1. Actus Reus & Omissions | 犯罪行为与不作为
The actus reus is the external element of a crime – a voluntary act (or qualifying omission) that causes harm. The conduct must be willed; an involuntary act, such as a reflex or spasm, does not satisfy actus reus (Hill v Baxter).

Mens rea is the mental element. Direct intent exists where the consequence is the defendant’s aim or purpose (R v Mohan). Oblique intent applies where the result is a virtual certainty and the defendant appreciates this (R v Woollin). The jury is entitled to find intention only where death or serious harm was a virtual certainty and the defendant foresaw it as such.

Recklessness in criminal law means the defendant foresees an unjustified risk and goes on to take it (R v Cunningham – subjective test). This contrasts with objective recklessness, which was abolished for most offences by R v G and another. For criminal damage, the test is now fully subjective.

To establish liability, the prosecution must show both factual and legal causation. Factual causation is determined by the ‘but for’ test: but for the defendant’s conduct, would the result have occurred? (R v White). Legal causation requires that the defendant’s act be the substantial and operating cause of the result (R v Smith).

The thin skull rule instructs that the defendant must take the victim as found (R v Blaue).

Strict liability offences require no mens rea for at least one element of the actus reus. Liability is imposed simply on proof of the prohibited conduct. These are usually regulatory or quasi-criminal offences (e.g. food safety, pollution) where Parliament intended to dispense with a mental requirement (Gammon Ltd v Attorney-General of Hong Kong).

Murder is the unlawful killing of a human being with malice aforethought, express or implied (R v Moloney). Malice aforethought means an intention to kill or cause grievous bodily harm. Partial defences reduce murder to voluntary manslaughter: diminished responsibility and loss of control.

Diminished responsibility (s.2 Homicide Act 1957, amended by s.52 Coroners and Justice Act 2009) requires an abnormality of mental functioning arising from a recognised medical condition, which substantially impaired the defendant’s ability to understand the nature of the conduct, form a rational judgment, or exercise self‑control (R v Byrne).

Assault and battery are distinct common law offences. Assault is causing the victim to apprehend immediate unlawful force (R v Ireland). Battery is the actual application of unlawful force, however slight (Collins v Wilcock). Both require intention or recklessness (R v Venna).

Negligence requires a duty of care, breach of that duty, and resultant damage. The modern approach to duty stems from Caparo Industries plc v Dickman: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty. An incremental approach is favoured (Robinson v Chief Constable of West Yorkshire Police).

8. Negligence: Breach of Duty & Damage | 过失侵权:违反义务与损害
Breach is assessed by the standard of the reasonable person in the defendant’s position (Blyth v Birmingham Waterworks). The reasonable person is not a perfect person: the standard is objective. Professionals must act in accordance with a responsible body of professional opinion (Bolam test, refined by Bolitho v City and Hackney HA, requiring that the opinion be logical).

Occupiers of premises owe a common duty of care to lawful visitors (Occupiers’ Liability Act 1957). The duty is to take such care as is reasonably necessary to ensure the visitor will be reasonably safe (s.2(2)). Children are owed a higher standard (s.2(3)(a); Glasgow Corp v Taylor), and tradesmen are expected to guard against risks peculiar to their trade (s.2(3)(b); Roles v Nathan).

The Occupiers’ Liability Act 1984 imposes a limited duty towards trespassers. The occupier owes a duty if aware of the danger and has reasonable grounds to believe a trespasser may come into the vicinity, and the risk is one against which he may reasonably be expected to offer some protection (s.1(3); Ratcliff v McConnell). The duty is to take reasonable care to see that the trespasser does not suffer injury (s.1(4)).

Consent can be a defence to non‑fatal offences. The victim’s consent must be true, informed, and freely given (R v Olugboja). Consent is no defence to bodily harm unless the activity falls within a recognised category (e.g. sports, surgery, rough horseplay) as set out in R v Brown and R v Wilson. Public policy limits the scope of consent.

Self‑defence, defence of another and prevention of crime are governed by common law and s.76 Criminal Justice and Immigration Act 2008. The force used must be reasonable in the circumstances as the defendant genuinely believed them to be (R v Gladstone Williams). Whether force is proportionate is assessed objectively, allowing for the fact that a person acting in the heat of the moment cannot weigh to a nicety the exact measure of necessary action (s.76(7); R v Palmer).
