1. What is Law? |
Law is a set of rules made by the state that everyone in society must follow. It applies to all people equally, no matter who they are. Unlike rules in a game or in your home, laws are enforced by courts and the police. If you break a law, there can be serious consequences, such as a fine or even imprisonment. Law exists to protect people, property, and our way of life. It helps us live together peacefully by setting clear boundaries of acceptable behaviour. In Northern Ireland, many laws are made by the UK Parliament, but some are made by the Northern Ireland Assembly.
2. Rules vs Laws |
Rules and laws are similar because they both guide how we behave, but they are not the same. Rules are usually made by smaller groups, like a school, a sports club, or a family. The consequences for breaking a rule are usually less severe – you might get a detention, a yellow card, or lose screen time. Laws are created by the government and apply to everyone in the country. Breaking a law can lead to the police getting involved and a case going to court. Another key difference is that laws are written down and published officially, while rules can sometimes be informal or spoken.
3. Why Do We Need Laws? |
Without laws, society would be chaotic and unsafe. Laws protect our basic rights, such as the right to life, to own property, and to speak freely. They also keep order by telling us what we can and cannot do, like driving on the correct side of the road. Laws provide a way to settle disputes peacefully instead of through violence. They protect the vulnerable, including children, and set standards for businesses and public services. In short, laws create a framework so that people can live, work, and grow in a fair and predictable environment.
4. Sources of Law |
Laws do not appear out of nowhere. In the United Kingdom, the main sources of law are Parliament (statute law) and the courts (common law). Statute law is created when Parliament passes an Act, such as the Education Act. Common law, also known as case law, is built up over time through decisions made by judges in earlier cases. Another source is European Union law, some of which still applies in Northern Ireland under the Windsor Framework. For some matters, the Northern Ireland Assembly can also pass its own legislation. International treaties can influence UK law too, especially in areas like human rights.
5. The Court System |
Courts are where legal disputes are heard and decided. Different courts deal with different types of cases. In Northern Ireland, the lowest criminal court is the Magistrates’ Court, which handles minor offences. More serious cases go to the Crown Court. Civil cases, like claims for compensation, are often heard in the County Court or the High Court. If someone is unhappy with a decision, they may be able to appeal to a higher court, such as the Court of Appeal. The highest court for most UK cases is the Supreme Court in London. Tribunal systems also exist to deal with specialised areas like employment or immigration.
6. Criminal vs Civil Law |
One of the most important distinctions in law is between criminal and civil cases. Criminal law deals with actions that are harmful to society as a whole, such as theft, assault, or damaging property. The state, usually through the Public Prosecution Service, brings the case against the accused person. If found guilty, the punishment might be a fine, community service, or a prison sentence. Civil law, on the other hand, settles disputes between individuals or organisations. Examples include disagreements over contracts, negligence claims, or family matters like divorce. The outcome is usually an order to pay money (damages) or to do something (an injunction).
7. Key People in the Legal System |
Many people work to make the legal system function. Judges are independent decision-makers who oversee court cases, make sure the process is fair, and pass sentence in criminal trials. Solicitors give legal advice to clients and often prepare cases before they go to court. Barristers represent clients in more complex court hearings. The police investigate crimes, gather evidence, and arrest suspects. In a criminal case, the prosecution lawyer presents the case against the defendant, while the defence lawyer argues for the defendant. The defendant is the person accused of the crime. Court clerks help the judge and manage administrative tasks.
8. The Role of the Police |
The police have a vital job: to keep the peace, protect life and property, and prevent and detect crime. In Northern Ireland, the Police Service of Northern Ireland (PSNI) is the main police force. Officers must follow strict rules about how they investigate crimes and arrest people. They can only use reasonable force and must read a suspect their rights, including the right to remain silent. The police also work closely with the community to build trust and solve problems before they become crimes. They are accountable to the law just like everyone else and can be complained about if they behave unlawfully.
9. The Jury System |
A jury is a group of ordinary citizens chosen at random to decide the facts in a court case. In Northern Ireland, juries are mainly used in Crown Court criminal trials. The jury’s job is to listen to the evidence presented by both sides and then reach a verdict: guilty or not guilty. The judge then decides the sentence if the defendant is found guilty. To serve on a jury, you must be aged between 18 and 70, registered to vote, and have no serious criminal record. Juries help make the legal system fair and democratic because the decision comes from members of the community, not just one judge.
10. Rights and Responsibilities |
With rights come responsibilities. Every person has fundamental human rights, like the right to education, the right to privacy, and freedom from torture. In the UK, the Human Rights Act 1998 makes these rights enforceable in domestic courts. Even young people have rights: for example, the right to be heard in family proceedings. However, we all have responsibilities too. We must respect the rights of others, obey the law, and not harm anyone. At school, you have the right to learn, but you also have the responsibility to behave well and not disrupt others. Understanding this balance is at the heart of being a good citizen.
11. How a Law is Made | 法律是如何制定的
Creating a new law in the UK is a detailed process. It starts with an idea for a Bill, which might come from the government, an MP, or a public campaign. The Bill is introduced into Parliament, where it goes through several stages of debate and scrutiny in both the House of Commons and the House of Lords. Committees examine the Bill in detail, and amendments can be made. If both Houses agree on the final version, the Bill goes to the Monarch for Royal Assent, which is usually a formality. Once Royal Assent is given, the Bill becomes an Act of Parliament and is now law. For some devolved matters in Northern Ireland, a similar process happens in the Northern Ireland Assembly.
12. Young People and the Law |
The law treats children and young people differently from adults in many ways. The age of criminal responsibility in Northern Ireland is 10, meaning a child under 10 cannot be charged with a crime. For young people aged 10–17, cases are usually heard in the Youth Court, which aims to rehabilitate rather than just punish. The law also gives young people extra protection, for example through special rules about employment, education, and protection from harm. At the same time, damaging property, stealing, or bullying can still lead to serious legal consequences for a young person. Knowing the law is your best protection.
