📚 Quick Reference Handbook of Legal Formulas and Theorems |
Welcome to your quick-reference guide for Year 7 SQA Law. Like science and mathematics, law has its own ‘formulas’ and ‘theorems’ – core principles that help us understand how rules, rights and justice work in Scotland and beyond. This handbook collects the most important legal equations, definitions and reasoning tools you will need for your S1 studies.
1. The Basic Equation of Law |
At its simplest, law can be expressed as a deceptively straightforward equation: Law = Rules + Consequences. Rules set out what we must or must not do – for example, the Road Traffic Act 1988 tells us to drive on the left in Scotland. Consequences are the penalties or remedies that apply when rules are broken. Without consequences, legal rules would be no more than polite suggestions. In Scotland, the justice system ensures that every breach is met with a measured response, from fines to imprisonment.
Law = Rules + Consequences
2. The Rule of Law Principle |
The Rule of Law is the supreme theorem of any democratic society: No one is above the law. This means everyone – citizens, police officers, government ministers and even the First Minister of Scotland – must obey the law. The principle ensures that power is exercised according to published rules, not personal whim. It was famously described by jurist A.V. Dicey and remains central to the Scottish legal system, binding all public authorities to act lawfully.
法学家A.V.
Rule of Law = No One Above the Law
3. The Justice Formula |
We can think of justice as a product of two indispensable factors: Justice = Fairness × Equality. If either factor is zero, the whole product collapses. Fairness means applying legal rules consistently and without bias; equality requires treating like cases alike, irrespective of a person’s wealth, background or identity. In a Scottish sheriff court, the sheriff applies the same legal tests whether the party before them is a large corporation or a private individual.
Justice = Fairness × Equality
4. Rights and Responsibilities Balance |
Every right in law has a corresponding responsibility; the two are inseparably linked: Rights ⟷ Responsibilities. The right to free speech, protected in Scotland by the European Convention on Human Rights, comes with the responsibility not to incite violence or spread malicious falsehoods. The right to education imposes a duty on parents to ensure their children attend school. Understanding this balance helps citizens exercise their freedoms without harming others.
Rights ⟷ Responsibilities
5. Sources of Law: The Dual Engine |
Scottish law draws from two principal sources plus a distinctive historical supplement: Statute Law + Common Law (+ Institutional Writings). Statute law is the written legislation passed by the UK Parliament at Westminster or the Scottish Parliament at Holyrood. Common law is the body of rules developed by judges through decisions in individual cases over centuries. Scotland additionally respects the “institutional writers” such as Stair and Erskine, whose 17th- and 18th-century works still carry persuasive authority.
Sources of Scots Law = Statute + Common Law + Institutional Writings
6. Criminal vs Civil Law: Two Different Worlds |
Law divides into two fundamental branches, each with its own logic and vocabulary. Criminal law deals with wrongs against society as a whole; in Scotland a case is raised by the Procurator Fiscal against the accused. Civil law resolves disputes between private parties: a pursuer (the Scottish term for claimant) sues a defender for a remedy such as damages. The standard of proof also differs – criminal cases require proof “beyond a reasonable doubt”, while civil cases rely on the “balance of probabilities”.
| Feature | Criminal Law | Civil Law |
| Parties (Scotland) | Procurator Fiscal v Accused | Pursuer v Defender |
| Purpose | Punishment, deterrence | Compensation, enforcement of rights |
| Standard of proof | Beyond a reasonable doubt | Balance of probabilities |
7. The Presumption of Innocence Theorem |
One of the strongest protections in Scottish criminal law is the presumption of innocence. The theorem states: Accused = Innocent until proven guilty. It is never the job of the accused to prove their innocence; the burden of proof lies entirely with the prosecution. Only if the Crown can present sufficient evidence to satisfy a judge or jury beyond a reasonable doubt can a conviction be secured. This theorem is a cornerstone of a fair trial.
Presumption of Innocence = Innocent Until Proven Guilty
8. Court Hierarchy: The Legal Ladder |
Scottish courts are arranged in a clear hierarchy, which can be visualised as a ladder of authority: Justice of the Peace Court → Sheriff Court → High Court of Justiciary → UK Supreme Court. The Justice of the Peace Court deals with minor offences and some civil matters. The Sheriff Court handles the majority of serious criminal and civil cases. The High Court of Justiciary is Scotland’s supreme criminal court, while the UK Supreme Court in London is the final court of appeal for most Scottish civil cases. This structure ensures that decisions can be reviewed and that serious matters receive the highest level of scrutiny.
Court Hierarchy: JP Court → Sheriff Court → High Court → UK Supreme Court
9. From Bill to Act: The Legislative Process |
A new law does not appear overnight; it follows a strict constitutional path. The formula for legislation in the Scottish Parliament is: Bill → Stage 1 (General Principles) → Stage 2 (Detailed Amendments) → Stage 3 (Final Vote) → Royal Assent → Act. Once a Bill passes all three stages and receives Royal Assent from the monarch, it becomes an Act of the Scottish Parliament and has the force of law. This process ensures thorough debate and democratic scrutiny.
Bill → 3 Stages → Royal Assent → Act of Parliament
10. Legal Reasoning: Applying Law to Facts |
Judges and lawyers use a powerful reasoning formula every day: Facts + Law → Decision. The process begins by identifying the relevant facts of a case – who did what, when and where. Next, the applicable legal rule is located, whether in a statute or a precedent. Finally, the rule is applied to the facts to reach a logical conclusion. This syllogism lies at the heart of legal analysis and helps ensure consistent, predictable outcomes.
Facts + Law → Decision
