payment of a debt is not consideration for the whole, as decided in Pinnel’s Case, although promissory estoppel may provide a defence in certain circumstances. Intention to create legal relations is presumed in commercial agreements but presumed absent in domestic and social arrangements, though either presumption can be rebutted by evidence.

To establish negligence, a claimant must prove that the defendant owed a duty of care, breached that duty, and caused damage which is not too remote. The modern duty of care derives from the neighbour principle in Donoghue v Stevenson, refined through the three-stage test in Caparo Industries plc v Dickman: foreseeability of damage, proximity of relationship, and whether it is fair, just and reasonable to impose a duty. Breach occurs when the defendant fails to meet the standard of the reasonable person in the circumstances, with factors such as the likelihood of harm, the seriousness of the injury, the cost of precautions, and the social utility of the activity taken into account. Causation requires proof of factual causation (the ‘but for’ test) and legal causation, and damage must not be too remote (The Wagon Mound (No 1)). Defences include contributory negligence, consent (volenti non fit injuria), and illegality.

12. Tort Law: Occupiers’ Liability and Nuisance | 侵权法:占有人责任与妨害

Occupiers’ liability governs the duty owed by an occupier of premises to entrants. The Occupiers’ Liability Act 1957 imposes a common duty of care toward lawful visitors: to take such care as is reasonable to ensure the visitor is reasonably safe in using the premises for the permitted purpose. The 1984 Act extends limited protection to trespassers, requiring an occupier to take reasonable care where they are aware of a danger, know that a trespasser may come into the vicinity, and the risk is one against which, in all the circumstances, they may reasonably be expected to offer some protection. Private nuisance, on the other hand, protects a person’s right to enjoy their land. It involves an unreasonable and substantial interference with the use or enjoyment of land, assessed by factors such as the character of the neighbourhood, duration, intensity, and the sensitivity of the claimant. Remedies include damages and injunctions.
