KS3 AQA Law: Case Analysis Practical Drill | KS3 AQA

📚 KS3 AQA Law: Case Analysis Practical Drill | KS3 AQA

Legal case analysis is the beating heart of studying law. It transforms abstract rules into living, breathing disputes, showing you how judges, lawyers, and citizens resolve real-world problems. Unlike simply memorising statutes, case analysis builds your ability to reason, argue, and uncover what is fair. In this practical drill, we will guide you through a structured method you can use again and again, then apply it to realistic scenarios designed for KS3 AQA Law. By the end, you will feel confident tackling any legal puzzle, whether it is about theft, broken promises, or accidents.

1. What is Case Analysis? |

Case analysis is the process of examining a real or fictional legal dispute to determine who should win and why. It is not about guessing or relying on gut feelings. Instead, it follows a logical path: you collect the facts, identify the legal question, find the relevant rule, apply that rule, and reach a reasoned conclusion. Lawyers call this the IRAC method (Issue, Rule, Application, Conclusion), and it is the backbone of legal education from Year 7 right up to university. Mastering it early gives you a superpower: the ability to think like a lawyer.

For KS3 students, the cases we analyse will be stripped down to their essentials. We will not ask you to read long judgments or dig into Latin maxims. Instead, we will use everyday situations – a lost phone, a broken window, a borrowed item – to teach you how legal logic works. This drill is designed to make you fluent in the language of law, step by step.

2. Step 1: Identifying the Facts |

Every legal case begins with the facts – the who, what, when, where, and how of the story. Before you can solve the puzzle, you must understand exactly what happened. This step requires you to be a detective. Read the scenario carefully and separate relevant facts from irrelevant noise. A relevant fact is one that could affect the outcome of the case according to the law. For example, in a theft case, whether the person intended to permanently deprive the owner is a relevant fact; the colour of the item usually is not.

When you first read a case, jot down bullet points of key facts. Do not add your own assumptions. Stick strictly to what the words tell you. In an exam, missing a key fact can lead you to a completely wrong conclusion, so slow down and highlight every detail that might matter later.

3. Step 2: Spotting the Legal Issue |

Once the facts are clear, you must translate the story into a legal question. This is called the ‘issue’. The issue is not ‘who is right?’; it is a precise question about which area of law is involved and what needs to be decided. For example, if someone takes a bicycle without permission and keeps it, the issue might be: ‘Did D commit theft under the Theft Act 1968?’ If a person is injured by a falling object, the issue could be: ‘Is the owner liable in negligence?’ Framing the issue correctly is half the battle.

In KS3, issues typically revolve around whether a crime has been committed or whether a civil wrong has occurred. You will see words like theft, assault, battery, negligence, and breach of contract. Practice spotting the issue by asking: ‘What type of legal dispute is this? What law has possibly been broken?’ Write the issue as a clear, simple question.

4. Step 3: Explaining the Relevant Law |

With the issue identified, you now state the legal rule that governs it. This rule might come from a statute, such as the Theft Act 1968, or from common law, which is law developed by judges over time. You do not need to quote whole sections – a summary will do. However, you must be accurate. For theft, for example, you would explain that it involves dishonestly appropriating property belonging to another with the intention of permanently depriving them of it.

Breaking a rule into its ‘elements’ is a powerful technique. Each element is a condition that must be proved. In theft, the elements are: (1) appropriation, (2) of property, (3) belonging to another, (4) dishonesty, and (5) intention to permanently deprive. If any element is missing, the crime has not been committed. For civil law, like negligence, the elements are duty of care, breach of that duty, and damage caused by the breach. Learning these building blocks makes rule explanation structured and memorable.

5. Step 4: Applying the Law to the Facts |

This is the most important step and where most marks are earned. Application means you take each element of the legal rule and match it to the facts of the case. Go element by element, asking: ‘Is this satisfied? What fact proves or disproves it?’ For example, if the rule requires ‘intention to permanently deprive’, you look at whether the defendant kept the item, sold it, or abandoned it. If they borrowed it briefly and returned it, that element likely fails.

Never skip this connection. Writing ‘the defendant is guilty because they stole’ is not application – it is a conclusion without reasoning. Instead, write: ‘In our case, Daniel took Maya’s phone from her bag without asking. He then switched it off and refused to return it. This shows appropriation of property belonging to another, and his refusal to give it back demonstrates an intention to permanently deprive. His actions were dishonest by the standards of ordinary people.’ This step-by-step linkage is what turns a vague answer into a high-scoring one.

6. Step 5: Reaching a Conclusion |

After application, your conclusion should flow naturally. It answers the issue question directly, supported by everything you have just explained. A strong conclusion does more than say ‘guilty’ or ‘liable’; it summarises why. For instance: ‘Therefore, Daniel is likely to be found guilty of theft because all five elements of the offence are satisfied on the facts.’ If one element fails, your conclusion should reflect that, perhaps clearing the defendant or reducing liability.

In law, it is perfectly acceptable to reach a tentative conclusion, such as ‘the court would probably find…’ because you often do not have every tiny detail. What matters is that your conclusion is consistent with your application. Never change your reasoning to fit a conclusion you want; let the facts and rules lead you. Practising this discipline will improve your critical thinking across all subjects.

7. Practice Case 1: Amy and the Missing Phone |

Facts: Amy left her new smartphone on a bench in the school playground. Ben walked past, saw the phone, and picked it up. He looked around but did not see anyone near. He put the phone in his own bag and took it home. Later, Amy announced that her phone was missing, but Ben stayed silent. The next day, Ben sold the phone to a classmate for £50.

Issue: Has Ben committed theft?

Rule: Under the Theft Act 1968, a person commits theft if they dishonestly appropriate property belonging to another with the intention of permanently depriving the other of it.

Application: The phone is property and belonged to Amy. When Ben picked it up from the bench and put it in his bag, he ‘appropriated’ it – he assumed the rights of the owner. He found the phone, but finding does not automatically make it his; he made no effort to return it. His silence when Amy reported the loss and his decision to sell the phone strongly indicate an intention to permanently deprive. Selling it for cash cements that intention. As for dishonesty, the ordinary person would say that keeping and selling someone else’s phone without trying to find the owner is dishonest. All five elements appear satisfied.

Conclusion: Ben is likely to be found guilty of theft. The facts support every required element, and there is no valid defence on these basic facts.

8. Practice Case 2: The Neighbour’s Fence |

Facts: Tariq was mowing his lawn when he lost control of the mower. It crashed into the fence that divides his garden from Mrs Owen’s. The fence, which belongs to Mrs Owen, was smashed and will cost £200 to repair. At the time, Tariq was daydreaming and not paying attention. Mrs Owen is furious and wants Tariq to pay.

Issue: Is Tariq liable in the tort of negligence for the damage to the fence?

Rule: Negligence in civil law requires three elements: (1) the defendant owed the claimant a duty of care, (2) the defendant breached that duty by failing to act as a reasonable person would, and (3) the breach caused damage that is not too remote.

Application: Tariq, as a neighbour operating machinery near the boundary, clearly owed Mrs Owen a duty of care – a neighbour principle applies. The reasonable person mowing a lawn would pay attention to avoid veering into a fence. By daydreaming, Tariq fell below that standard; he breached his duty. That breach directly caused the mower to hit and smash the fence, leading to a £200 repair cost, which is a direct and foreseeable consequence. All three elements of negligence are met.

Conclusion: Tariq is likely to be held liable in negligence and would be ordered to pay £200 in damages to Mrs Owen. The outcome shows that carelessness can have legal consequences even without a criminal act.

9. Practice Case 3: The Borrowed Laptop |

Facts: Leo asked his friend Jasmine if he could borrow her laptop for one week to finish a school project. Jasmine agreed. After the week ended, Leo did not return the laptop. Jasmine texted him several times, but Leo ignored the messages. Two months later, Leo still had the laptop and had installed his own software on it. He had no intention of returning it.

Issue: Can Leo be charged with theft, and what civil claim might Jasmine have?

Rule: For theft, appropriation includes keeping property beyond the agreed time if there is dishonesty and intention to permanently deprive. Civilly, this could be the tort of conversion (using someone else’s property as your own) or breach of a bailment agreement (a contract where you lend an item).

Application: Leo initially had permission, so his original taking was not dishonest. However, after the week passed and he ignored requests, keeping the laptop became dishonest. By installing software and treating the laptop as his own, he showed an intention to permanently deprive Jasmine of it. Criminally, the elements of theft are likely satisfied once the initial permission expired. On the civil side, Jasmine lent the laptop under a bailment; failing to return it and using it for his own purposes breaches that obligation. She could sue for the return of the laptop or its value.

Conclusion: Leo could face a theft charge and will also be liable in civil law. Jasmine has the option of reporting the matter to the police or taking a civil claim for conversion. This case illustrates how the same behaviour can trigger both criminal and civil consequences.

10. Common Pitfalls and How to Avoid Them | 常见误区与规避方法

One huge mistake is leaping to a conclusion without working through the elements. Students often write, ‘He’s guilty because he took it,’ and stop. That approach misses all the analysis marks. Always walk through each legal element step by step, even if it feels repetitive. Another pitfall is mixing up criminal and civil law. Remember: criminal cases are brought by the state and aim to punish; civil cases are brought by individuals and aim to compensate. Using the wrong vocabulary – such as ‘guilty’ in a civil case – can lose marks.

Many learners also ignore facts that do not fit neatly into the rule. If one element is missing, you must say so and adjust your conclusion. For example, if someone took an item but intended to return it the next day, the intention to permanently deprive is absent – so the conclusion should be not guilty of theft. Never twist the facts to make a case fit. Finally, some students write vague applications like ‘it was dishonest.’ Instead, name the standard: ‘the ordinary person would view secretly taking and keeping the property as dishonest.’ Precision makes all the difference.

11. Exam Technique for AQA KS3 Law Case Questions | AQA KS3

In an AQA-style KS3 assessment, a case analysis question usually gives you a short scenario and asks you to ‘advise’ the parties or explain whether a crime has been committed. Begin by reading the question twice. Underline the legal terms in the question, such as ‘theft’, ‘negligence’, or ‘liable’. This tells you what rules you need to discuss. Structure your answer exactly as we practised: issue, rule, application, conclusion. Use the subheadings if you are allowed, or at least signal them with phrases like ‘The legal issue here is…’ and ‘Applying the law…’

Time management is critical. Allocate a set number of minutes per case. Do not spend so long on the facts that you run out of time for application. Jot down a quick plan: issue and elements in the margin. Quality of reasoning counts far more than length. A concise, well-linked answer will beat a rambling one every time. Finally, always check you have used the correct terminology and that your conclusion matches your analysis.

12. Summary and Key Takeaways |

Case analysis is a skill that sharpens with practice. Every legal problem, no matter how complicated, boils down to a clear question: has the law been breached, and if so, what remedy follows? By following IRAC – Issue, Rule, Application, Conclusion – you build an unshakeable framework. Start by extracting the crucial facts, frame the issue as a legal question, state the rule with its elements, apply each element meticulously, and let the conclusion emerge from that process.

Remember that criminal law and civil law serve different purposes and require different language. Practise with our three sample cases until the steps feel automatic. Then create your own mini-cases with friends and analyse each other’s reasoning. The more you do it, the more natural it becomes. Finally, on exam day, stay calm, trust the method, and show the examiner how you think like a lawyer.
