A legally binding contract generally requires four elements. An offer is a clear statement of terms on which the offeror is willing to contract. Acceptance must mirror the offer precisely (the mirror-image rule) and be communicated. Consideration is something of value exchanged between the parties. Battery is a form of trespass to the person. The formula is straightforward: the defendant must have directly and intentionally (or recklessly) caused physical contact with the claimant, and that contact was without the claimant’s consent. Under the Theft Act 1968, theft is defined by five elements, simplified into three key parts. ‘Appropriation’ means assuming the rights of the owner. The property must belong to another, and the defendant must intend to permanently deprive the owner of it.

Borrowing something with no intention of returning it can be intention to permanently deprive. Even if the defendant later returns the property, the theft is complete at the moment of dishonest appropriation with that intention.

The purposive approach goes further and asks what Parliament intended to achieve. The formula is a spectrum: the more the court departs from pure literalism, the more it considers purpose.

Justice is not a single concept but a combination of principles. Equality means like cases should be treated alike, without discrimination. Fairness implies that legal procedures should be unbiased and give each side a chance to be heard. Access to justice means that people should be able to use the legal system to enforce their rights – cost, delay, and complexity should not be prohibitive. When all three are present, the legal system is closer to delivering true justice.
