A common mistake is treating ‘explain’ as ‘define’. If a question asks you to explain the defence of consent, you should not simply say ‘consent is a defence’. You must explain how it operates, when it is valid, and what limits apply, using legal examples.

Rule means stating the relevant legal rule, including the statute or case that creates it. Application means applying the rule to the specific facts step by step. Conclusion means giving a clear, supported outcome.

Say ‘the defendant picked up the victim’s bag and walked out of the shop without paying, which amounts to appropriation because he assumed the rights of the owner.’

Explain how that evidence supports your point. Then link back to the question or to your overall argument.

Another might argue that it can be unfair to a defendant who took all reasonable care, citing Harrow LBC v Shah.

Accurate use of case names and statutory references demonstrates AO1 knowledge. For negligence, cite Donoghue v Stevenson. For theft, cite the Theft Act 1968. For non-fatal offences, cite the Offences Against the Person Act 1861. Do not just name a case; explain its legal principle. Write, for example: ‘In Donoghue v Stevenson, the House of Lords established the neighbour principle, meaning manufacturers owe a duty of care to the ultimate consumer.’

Case names do not need to be perfectly memorised if the exam board does not require underlining, but they must be recognisable and linked to the correct principle. If you are unsure of a case name, you can sometimes refer to the principle, but using the case name strengthens your answer and signals confidence.

High-scoring answers avoid the ‘all AO1’ trap. If a question is worth 12 marks, do not spend 10 marks repeating definitions. Instead, outline the law briefly, spend most of your time applying it, and finish with an evaluative comment. A useful ratio for extended answers is roughly 30% AO1, 40% AO2 and 30% AO3, but this must follow the question wording.

As a guide, spend roughly the number of minutes equal to the marks available, but reserve five minutes for planning and five minutes for checking. A 10-mark question deserves about 10 minutes. Never spend 20 minutes on a 5-mark question while leaving a 15-mark question unfinished.

These errors often keep candidates in the lower mark bands even when they know the law.
