📚 Constitutions | 宪法
A constitution sets out the fundamental rules, principles and structures by which a state is governed. In A-Level Politics, studying constitutions helps you understand where power lies, how rights are protected, and whether the rules of the political game are codified or based on convention. For Edexcel, the focus is mainly on the UK constitution, with comparisons to the US model.
1. Definition and Purpose of a Constitution |
A constitution is the set of rules that establishes the duties, powers and functions of government institutions and regulates the relationship between the state and the individual. Its main purposes are to allocate power, provide legitimacy, protect rights and limit arbitrary rule.
In a liberal democracy, a constitution is expected to ensure that power is exercised according to law and that citizens know the basic rules of the political system.
Constitutions also create a framework for resolving political conflicts peacefully, because they set out who is entitled to make decisions and how those decisions can be challenged.
2. Features of the UK Constitution |
The UK constitution is often described as uncodified, unentrenched, flexible and unitary, although devolution has made the unitary label more contested.
Because it is not contained in a single legal document, it has evolved over time through statutes, common law and conventions rather than being created at a single constitutional moment.
A further feature is parliamentary sovereignty, which means that Parliament, rather than a constitutional court, is the supreme legal authority. This gives the UK constitution its distinctive flexibility.
3. Sources of the UK Constitution |
The main sources of the UK constitution include statute law, common law, royal prerogative, constitutional conventions and authoritative works.
Statute law refers to Acts of Parliament that have constitutional significance, such as the Human Rights Act 1998 and the Scotland Act 1998. These are the highest form of legal source.
Constitutional conventions are non-legal rules that are nonetheless binding in practice, for example the convention that the monarch gives royal assent to bills passed by Parliament.
Common law decisions by judges, such as the protection of residual rights, and works of authority like Dicey’s Introduction to the Study of the Law of the Constitution also shape constitutional understanding.
4. Parliamentary Sovereignty |
Parliamentary sovereignty, associated with A.V. Dicey, has traditionally meant that Parliament can make or unmake any law, that no Parliament can bind its successors, and that no court can strike down primary legislation.
In recent years, sovereignty has been qualified by EU membership, devolution, the Human Rights Act and judicial review, although after Brexit the EU constraint has been removed.
Nevertheless, Parliament remains legally sovereign because it can in principle repeal any of these arrangements. The doctrine remains central to the UK constitution even if its practical force has been diluted.
5. The Rule of Law | 法治
The rule of law is a key constitutional principle, classically summarised by Dicey as the absence of arbitrary power, equality before the law, and the protection of rights through the common law.
It ensures that government action must be lawful, reasonable and subject to challenge in the courts. The courts can therefore review ministerial decisions through judicial review.
In the UK, the rule of law operates alongside parliamentary sovereignty, which can create tension if Parliament passes legislation that appears to breach fundamental rights.
6. Separation of Powers |
The separation of powers divides government into the legislature, executive and judiciary to prevent the concentration of power. Each branch should be checked by the others.
The UK has a partial separation of powers: the executive is drawn from Parliament, creating a fusion of powers, but the judiciary has become more independent, especially after the Constitutional Reform Act 2005.
That Act created the Supreme Court and reduced the role of the Lord Chancellor, strengthening judicial independence and the appearance of a clearer separation between law and politics.
The Labour governments of 1997-2010 introduced major constitutional reforms, including devolution to Scotland, Wales and Northern Ireland, the Human Rights Act 1998, and the Freedom of Information Act 2000.
Further reforms included removing most hereditary peers from the House of Lords, establishing the Supreme Court in 2009, and creating elected mayors in some English cities.
These reforms have made the constitution more pluralist and legally protected, but critics argue they were piecemeal and unfinished. For example, the House of Lords remains largely appointed, and devolution is asymmetric.
8. Should the UK Adopt a Codified Constitution? |
Supporters of a codified constitution argue that it would provide clarity, better protect rights, limit executive power and modernise the political system.
A codified document would make citizens more aware of their rights and would entrench key principles so that a simple parliamentary majority could not remove them.
Opponents reply that the current uncodified system is flexible, has worked for centuries, avoids judicial overreach and preserves parliamentary sovereignty.
