Actus Reus + Mens Rea = Crime
Actus reus is the physical act or omission that forms the external element of an offence. Mens rea is the mental element – the guilty mind, such as intention or recklessness. For most crimes, both must be present at the same time.

Unlawful Killing + Malice Aforethought = Murder
In English law, murder is the unlawful killing of a human being under the Queen’s peace with malice aforethought. Malice aforethought means an intention to kill or to cause really serious bodily harm. It does not require hatred or pre‑planning.

To succeed in a negligence claim, a claimant must prove that the defendant owed them a duty of care, breached that duty by falling below the standard of a reasonable person, and that the breach caused the claimant’s loss or injury, which was not too remote.

A legally binding contract requires a clear offer by one party and an unconditional acceptance by the other. Consideration is something of value exchanged between the parties (e.g. money for goods). Both sides must intend the agreement to be legally enforceable.

In criminal trials, the legal burden lies on the prosecution to prove every element of the offence so that the jury or magistrates are sure of guilt. This is the highest standard in English law.

A person may use such force as is reasonable in the circumstances to defend themselves or another from an imminent attack. The force must be proportionate to the threat; deadly force can be reasonable only if faced with a threat of death or serious injury.

This principle ensures the legal system functions fairly: if ignorance were a defence, anyone could avoid punishment by remaining willfully uninformed. Citizens are expected to make reasonable efforts to understand the rules that govern society.

9. Causation Chain | 因果关系链
Factual Causation (‘But For’ Test) + Legal Causation (No Intervening Act) = Causation Proved
To establish liability, the prosecution or claimant must prove causation. Factual causation uses the ‘but for’ test: but for the defendant’s act, would the harm have occurred? If the answer is no, factual causation is satisfied.

Legal causation requires that the defendant’s act made a more than minimal contribution to the outcome and that no new intervening act broke the chain of causation. A natural event or a third party’s grossly negligent medical treatment might break the chain.

Often called the ‘golden thread’ of English criminal law, the presumption of innocence means every defendant is considered innocent until proven guilty. It is for the prosecution to overcome this presumption with sufficient evidence.
