Understanding law at Key Stage 3 means unlearning many ideas we pick up from films, friends or family. This article explores the most common misunderstandings Year 7 students have when they first study OCR Law and shows clear ways to correct them, so you can build a solid legal foundation from the start.

1. Law Is Just Like School Rules | 1. 法律就像学校规则

Many pupils believe that breaking a law is no different from breaking a school rule, perhaps just leading to a telling-off or a detention. They see both as sets of instructions and assume similar consequences.

In reality, laws are made by Parliament and enforced by courts, police and other state bodies. Breaking a criminal law can lead to arrest, a criminal record and even imprisonment, which are much more serious than school sanctions.

Although judges can shape law through precedent (decisions in higher courts that lower courts must follow), the supreme law-making body in the UK is Parliament. Sentencing options in England and Wales are highly varied. For less serious offences, courts can impose fines, community orders, compensation orders or conditional discharges. Criminal law deals with behaviour the state considers harmful to society, and the case is brought by the Crown Prosecution Service. The outcomes also differ: criminal cases can lead to punishment, while civil cases usually result in compensation.

It feels logical to a young person that if you did not know something was against the law, you should not be punished. This assumption surfaces in every classroom.

The legal principle “ignorantia juris non excusat” means ignorance of the law is no excuse. Every citizen is expected to know the law, even if that is impossible in practice. Courts will not accept “I didn’t know it was illegal” as a defence, although in very rare cases genuine and reasonable mistake about a specific legal element might affect liability.
