📚 What Is an EHC Plan? Special Educational Needs Provision from 0 to 25 | EHC

An Education, Health and Care (EHC) plan is the statutory document that specifies the special educational provision for a child or young person in England aged 0 to 25 whose needs cannot be met through the support normally available in schools, colleges and early years settings. Introduced by the Children and Families Act 2014 and in force since September 2014, it replaced Statements of Special Educational Needs for children and Learning Difficulty Assessments for young people over 16, merging education, health and social care into one legally enforceable plan. For students of education policy, sociology of education and public law, the EHC plan is a rich case study in how rights, resources and responsibilities are distributed between families, schools, local authorities and the National Health Service.

1. What an EHC Plan Actually Is | EHC

An EHC plan is not a diagnosis, a funding application or a medical record. It is a legal document issued by a local authority in England that identifies a child or young person’s special educational needs, states the outcomes they should work towards, and sets out the provision that must be made to help them achieve those outcomes. In policy terms it converts an assessed need into an enforceable entitlement.

Once finalised, the plan creates binding duties. The local authority must secure the special educational provision listed in section F; if a school or college is named in section I, that institution must admit the child and must use its best endeavours to deliver the provision. Health and social care partners have parallel duties in relation to their own sections of the plan.

It is a single, integrated plan spanning three service systems, and its birth-to-25 scope is unusual internationally. The plan travels with the young person across phases and institutions — from nursery to primary, primary to secondary, secondary to college — and remains in force until the local authority formally ceases it.

2. The Legal Framework Behind the Plan | 支撑 EHC 计划的法律框架

The primary legislation is Part 3 of the Children and Families Act 2014, which created the duty to identify and support children with special educational needs, the EHC needs assessment, the EHC plan itself, and the Local Offer. It also gave young people aged 16 to 25 rights that previously belonged only to parents.

Secondary legislation and guidance fill in the detail: the Special Educational Needs and Disability Regulations 2014 set out procedures and timescales, while the SEND Code of Practice: 0 to 25 years (2015) is statutory guidance that local authorities, schools, colleges and health bodies must have regard to. Wider duties come from the Equality Act 2010 on reasonable adjustments and disability discrimination, and from the Care Act 2014 on adult social care.

The Local Offer is a parallel duty: every local authority must publish accessible information about the provision it expects to be available for children and young people aged 0 to 25 with SEN or disabilities, covering education, health, social care and travel. Parents and young people also have a statutory right to impartial information, advice and support through a SENDIASS service, and Independent Supporters are often funded to help families through the assessment process.
