4. Criminal Law Basics: Actus Reus and Mens Rea | 刑法基础:犯罪行为与犯罪意图

Every criminal offence requires an actus reus (the guilty act) and a mens rea (the guilty mind). An actus reus can be a positive act, an omission in limited circumstances, or a state of affairs. Write out the exceptions to the rule against liability for omissions, such as where there is a statutory duty or a special relationship.

Break the definition down into its five elements: appropriation, property, belonging to another, dishonesty and intention to permanently deprive. Test yourself by writing each element on a separate card and shuffling them back into order.

This is a full defence but results in a special verdict.

Create a set of bullet points summarising novel duty of care situations found in past exam papers.

Apply these factors to a situation such as a school failing to supervise children in a playground.
