Common Misconceptions in Law for Year 8 and Their Corrections | Year 8 法律常见误区与纠正方法

📚 Common Misconceptions in Law for Year 8 and Their Corrections | Year 8 法律常见误区与纠正方法

Understanding law at Year 8 often comes with a bundle of popular myths. Many students confuse everyday rules with laws, think all wrongdoing is criminal, or believe courts are the only place to settle arguments. This article tackles the most common misconceptions in the CAIE Year 8 Law course and provides clear corrections to build a strong, accurate foundation.

1. The Law Is Just Any Rule |

A very common mistake is to think that any rule set at home, in school, or within a friendship group carries the same force as the law. A student might say, ‘My mum made a rule about screen time, so it is the law of our house.’

In reality, laws are created by Parliament, interpreted by courts, and apply to everyone in the state. Rules are set by smaller groups for specific, limited contexts. Non-compliance with a school rule might land you in detention; breaking a statute can lead to fines, criminal records, or imprisonment. Key differences lie in the source, the scope of people affected, and the consequences of breaking them.

Feature (特点) Law (法律) Rule (规则)
Creator (制定者) Parliament, courts Families, schools, clubs
Who must obey (遵守者) All citizens in the state Members of a specific group
Consequence of breach (违反后果) State punishment, fine, prison Disciplinary measures, detention

2. All Illegal Acts Are Crimes |

Many Year 8 learners believe that if something is ‘illegal’ it must mean you are a criminal. They assume that breaking a promise to repay money, littering, or trespassing on someone’s land are crimes just like theft.

Illegal acts fall into two big categories: criminal law and civil law. Criminal law deals with offences against the state, such as murder, burglary, and fraud. Civil law, on the other hand, deals with disputes between individuals or businesses, like breach of contract, negligence, or defamation. A civil wrong is not a crime, and the usual remedy is compensation, not imprisonment. Only Parliament can define an act as a crime through legislation.

Criminal Law (刑法) Civil Law (民法)
Offences against the state Disputes between individuals
Prosecution by the Crown Claimant sues the defendant
Punishment: prison, fines Remedy: damages, injunction

3. Criminal Law Only Deals with Murder and Theft |

When students picture a ‘crime’, they usually imagine violent acts or stealing. The idea that speeding, not wearing a seatbelt, or polluting a river are crimes often comes as a surprise.

Criminal law covers an enormous range of conduct, not just offences against the person and property. There are regulatory crimes (like health and safety breaches), traffic offences, white-collar crimes (like insider trading), and public order offences. All of these are created by statutes and are punishable because they threaten the fabric of society, not simply because they cause direct physical harm. Even an anti-social behaviour order breach can lead to criminal sanction.

4. If Both Parties Agree, They Can Ignore the Law |

Some students think that if two people agree to fight or to take each other’s belongings, the law does not interfere. They argue, ‘We both wanted to do it, so it is not a crime.’

While consent can operate as a defence in certain civil claims, it does not erase criminal liability in many serious cases. Society has an interest in preventing harm, even when the immediate participants agree. For instance, you cannot consent to assault that causes actual bodily harm or to being killed. Agreements to commit a crime are themselves criminal conspiracies. Moreover, any contract that aims to break the law is void and unenforceable from the outset.

5. Judges Make Decisions and Create Law Arbitrarily |

Year 8 learners often watch TV dramas where judges seem to invent punishments on a whim or declare new laws. This fuels the belief that judges are unbound law-makers.

Judges must follow the doctrine of precedent (stare decisis). Decisions of higher courts are binding on lower courts. They interpret statutes and apply existing legal principles; they do not invent law from nothing. In rare cases, where a genuine gap exists, judges may develop the common law cautiously, but always subject to parliamentary supremacy. Sentencing is guided by detailed guidelines; judges cannot simply pick any number they like. Their reasoning is public and can be appealed.

6. Lawyers Are Paid to Lie and Deceive |

A persistent stereotype says that lawyers twist the truth, hide evidence, and lie to win cases at any cost. Many students think the job is about acting dramatically and tricking the jury.

Barristers and solicitors have a professional duty of candour to the court. They must not knowingly mislead the judge or present false evidence. Their role is to present their client’s case fearlessly within the boundaries of the law and legal ethics. If a lawyer lies or encourages perjury, they risk being struck off the profession’s roll and may face criminal charges for perverting the course of justice. Advocacy is about honest persuasion, not deception.

7. You Are Not Legally Responsible If You Are Under 18 | 只要你不满18岁,就不用承担法律责任

Many 13- and 14-year-olds believe their age acts as a complete shield against any legal consequence. They say, ‘I am a minor, so I can’t be arrested or sued.’

In England and Wales, the age of criminal responsibility is 10. Children between 10 and 17 can be arrested, charged, and prosecuted in the youth court. While sentences differ from adults’ — focusing on rehabilitation — custodial sentences are possible for serious offences. In civil matters, parents or guardians may be held vicariously liable for the actions of minors, and teenagers can be sued in their own name in certain cases. Being under 18 does not mean being above the law.

8. Police Can Arrest Anyone at Any Time | 警察可以随时逮捕任何人

Another common myth is that police officers enjoy unlimited power to detain anyone they choose, simply because they wear a uniform.

Under the Police and Criminal Evidence Act 1984 (PACE), an arrest must be based on reasonable grounds for suspecting an offence has been, is being, or is about to be committed. The arrest must also be necessary — for example, to check a suspect’s identity, prevent harm, or allow effective investigation. Unlawful arrest can give rise to a civil claim for false imprisonment. Furthermore, citizens have the right to be informed of the reason for their arrest and to access legal advice.

9. All Disputes Must Be Resolved in Court |

Students often believe that the only way to solve a disagreement is a dramatic courtroom battle. They see no alternative to suing or being prosecuted.

In reality, a huge number of disputes are settled without a trial. Alternative Dispute Resolution (ADR) methods such as negotiation, mediation, and arbitration are widely used. Mediation involves a neutral third party helping the sides reach a voluntary agreement. Arbitration is a private process where an arbitrator makes a binding decision. Courts themselves encourage parties to attempt settlement out of court to save time and public resources. Only a tiny fraction of cases ever reaches a full trial.

Method (方式) Feature (特点) Binding?
Negotiation (谈判) Direct discussion between parties No
Mediation (调解) Neutral mediator assists Agreement is voluntary
Arbitration (仲裁) Private judge decides Yes
Court trial (法庭审判) State judge/jury decides Yes (subject to appeal)

10. Ignorance of the Law Is a Valid Defence |

The phrase ‘I didn’t know it was illegal’ is one of the most cited excuses. Many young people genuinely believe that if they were unaware of a law, they cannot be punished for breaking it.

The legal system operates on the maxim ‘ignorantia juris non excusat’ — ignorance of the law is no excuse. Everyone is presumed to know the law once it has been published. Allowing ignorance as a defence would encourage people to remain uninformed and undermine the rule of law entirely. There are extremely narrow exceptions in specific regulatory contexts and for mistake of law, but as a general rule, the defence does not stand. Knowing the law is a civic responsibility, not an optional extra.
