She sued the manufacturer, Stevenson, even though she had no contract with him.

Rule: Lord Atkin’s ‘neighbour principle’: ‘You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Who, then, in law, is my neighbour? … persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation.’

Application: Stevenson manufactured and sealed the ginger beer. He knew it would be consumed by someone beyond the retailer. It was reasonably foreseeable that a snail in the bottle would cause illness, and the opaque bottle meant the consumer could not protect herself. The relationship was sufficiently proximate. No public policy reason shielded Stevenson from liability.

Conclusion: The House of Lords held (by majority) that a duty of care existed. Mrs Donoghue’s claim could proceed. This case gave birth to the modern law of negligence.

Tom says it was an accident and he did not mean to cause damage.

Issue: Is Tom liable for the damage caused by his ball, even though he did not intend to break the glass?

Rule: Under the tort of trespass to goods or negligence, a person owes a duty to take reasonable care not to cause damage to another’s property. In cases of accidental damage, the court looks at the defendant’s actions – were they careless in all the circumstances? The Children and Young Persons Act 1933 does not exclude liability for children; however, the standard of care expected of a child is that of a reasonable child of the same age.

Application: Tom was kicking a ball near a boundary. A reasonable 12-year-old would appreciate that a hard kick near a fence risks the ball going over and damaging something. Kicking against the wall, with less control over rebound, increased that risk. Tom did not take steps to move away from the fence or use a softer ball. His conduct fell below the standard of a reasonable child of his age. The argument that he ‘did not mean it’ is not a full defence – carelessness, not just intention, can create liability.

Conclusion: A court would likely find Tom liable for the cost of the greenhouse panel, £200. However, as a minor, a parent or guardian might ultimately be responsible for the payment, depending on local law. This example shows how even everyday accidents can raise legal duties.

Consider: What is the legal issue? (Hint: private nuisance). Research what the rule on nuisance requires – unreasonable interference with the use or enjoyment of land. Apply the facts: duration, time of day, alternatives available to Sam, effect on Li. Then reach a reasoned conclusion. Share your analysis with a classmate and compare reasoning.
