IGCSE Cambridge Law Essay Writing: Frameworks, Techniques and a Model Answer | IGCSE

📚 IGCSE Cambridge Law Essay Writing: Frameworks, Techniques and a Model Answer | IGCSE

In Cambridge IGCSE Law, strong essay answers are not just about remembering cases and statutes. Examiners reward clear structure, precise application of legal rules and balanced evaluation. This guide explains the main writing frameworks used in IGCSE Law and provides model answers to show how they work in practice.

Cambridge IGCSE Law assesses three main skills: AO1 knowledge and understanding of legal rules, AO2 application of the law to factual scenarios, and AO3 analysis and evaluation of legal arguments. A complete answer must show all three, not just list the law.

  • AO1 – Knowledge / 知识: define key terms, state case principles and statutory rules.
  • AO2 – Application / 应用: connect the rule to the facts of the question.
  • AO3 – Evaluation / 评价: weigh strengths and weaknesses, consider alternatives, reach a reasoned judgement.

2. Common Command Words Decoded |

Before writing, identify the command word because it determines the structure. The table below summarises the most common IGCSE Law command words and what they require.

Describe / 描述 State the main features / 说明主要特征 Give definitions and examples without evaluation / 给出定义和例子,无需评价
Link legal principles to the outcome / 将法律原则与结果联系起来
Discuss / 讨论 Present both sides / 呈现正反两方面 Include arguments and counter-arguments / 包括论点和反驳论点
Evaluate / 评价 Make a reasoned judgement / 作出有理由的判断 Weigh strengths and limitations, then conclude / 权衡优点与局限,然后下结论
Apply law to a client’s facts / 将法律适用于当事人事实 Use IRAC to identify liability and remedy / 使用 IRAC 确定责任和救济

3. The IRAC Framework for Problem Questions | 问题分析题 IRAC 框架

For scenario-based questions, the IRAC framework is the most reliable structure: Issue, Rule, Application and Conclusion. It keeps your answer focused on the facts and prevents you from writing a general essay about the topic.

Issue / 争议问题: identify the legal question, for example “Did D owe P a duty of care?”

Rule / 法律规则: state the relevant rule, case or statute, such as the neighbour principle from Donoghue v Stevenson [1932] AC 562.

Application / 应用分析: apply the rule to the facts, point by point. Explain why the facts satisfy or fail each legal test.

Conclusion / 结论: answer the client’s question directly, even if the outcome is uncertain.

4. The PEE and Evaluation Framework for Essay Questions | 论述题 PEE 与评价框架

For open essay questions such as “Evaluate the advantages of judicial precedent”, use a PEE-style structure: Point, Evidence, Explanation. Each paragraph should make a clear point, support it with a case or statute, and explain why it matters.

At the same time, evaluation questions require balance. You should not just describe advantages; you should also consider disadvantages or limits, and finish with an overall judgement. For example, precedent promotes consistency, but it may also make the law too rigid.

  • Evidence / 证据: “The ratio decidendi of Donoghue v Stevenson has been followed in later negligence cases.”
  • Explanation / 解释: “This allows lawyers to advise clients with confidence because lower courts must follow higher courts.”

5. Planning Before You Write |

Spend a few minutes planning before writing. Underline the command word, identify the topic, list the key cases or statutes you intend to use, and decide whether the question needs IRAC or PEE.

A simple plan for a 12-mark essay might look like this: introduction – define key term; paragraph 1 – first advantage with case; paragraph 2 – second advantage with case; paragraph 3 – limitation or counter-argument; conclusion – overall judgement.

6. Structuring the Introduction and Conclusion |

An introduction should be short. For a problem question, state the area of law and the parties: “This answer advises Pia on whether she can claim in negligence against Dina.” For an essay, define the key term and outline your argument.

A conclusion must directly answer the question. Do not introduce new material. In a problem question, say “Pia is likely to succeed” or “Pia’s claim is likely to fail” and briefly state the main reason. In an essay, sum up your judgement, for example “Precedent is more beneficial than problematic because its consistency outweighs its rigidity.”

7. Using Cases and Statutes Effectively |

When you cite a case, include the name and the legal principle it stands for, not just the facts. For example, write “Donoghue v Stevenson established the neighbour principle: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would injure your neighbour.”

For statutes, refer to the relevant section and apply it. For example, “Under s.1 of the Theft Act 1968, theft requires dishonestly appropriating property belonging to another with the intention to permanently deprive.”

8. Time Management in the Exam |

Allocate your time according to the number of marks. As a general guide, spend around one minute per mark, but always leave a few minutes at the end to check for missing conclusions or missed applications.

If a question asks you to answer two parts, divide your time proportionally. Do not spend too long on a low-mark describe question and leave no time for a high-mark evaluate question.

9. Model Answer: Negligence Problem Question |

Dina owns a small cafe. After mopping the floor, she goes to answer the telephone and forgets to put out a ‘wet floor’ sign. Pia, a customer, walks across the damp floor, slips and breaks her arm. Advise Pia whether she has a claim in negligence against Dina.

Did Dina owe Pia a duty of care, breach that duty, and cause Pia’s injury?
Under Donoghue v Stevenson, a person owes a duty to their ‘neighbour’ – anyone who is closely and directly affected by their actions. Under Caparo Industries v Dickman, a duty arises where harm is foreseeable, there is proximity, and it is fair, just and reasonable to impose a duty. Breach is judged by the standard of the reasonable person. The claimant must also prove factual causation using the ‘but for’ test.
Pia is a customer lawfully on the cafe premises, so there is clear proximity. It is reasonably foreseeable that a customer could slip on a damp floor and suffer injury if no warning sign is used. Dina created the hazard by mopping and failed to place a sign; a reasonable cafe owner would have placed a sign or dried the floor promptly. The ‘but for’ test is satisfied: but for the damp floor, Pia would not have slipped.
Pia is likely to succeed in negligence. However, if Dina shows that Pia ignored visible warning signs or was not looking where she was going, damages might be reduced for contributory negligence.

10. Model Answer: Advantages of Judicial Precedent |

Discuss the advantages of judicial precedent.

A good answer would begin by defining judicial precedent as the principle that lower courts must follow the legal reasoning, or ratio decidendi, of higher courts in earlier similar cases. It would then develop three advantages with examples.

  • Consistency and certainty / 一致性与确定性: like cases are decided alike, so people and businesses can plan their affairs with confidence.
  • Flexibility through distinguishing / 通过区别案件实现灵活性: courts can find differences in facts to avoid an unjust result.
  • Efficiency / 效率: following precedent saves time because established principles do not need to be re-argued in every case.

However, a discuss question also requires limitations. Precedent can be rigid if a bad decision is followed too strictly, and distinguishing may be inconsistent. Overall, judicial precedent brings more benefits because fairness in individual cases can be achieved through distinguishing and overruling by higher courts.

11. Common Mistakes to Avoid |

Many candidates lose marks by reciting case facts instead of applying the legal principle to the question, writing one-sided answers to discuss or evaluate questions, forgetting a conclusion, and using irrelevant cases. Avoid these by planning and following IRAC or PEE.

  • Writing a case summary instead of application /
  • No counter-argument in evaluate questions /
  • Missing final judgement /
  • Using legal jargon without explanation /

12. Final Checklist |

Before moving to the next question, check your answer against this short checklist. It will help you avoid losing marks for structure and application.

  • Did I identify the command word? /
  • Did I state the relevant rule before applying it?
  • Did I use at least one case or statute for every major point? /
  • Did I include a counter-argument where the question asks for evaluation? /
  • Did I reach a clear conclusion? /
