Refer to statutes by short title and section, such as Theft Act 1968 s.1. Distinguish ratio decidendi from obiter dicta: examiners want the binding reason, not passing remarks. Every authority should be followed by one sentence explaining its relevance.

However, in Caparo, auditors did not owe a duty to potential investors as the relationship lacked proximity. This three-stage test is criticised for being circular: fair, just and reasonable can conceal policy choices rather than legal principle. Nevertheless, it remains the default framework in novel duty situations.’
