1. The Fundamental Crime Formula | 犯罪基本公式

Actus Reus + Mens Rea – Defence = Criminal Liability

The actus reus is the physical element of a crime and can consist of an act, an omission (where a duty exists), or a state of affairs. Mens rea is the mental element, which may be intention, recklessness, negligence or strict liability, depending on the offence. If the prosecution proves both beyond reasonable doubt, the defendant is guilty unless they raise a complete or partial defence, such as self-defence, duress or insanity.

Actus reus(犯罪行为)是犯罪的客观要件,可以是作为、不作为(在存在义务时)或状态。Mens rea(犯意)是主观要件,根据不同罪行可分为蓄意、轻率、过失或严格责任。若控方排除合理怀疑地证明了这两个要素,被告即属有罪,除非其提出完全或部分的抗辩理由,如自卫、胁迫或精神错乱。

2. Causation: The Chain of Responsibility | 因果关系:责任链条

Factual Causation (‘But For’ Test) + Legal Causation = Causation Established

Factual causation asks: but for the defendant’s act, would the result have occurred? If the answer is no, factual causation is proved. Legal causation requires that the defendant’s act was the ‘operating and substantial’ cause of the result, and that no new intervening act (novus actus interveniens) broke the chain of causation. Intervening acts can be the victim’s own conduct, a third party’s actions, or a natural event, but they must be free, voluntary and informed, and unreasonable to break the chain.

The ‘thin skull’ rule (eggshell skull principle) is a vital corollary: a defendant must take their victim as they find them. If the victim has a pre-existing condition that makes the injury more serious, the defendant is liable for all the consequences, even if those are unforeseeable.

3. Murder: The Ultimate Offence Formula | 谋杀:终极犯罪公式

Unlawful Killing of a Reasonable Creature in Being + Malice Aforethought = Murder

Malice aforethought means an intention to kill or an intention to cause grievous bodily harm (GBH). This includes direct intent (aim or purpose) and oblique intent (where the result is a virtually certain consequence of the defendant’s act and the defendant appreciated that). The victim must be a human being who has been born alive and has an existence independent of the mother.

Partial defences reduce murder to voluntary manslaughter. The two principal ones are diminished responsibility (abnormality of mental functioning arising from a recognised medical condition, which substantially impaired the defendant’s ability to understand the nature of their conduct, form a rational judgment, or exercise self-control) and loss of control (a qualifying trigger of fear of serious violence or things said/done of an extremely grave character, which caused the defendant to lose self-control and a person of the defendant’s sex and age with a normal degree of tolerance and self-restraint might have done the same).

4. Involuntary Manslaughter: Unlawful Act & Gross Negligence | 非自愿误杀:非法行为与重大过失

Unlawful Act Manslaughter: Intentional Unlawful Act + Dangerousness + Causation

The defendant must commit an intentional act (not omission) that is unlawful and is objectively dangerous (a sober and reasonable person would recognise the risk of some physical harm). That act must cause the victim’s death. There is no requirement that the defendant foresaw any harm.

被告必须实施一个非法的、客观上危险的有意行为(不作为不构成),即清醒的理性人会意识到存在某种身体伤害的风险。该行为必须导致受害人死亡。不要求被告预见到任何伤害。

Gross Negligence Manslaughter: Duty of Care + Breach + Risk of Death + Gross Negligence + Causation

This form requires that the defendant owed the victim a duty of care, breached that duty in a way that created an obvious and serious risk of death, and that the breach was so grossly negligent as to amount to a crime. The jury decides whether the negligence is ‘gross’ by considering whether the defendant’s conduct was so bad in all the circumstances as to justify a criminal conviction.

5. Non-Fatal Offences: The Ladder of Harm | 非致命犯罪:伤害阶梯

Assault: Causing Victim to Apprehend Immediate Unlawful Personal Violence

Assault is a summary offence. The defendant must intentionally or recklessly cause the victim to apprehend immediate and unlawful physical violence. No touching is required; words alone can suffice, and silence can be an assault if the context creates such apprehension.

Assault 是简易罪。被告须蓄意或轻率地使受害人害怕即将遭受立即、非法的人身暴力。无需实际接触;仅凭言语即可构成,沉默在某些情境下同样可构成 assault。

Battery: Infliction of Unlawful Personal Force

Battery requires the actual infliction of unlawful force, however slight. The force can be applied directly or indirectly, and the mens rea is intention or recklessness as to the application of force. Everyday touching (jostling in a crowd) is impliedly consented to and not battery.

Actual Bodily Harm (ABH): Assault or Battery Occasioning Actual Bodily Harm

ABH under s.47 Offences Against the Person Act 1861 can be committed by assault or battery. ‘Actual bodily harm’ means any hurt or injury calculated to interfere with the health or comfort of the victim; it includes psychiatric injury but not mere emotions. Mens rea is the same as for the initial assault or battery, not necessarily an intention to cause ABH.

Section 20 (malicious wounding or inflicting GBH) requires a wound (break in the continuity of the whole skin) or really serious bodily harm, caused with intention or recklessness as to some harm. Section 18 (wounding or causing GBH with intent) adds a specific intent to cause GBH or resist arrest, and carries a maximum life sentence.

6. Theft: The Dishonesty Equation | 盗窃:不诚实等式

Appropriation + Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive = Theft

Appropriation (s.3 Theft Act 1968) is any assumption of the rights of an owner, including keeping or dealing with property, and can occur even with the owner’s consent if obtained by deception. Property (s.4) includes money, real property, personal property, things in action and other intangible property, but not wild creatures or plants growing wild unless taken for commercial purposes.

Property belongs to another (s.5) if that person has possession or control, or any proprietary right or interest. The dishonesty test (s.2 partly negative, plus common law test from Ivey v Genting Casinos) asks: what was the defendant’s actual state of knowledge or belief as to the facts, and was their conduct dishonest by the standards of ordinary decent people? Intention to permanently deprive (s.6) includes treating the property as one’s own to dispose of regardless of the owner’s rights, such as by selling, pawning or destroying.

7. Contract Formation: The Three Essential Elements | 合同成立:三大要素

Agreement (Offer + Acceptance) + Consideration + Intention to Create Legal Relations = Contract

An offer is an expression of willingness to contract on certain terms, made with the intention that it will become binding upon acceptance. It must be distinguished from an invitation to treat (e.g. goods on display, advertisements). Acceptance must be a mirror-image response communicated to the offeror, unless the postal rule applies (acceptance by post is complete on posting, provided it was reasonable to use post and the letter was properly stamped and addressed).

要约是一方以特定条款订立合同的意思表示,意图一经承诺即受约束。必须与要约邀请(如展示商品、广告)区分。承诺必须是与要约条款完全一致的回应,并传达给要约人,除非适用邮寄规则(若使用邮寄方式合理且信件正确署名、贴足邮资,则投邮时承诺即生效)。

Consideration is the price for which the promise of the other is bought; it must be sufficient but need not be adequate, must not be past (the act must not pre-date the promise), and must move from the promisee. Performance of an existing contractual duty owed to a third party, or of a public duty, can be consideration if it goes beyond the duty or confers a practical benefit. Intention to create legal relations is presumed in commercial agreements and rebutted in social/domestic arrangements, unless evidence shows a contrary intention.

对价是换取对方承诺而付出的代价;必须充分但不必相当,不得为过在对价(行为不能先于承诺),且须由受诺人提供。履行对第三方既存的合同义务,或履行公法义务,若超越了义务范围或带来实际利益,亦可构成对价。法律关系的意图在商业协议中推定存在,在社会/家庭安排中推定不存在,但可被相反证据推翻。


8. Negligence: The Tort of Carelessness | 过失侵权:注意义务公式

Duty of Care + Breach of Duty + Causation + Damage (Not Too Remote) = Negligence

A duty of care exists where there is proximity between the parties, the harm was reasonably foreseeable, and it is fair, just and reasonable to impose a duty (the Caparo test). In established categories (e.g. road users, doctor-patient, manufacturer-consumer) a duty is automatically owed. For novel situations, incremental development by analogy is preferred.

注意义务存在于当事人之间具有近因性、损害可合理预见,且施加义务公平、公正且合理的情况下(Caparo 三要素标准)。在既定类别中(如道路使用者、医患、制造商-消费者),义务自动存在。对于新型情形,倾向于通过类比进行逐案发展。

Breach occurs when the defendant fails to act as the reasonable person would have done. The standard is objective, but is adjusted for professionals (Bolam test: acting in accordance with a responsible body of professional opinion), children (standard of a reasonable child of the same age), and emergencies. The court considers the probability of injury, the seriousness of the risk, the cost of precautions and the social utility of the defendant’s activity.

违反义务指被告未能像理性人那样行事。标准为客观,但专业人士适用 Bolam 检验(符合一个负责任的专业团体意见即可)、儿童适用同龄理性儿童标准,紧急情况可降低要求。法院会考虑损害发生概率、风险严重性、预防措施的代价以及被告活动的社会效用。

Causation is the same two-stage test applied in crime: ‘but for’ factual causation and legal causation, where the damage must not be too remote (the Wagon Mound test: the type of damage must be reasonably foreseeable). The ‘thin skull’ rule applies, so a pre-existing vulnerability will not break the chain.

因果关系采用与刑法相同的两阶段检验:事实因果关系(“若无则不”)和法律因果关系,且损害不得过于遥远(Wagon Mound 标准:损害类型须可合理预见)。“薄颅骨”规则适用,故原有的脆弱性不会打断因果链条。


9. Strict Liability in Crime | 刑事严格责任

Strict Liability Offence = Actus Reus Only (No Mens Rea for at Least One Element)

Strict liability offences require no proof of mens rea for one or more elements of the actus reus. They are usually regulatory or quasi-criminal, such as food safety, road traffic and environmental laws. The court presumes mens rea is required unless the statute clearly indicates otherwise, considering the wording, the subject matter, the maximum penalty, and whether imposing strict liability will promote the legislative purpose.

严格责任犯罪不要求证明被告对犯罪行为中的一个或多个要素具有犯意。它们通常是规制性或准刑事犯罪,如食品安全、道路交通和环境法律。法院推定需要犯意,除非法律明确规定相反,并考虑措辞、主题、最高刑罚及施加严格责任是否符合立法目的。

Due diligence or third-party fault defences may be available if the statute so provides, but a pure strict liability offence offers no defence once the actus reus is proved. This formula asks: is the offence truly one of strict liability, and has the prosecution proved the prohibited act?

若法条有规定,被告可提出尽职调查或第三方过错抗辩,但在纯粹严格责任犯罪中,一旦犯罪行为被证明,便无抗辩可能。本公式问:该罪行是否确属严格责任,且控方是否证明了禁止行为?


10. Vicarious Liability: The Employer’s Responsibility | 替代责任:雇主责任

Vicarious Liability = Tort Committed by Employee + in the Course of Employment

Employers are vicariously liable for torts committed by their employees (not independent contractors) in the course of employment. The two-stage test asks: is the relationship one of employment or akin to employment; and was the tort so closely connected with the employment that it would be fair, just and reasonable to hold the employer liable? A wrongful act done by an employee within the field of activities assigned to them, even if performed in a criminal or prohibited manner, can fall within the course of employment.

雇主对雇员(非独立承包商)在雇佣过程中实施的侵权行为承担替代责任。两阶段检验询问:该关系是否为雇佣关系或类似雇佣关系;侵权行为是否与雇佣关系紧密相关,以至于追究雇主责任是公平、公正且合理的?雇员在其被指派的活动范围内实施的错误行为,即使以犯罪或禁止的方式进行,也可能属于雇佣过程。


11. Defences in Tort: Blocking Liability | 侵权抗辩:阻断责任

Full Defence or Partial Reduction = Consent + Contributory Negligence + Illegality + Necessity

Consent (volenti non fit injuria) provides a complete defence where the claimant freely and voluntarily, with full knowledge of the nature and extent of the risk, agreed to run that risk. Mere knowledge of a risk is not consent; the claimant must have voluntarily accepted the risk, which is rare outside sporting and employment contexts.

同意(volenti non fit injuria,自愿者不受害)是一项完全抗辩,要求索赔人在充分了解风险的性质与程度后,自由自愿地同意承受该风险。仅知悉风险不构成同意;索赔人必须自愿接受风险,这一抗辩在体育和雇佣关系之外很少成立。

Contributory negligence (Law Reform (Contributory Negligence) Act 1945) reduces damages by a percentage reflecting the claimant’s share of the fault for their own damage. The claimant must have failed to take reasonable care for their own safety, and that failure must have contributed to the damage. Illegality (ex turpi causa) may bar a claim where the claimant’s injury is inextricably bound up with their own illegal act, preventing any recovery on public policy grounds. Necessity operates as a defence where the defendant acted reasonably to prevent a greater harm.

12. Occupiers’ Liability: Protecting Visitors and Trespassers | 占用人责任:保护访客与侵入者

Occupiers’ Liability Act 1957 (Visitors): Common Duty of Care = Take Reasonable Care to See That Visitor Is Reasonably Safe

An occupier under the 1957 Act owes a common duty of care to all lawful visitors (invitees, licensees, those with contractual permission, and persons entering under a right conferred by law). The occupier must take such care as is reasonable in all the circumstances to see that the visitor will be reasonably safe in using the premises for the permitted purpose. The Act expressly protects persons and property. Warnings may discharge the duty if they are enough to enable the visitor to be reasonably safe, and children must be expected to be less careful.

根据1957年法律,占用人对所有合法访客(受邀人、被许可人、合同允许者和依法有权进入者)负有共同的注意义务。占用人须在所有情形下采取合理注意,确保为获准目的使用场所的访客能合理地安全。该法明确保护人身与财产。警告若足以使访客合理安全便可解除义务,且必须预料到儿童会较不谨慎。

Occupiers’ Liability Act 1984 (Trespassers): Limited Duty = Awareness of Danger + Knowledge of Proximity + Reasonable to Offer Protection

For persons other than visitors (mainly trespassers), the 1984 Act imposes a duty only if three conditions are met: the occupier is aware of the danger or has reasonable grounds to believe it exists; knows or has reasonable grounds to believe that a non-visitor is in the vicinity of the danger; and the risk is one against which, in all the circumstances, it is reasonable to offer some protection. The duty is to take such care as is reasonable in all the circumstances to see that the entrant does not suffer injury on the premises by reason of the danger concerned. Warnings may suffice.

对于访客以外的人(主要是侵入者),1984年法律仅在满足三项条件时才施加义务:占用人知悉危险或有合理理由相信其存在;知道或有合理理由相信非访客处于危险附近;且在所有情形下对该风险提供某种保护是合理的。该义务是采取一切合理注意,确保进入者不会因相关危险在场所内受伤。警告可能足矣。
