Success in A-Level CAIE Law requires more than memorising cases and statutes. It depends on understanding exactly what examiners reward, how to structure answers, and how to balance knowledge, application and evaluation under timed conditions.

1. Understand the Paper Structure and Mark Allocation | 了解试卷结构与分值分配

The CAIE A-Level Law syllabus (9084) contains four papers. Paper 1 covers the English Legal System and Paper 2 covers Criminal Law at AS Level. At A2, Paper 3 covers the Law of Tort and Paper 4 covers Human Rights Law. Each paper is 1 hour 30 minutes and carries 60 marks.

You will usually answer a small number of extended questions. Many questions are worth 15, 25 or 30 marks, so you must allocate time in proportion to the marks offered. A 25-mark answer should receive around 35 minutes, including planning time.

CAIE Law mark schemes assess three broad objectives. AO1 tests knowledge and understanding of legal rules, cases and statutes. AO2 tests analysis and application of law to given facts. AO3 tests evaluation, judgment and the ability to reach a justified conclusion.

3. Command Words and Question Types | 指令词与题型

Every CAIE Law question contains a command word that tells you the required skill. If the question says “Explain”, you must set out reasons and details. If it says “Discuss”, you must present both sides and usually evaluate. If it says “Advise”, you must apply law to a client or party in a scenario.

For every legal point you make, follow a three-step golden rule. First, cite the legal rule or case authority accurately. Second, apply that rule to the facts or issue. Third, evaluate whether the rule works, whether exceptions apply, or how strong the argument is.

你提出的每一个法律观点,都应遵循三步黄金法则。第一,准确引用法律规则或判例权威;第二,把该规则适用于事实或争议;第三,评价该规则是否合理、是否存在例外,或者论点有多强。

For example, in negligence, do not just write “Donoghue v Stevenson created the neighbour principle”. Instead, explain that the principle established a duty of care based on reasonable foreseeability, apply it to the claimant, and then evaluate whether the modern Caparo test would be more suitable.

5. Answering Problem Questions: Use a Clear Framework | 案例题答题方法:使用清晰框架

For a problem question, use a clear framework such as IRAC: Issue, Rule, Application, Conclusion. Begin by identifying the legal issue raised by the facts, then state the relevant legal rule with authority, apply that rule directly to the facts, and finish with a reasoned outcome.

Do not restate the whole scenario. Select only the facts that matter for the legal issue. For example, if the issue is causation in criminal law, state the legal test from R v White and R v Smith, then explain why the defendant’s act was or was not an operating and substantial cause of the result.

Many students write “A is guilty because he intended to hurt B”. That is only a conclusion. A high-mark answer writes “The actus reus is satisfied because A’s act caused B’s injury. The mens rea is satisfied because A foresaw the risk and took it, as in R v Cunningham. Therefore A is likely guilty.”

6. Answering Essay Questions: Build a Sustained Argument | 论述题答题方法:构建持续论证

For essay questions, do not write everything you know about the topic. Plan a clear line of argument with an introduction, balanced paragraphs and a conclusion. Use the PEEEL structure: Point, Evidence, Explanation, Evaluation and Link back to the question.

论述题不要把所有知识都写进去。先规划清晰的论证主线,包括引言、正反两面的段落和结论。使用 PEEEL 结构:观点、证据、解释、评价、回扣题目。

A top essay does not simply list advantages and disadvantages. It weighs them and answers the question directly. If the question asks “Evaluate whether juries should be abolished”, your conclusion must state whether they should, based on the evidence you have considered.

Use counter-arguments to show evaluation. For example, “Although jury equity can produce fair results, it also creates inconsistency, which undermines the rule of law. On balance, this is a strong reason for reform.”

7. Using Cases and Statutes Effectively | 有效运用判例与法条

Case names should be accurate and relevant. You do not need to describe every fact of a case. Focus on the ratio decidendi, which is the legal reason for the decision, because that is the binding part used to solve later problems.

Use cases as tools, not decorations. For each case you cite, ask yourself: why am I citing this? If it supports a rule, say so. If it can be distinguished, explain how. For example, “R v Brown can be distinguished from R v Wilson because the harm in Brown was sadomasochistic violence rather than consensual personal adornment.”

Statutory sections should be cited where relevant, such as Section 18 of the Offences Against the Person Act 1861 for wounding with intent. A short, accurate citation is stronger than a vague reference to “the law”.

8. Time Management and Question Planning | 时间管理与题目规划

Before writing, spend at least five minutes planning each extended answer. This is not wasted time. A plan prevents rambling, missed issues and unbalanced answers.

Use a simple plan: list the legal issues, the rules and cases for each issue, and the evaluation points. For a 30-mark question, you might spend 5 minutes planning, 22 minutes writing and 3 minutes reviewing.

9. Common Mistakes That Lose Marks | 常见失分错误

One common mistake is repeating the facts without applying the law. For example, writing “Tom punched Dan and Dan fell” only repeats the scenario. Instead, explain “Tom’s act caused Dan’s injury, satisfying the actus reus of battery”.

一个常见错误是只重复事实而没有应用法律。例如,写“Tom 打了 Dan,Dan 摔倒了”只是复述案情。应改为“Tom 的行为导致 Dan 受伤,满足 battery 的 actus reus”。

Another mistake is listing case names without explaining their relevance. Do not write “See R v Miller” and move on. Explain what the case established and how it applies to the question.

Ignoring the command word is also dangerous. A “Discuss” question requires evaluation, not just explanation. A one-sided answer that never considers counter-arguments will stay in a lower mark band.

Finally, poor time allocation often causes candidates to write a brilliant first answer and a weak second answer. Balance your time so every question receives a full attempt.

10. Understanding Level Descriptors and Mark Band Language | 理解等级描述与分数段语言

CAIE Law uses level-based mark schemes rather than point-by-point marking. Each band describes the quality of knowledge, application and evaluation needed. Examiners use a “best fit” approach to place your answer in a band.

Top-band answers usually use accurate legal terminology, choose relevant cases, apply law precisely to the facts, and sustain an evaluation with a clear conclusion. Lower-band answers may show general knowledge but little analysis or evaluation.
