CIE A-Level Law: Core Concepts and Study Plan | CIE A-Level

📚 CIE A-Level Law: Core Concepts and Study Plan | CIE A-Level

The CIE A-Level Law syllabus is designed to develop a critical and analytical understanding of the legal system in England and Wales, including its institutions, processes and principles. It requires students to think like lawyers: to identify legal issues, apply rules to factual scenarios, evaluate doctrines and construct persuasive arguments.

CIE A-Level

1. Overview of the Syllabus |

The course is normally divided into AS and A2 components. The AS level covers the English legal system and the sources of law, while the full A Level adds criminal law, tort law and contract law. Each paper tests both knowledge and the ability to apply that knowledge to problem scenarios or essay questions.

Understanding the assessment objectives is essential. CIE exams reward not only accurate recall but also analysis, evaluation and structure. A typical candidate must learn a core body of case law, statutory definitions and judicial reasoning patterns.

2. English Legal System |

The English legal system is the foundation of the whole syllabus. You should understand the hierarchy of courts, from the Supreme Court down to the Magistrates’ Court, and know which court hears civil or criminal cases at first instance and on appeal.

Key topics include the role of the judiciary, juries, magistrates and legal professionals such as barristers and solicitors. You should be able to evaluate the advantages and disadvantages of trial by jury and the effectiveness of legal aid in providing access to justice.

  • Civil courts: County Court, High Court, Court of Appeal (Civil Division), Supreme Court.
  • Civil courts: County Court, High Court, Court of Appeal (Civil Division), Supreme Court.
  • Criminal courts: Magistrates’ Court, Crown Court, Court of Appeal (Criminal Division), Supreme Court.
  • Legal personnel: judges, magistrates, juries, barristers, solicitors, legal executives.

When writing about the English legal system, do not simply list courts. Instead, explain how the structure supports stare decisis and the appeal process. This creates a bridge between the institutional content and the later topic of judicial precedent.

3. Sources of Law |

The main sources of law in the English legal system are legislation (primary and secondary), judicial precedent, custom and, historically, European Union law. Since Brexit, the role of EU law has changed, but retained EU law still appears in many areas such as employment and consumer protection.

You must be able to compare the advantages and disadvantages of each source. For example, statute law is democratically legitimate and provides clarity, while precedent offers flexibility and consistency. However, statute can be complex and slow, and precedent depends on an accurate law reporting system.

Legislation | 立法

The process of an Act of Parliament becoming law involves the House of Commons, the House of Lords and royal assent. Delegated legislation, such as statutory instruments, saves parliamentary time but raises concerns about democratic accountability.

Judicial Precedent |

The doctrine of binding precedent relies on the court hierarchy and the Latin principle of stare decisis. Courts are bound by the ratio decidendi of higher courts, while obiter dicta are merely persuasive. Law reports, especially the Weekly Law Reports, are of central importance.

下级法院受上级法院判决中的 ratio decidendi(判决理由)约束,而 obiter dicta(附带意见)仅具说服力。

4. Statutory Interpretation |

Judges interpret statutes using the literal rule, the golden rule, the mischief rule and the purposive approach. You should know classic cases for each rule, such as Whitely v Chappell for the literal rule and Smith v Hughes for the mischief rule.

Examiners often ask whether judges make law or merely apply it. You can argue that the literal rule respects parliamentary supremacy but may produce absurdity, while the purposive approach allows flexibility but risks judicial law-making. Use examples to sustain your argument.

5. Criminal Law: Actus Reus and Mens Rea |

Criminal law at A Level focuses on offences against the person, offences against property, and general defences. The two pillars of criminal liability are actus reus (the guilty act) and mens rea (the guilty mind).

刑事责任的两大支柱是 actus reus(犯罪行为)和 mens rea(犯罪意图)。

Actus reus must be voluntary and may include an omission where a legal duty exists. Cases such as Miller and Stone & Dobinson show how duties arise. Mens rea includes intention and recklessness. Direct intention is aim or purpose, while oblique intention may be inferred from virtual certainty, as in Woollin.

Liability = Actus reus + Mens rea − Defences

Murder and Manslaughter |

Murder requires the unlawful killing of a human being under the Queen’s peace with malice aforethought. Malice aforethought means intention to kill or cause serious bodily harm. Voluntary manslaughter arises with provocation, loss of control or diminished responsibility; involuntary manslaughter includes unlawful act manslaughter and gross negligence manslaughter.

6. Criminal Law: Offences and Defences |

Property offences include theft, robbery, burglary and criminal damage. Theft is defined by the Theft Act 1968: dishonestly appropriating property belonging to another with the intention of permanently depriving the other of it. Every element must be analysed separately.

For robbery, the theft must be accompanied by force or threat of force immediately before or at the time of the theft. For burglary, the defendant must enter a building as a trespasser with intent to commit one of the specified offences, or actually commit an offence after entering.

Defences include self-defence, duress, necessity, insanity and automatism. You must know the distinction between general and specific defences, and the legal rules that govern the burden of proof. Insanity uses the M’Naghten rules, and duress requires a threat of death or serious injury, as in Hasan.

7. Tort Law: Negligence |

Tort law protects individuals from harm caused by the wrongful acts of others. The most examined tort is negligence. To succeed in a negligence claim, the claimant must prove a duty of care, a breach of that duty, and resulting damage that is not too remote.

Duty of care is established by the Caparo test: foreseeability of harm, proximity between claimant and defendant, and fairness, justice and reasonableness. Breach is assessed by comparing the defendant’s conduct with that of the reasonable person, considering factors such as likelihood of harm and practical precautions.

Causation requires proof on the balance of probabilities: the defendant’s breach must have materially contributed to the harm. You should know the ‘but for’ test in Barnett v Chelsea Hospital and the special rule for multiple causes in McGhee and Fairchild.

8. Contract Law: Formation and Breach |

A contract is a legally binding agreement. Formation requires offer, acceptance, consideration, intention to create legal relations and capacity. An offer must be distinguished from an invitation to treat. Acceptance must be communicated, although postal rule exceptions exist.

Consideration is the price paid for the promise, and it must move from the promisee. It must be sufficient but need not be adequate. Consideration cannot be past, except in special circumstances. Intention to create legal relations is presumed in commercial agreements but not in domestic or social agreements.

Breach of contract occurs when a party fails to perform their obligations. Remedies include damages, specific performance, injunctions and rescission. Damages aim to put the claimant in the position they would have been in had the contract been performed, subject to remoteness rules from Hadley v Baxendale and the duty to mitigate.

9. Applying Law to Scenarios |

CIE Law examinations frequently use problem questions that present a set of facts. To answer well, deploy the IRAC structure: Issue, Rule, Application, Conclusion. Issue identifies the legal question; Rule states the relevant law and cases; Application applies the law to the facts; Conclusion states the likely outcome, often on the balance of probabilities.

Consider two possible outcomes to show evaluative thinking. For example, in a theft problem, argue that Gordon has taken the item but not necessarily appropriated it because he did not assume a right to it until later; then conclude with the most likely judicial interpretation.

  • Identify the parties and each potential claim or offence.
  • Define the legal test in precise statutory or case language.
  • Apply each element to a separate fact, not the whole story at once.
  • Conclude with a clear ‘likely outcome’ and mention doubts if needed.

10. Case Law and Statutory Memory Techniques |

The biggest challenge in CIE Law is remembering a large number of cases, definitions and statutory provisions. Instead of memorising isolated names, organise cases by legal principle and use a two-column table: one column for the rule, one for the case name and a key fact.

Woollin (boy thrown into pram, death by shaking) | Woollin 案
Duty to act can arise from relationship | 基于关系产生行动义务 Stone & Dobinson (sister with anorexia) | Stone & Dobinson 案
Remoteness of damage in contract | 合同中的间接损害 Hadley v Baxendale (mill shaft delay) | Hadley v Baxendale 案

Use active recall and spaced repetition. Read a case summary, close the book and try to write the rule and a fact. If you can explain it to another student, you know it well. For statutory definitions, highlight the operative words and create a mnemonic for the order of elements.

11. Study Planning for CIE A-Level Law | CIE A-Level

A successful revision plan starts early and builds in regular exam practice. In the first term, focus on understanding the English legal system and sources of law. In the second term, move to criminal law and tort. In the final term, revise all topics and practise past papers under timed conditions.

Weekly study time of four to six hours is reasonable for most students. Two hours should be spent reading and creating summaries, two hours applying law to past paper questions, and one hour reviewing errors. Another hour can be used for memorising cases with flashcards.

  • Month 1-2: English legal system and statutory interpretation |
  • Month 3-4: Sources of law and precedent |
  • Month 5-6: Criminal law (actus reus, mens rea, specific offences) |
  • Month 7-8: Tort and contract law |
  • Month 9-10: Full past papers, essay planning and weak-topic review |

12. Common Mistakes and Final Advice |

A frequent mistake is writing about a case without stating the legal principle it establishes. Exam marks are given for using the principle to answer the question, not for listing cases. Always connect authority to argument.

Another mistake is ignoring the command words. ‘Explain’ requires a clear description of legal rules; ‘Discuss’ or ‘Evaluate’ requires a balanced argument with a conclusion; ‘Advise’ requires application of law to facts. Read each question twice and underline the command word.

Finally, maintain a case log organised by topic. Before the exam, you should be able to recall the major cases for duty of care, breach, causation, theft, murder, self-defence, offer and acceptance. When you feel confident with the core, try to explain each topic from memory in under five minutes.
