One of the most examined distinctions in IGCSE Law is the difference between criminal and civil cases. In criminal law, the state prosecutes a defendant, and the prosecutor must prove the case beyond reasonable doubt.

Obiter dicta are comments made by the way. They are not binding, but they can be persuasive. A common error is to treat obiter dicta as a binding rule.

Most criminal offences require both actus reus and mens rea. Actus reus can be an act, an omission where there is a legal duty, or a state of affairs. The mens rea may be intention or recklessness.

Common errors include forgetting to discuss causation in murder or manslaughter questions, assuming that motive equals intention, and saying that an omission always creates liability. 6. Fatal Offences: Murder and Manslaughter | 致命犯罪:谋杀与过失杀人

Murder is the unlawful killing of a reasonable creature in being under the King’s peace with malice aforethought, expressed or implied. The actus reus includes the killing, causation, and the victim being a human being.

Malice aforethought means intention to kill or intention to cause grievous bodily harm. Candidates often forget that an intention to cause serious harm is sufficient for murder, even if the defendant did not want death.

Involuntary manslaughter includes unlawful act manslaughter and gross negligence manslaughter. Gross negligence manslaughter requires a duty of care, a breach, a risk of death, and gross negligence.
