The Comparative Powers of the House of Commons and House of Lords |

📚 The Comparative Powers of the House of Commons and House of Lords |

In the UK Parliament, the House of Commons and the House of Lords have distinct but overlapping roles. The Commons is the elected, democratic chamber and enjoys primacy in most areas, especially financial matters. The Lords is an unelected revising and scrutinising chamber whose main power is to delay and amend legislation rather than to block it outright.

1. Composition and Democratic Mandate |

The House of Commons is made up of 650 Members of Parliament elected by constituencies under the first-past-the-post system. This gives the Commons a direct democratic mandate from the electorate. The House of Lords consists of around 800 peers, including life peers, 92 hereditary peers (due to ongoing reform), and 26 Church of England bishops. None of these members are elected by the public.

The difference in democratic legitimacy is the root of the Commons’ superiority. The elected chamber can claim to speak for the people, while the Lords must justify its role as a revising body with expertise rather than electoral authority.

2. Legislative Powers: Initiation and Debate |

Most government bills are introduced in the House of Commons, and all major legislation must pass both Houses to become law. However, the Commons normally dominates the legislative timetable because it controls the government through party discipline. The Lords can introduce its own bills, but these rarely become law without government support.

In practice, the Commons has the power to overturn Lords amendments, although it often accepts some amendments after negotiation. The Lords can ask the Commons to ‘think again’ but cannot ultimately insist if the Commons uses its majority to reject changes.

3. Financial Privilege of the Commons |

One of the most important constitutional differences is financial privilege. Under the Parliament Act 1911 and long-standing convention, the House of Commons has exclusive control over taxation and public spending. The House of Lords cannot amend or reject a ‘money bill’ – a bill dealing solely with national taxation, public money or loans.

The Speaker of the House of Commons certifies whether a bill is a money bill. Once certified, the Lords may only delay it for one month, and the bill can receive Royal Assent without the Lords’ consent. This ensures that the elected chamber holds the public purse strings.

4. Power to Delay: The Parliament Acts 1911 and 1949 | 延迟权力:1911 年与 1949 年《议会法》

The Parliament Act 1911 removed the Lords’ absolute veto over legislation and replaced it with a suspensory veto of two years. The Parliament Act 1949 reduced this delaying power to one year. Today, if the Commons passes a bill in two successive sessions and one year has elapsed, the bill can become law without the Lords’ consent, except for money bills (which have a one-month delay) and bills to extend the life of Parliament.

This means the Lords’ veto is no longer absolute but suspensory. It can force the government and the Commons to reconsider and possibly amend a bill, but it cannot permanently block a determined Commons majority.

5. Amendment and Revision Role of the Lords |

Although the Lords cannot ultimately defeat most bills, it performs a vital revising function. Because many peers are former ministers, senior judges, scientists, business leaders and other experts, the Lords often improves the technical quality of legislation and protects civil liberties.

The Commons is often constrained by party whips and the need to pass manifesto commitments quickly, so it may leave drafting errors or overlook consequences. The Lords can debate in a less partisan atmosphere and propose detailed amendments that the Commons may accept because they are not politically embarrassing.

6. Scrutiny and Accountability of Government |

Both Houses hold the government to account, but the Commons has stronger formal powers. Ministers are drawn from Parliament, usually the Commons, and they must answer questions, appear before select committees and face votes of no confidence. The Prime Minister and Chancellor must be MPs, by convention, and they are directly accountable to the Commons.

The Lords also scrutinises government through debates, questions and its own committees, such as the Constitution Committee and the European Union Committee (when the UK was a member). However, it cannot remove a government by a vote of no confidence, and no minister is accountable solely to the Lords.

7. The Confidence Convention and Government Survival |

The government’s survival depends exclusively on the confidence of the House of Commons. By convention, if a government loses a vote of no confidence, it must resign or seek a dissolution of Parliament. The House of Lords has no role in this process.

The Lords can criticise government policy and even defeat individual policy motions, but it cannot bring down a government. This is a fundamental difference in constitutional power: the elected chamber controls the executive, while the Lords can only influence and delay.

8. The Salisbury Convention and Other Constraints |

The Salisbury-Addison Convention states that the House of Lords should not reject or wreck a bill that gives effect to a government manifesto commitment. This convention arose from the Labour government of 1945, when the Lords had a large Conservative majority, and it prevents the unelected chamber from frustrating the democratic will expressed at a general election.

Other conventions also limit the Lords: it does not vote on money bills, it normally gives a second reading to government bills, and it avoids frivolous obstruction. These conventions are not legally enforceable but are politically binding.

9. Constitutional and Human Rights Scrutiny |

The House of Lords has developed a significant role in examining the constitutional implications of legislation. Its Constitution Committee reviews bills for their impact on the rule of law, devolution, and the separation of powers. Similarly, the Joint Committee on Human Rights, which includes members from both Houses, reports on human rights compatibility.

In these areas the Lords often exerts more influence than its formal powers suggest. Government defeats in the Lords on human rights grounds can force ministers to amend bills even when the Commons initially passed them. Recent examples include amendments to counter-terrorism and immigration legislation.

10. Composition and Reform Debates |

The unelected nature of the House of Lords has led to constant calls for reform. The House of Lords Act 1999 removed most hereditary peers, leaving only 92 as a temporary
