Starting GCSE Law is exciting, but students often bring misconceptions from media, common sense or previous study. Understanding what the law really is – and what it isn’t – is vital for success in AQA Paper 1 and Paper 2. This article tackles ten widespread myths and shows you how to correct them.

1. Law and Morality Are the Same | 法律与道德相同

Many students assume that if something is illegal, it must be immoral, and vice versa. For example, lying is generally considered immoral but is not always illegal (e.g. telling a ‘white lie’). Speeding is illegal but many people do not view it as deeply immoral. The law sets minimum standards of behaviour, while morality is a set of personal or societal beliefs, often influenced by religion or culture. The AQA specification expects you to recognise that law and morality overlap but are distinct concepts.

It is a common myth that Parliament can pass literally any law without restriction. While the principle of parliamentary sovereignty states that Parliament is the supreme law-maker and can make or unmake any law, there are important limits in practice. The Human Rights Act 1998 requires judges to interpret legislation compatibly with the European Convention on Human Rights. Devolution means the Scottish Parliament and Welsh Senedd have powers over devolved matters. Moreover, membership of the EU historically limited sovereignty, and although the UK left the EU, retained EU law principles still exert influence. No Parliament can bind its successors, so a law passed today can be repealed tomorrow. Thus, sovereignty is legally unlimited but politically and practically constrained.

Murder, for instance, is a common law crime, not defined in a single statute. Contract law and tort law have been developed largely through cases. Even where statutes exist, judges must interpret them, and those interpretations become precedents. AQA requires you to understand the three main sources: statute law (Parliament), common law (judicial decisions), and equity (fairness-based rules). Neglecting case law is a major mistake.

Some learners believe judges simply ‘make up’ the law when they feel like it. In reality, the doctrine of precedent (stare decisis) requires judges to follow previous decisions of higher courts. Changes in the law through case law happen incrementally, often when courts distinguish an earlier case or when a higher court overrules a past decision. The Supreme Court (formerly the House of Lords) can depart from its own precedents using the Practice Statement 1966, but it does so sparingly. Moreover, Parliament remains sovereign; if it disagrees with a judicial ruling, it can pass an Act to reverse it. Therefore, judicial law-making is constrained and secondary to Parliament.

A frequent misunderstanding is that the jury decides everything. In a Crown Court trial, the jury decides the facts – that is, whether the defendant is guilty or not guilty – based on the evidence. However, the judge controls all points of law, such as whether certain evidence is admissible, and directs the jury on the relevant legal principles. The jury must apply the law as explained by the judge to the facts they find. Sentencing is always the judge’s responsibility, never the jury’s. Thus, jurors are triers of fact, not of law.

A single incident can give rise to both criminal and civil cases, but they are heard separately. A table can help visualise the distinctions.

7. Magistrates and Judges Are the Same | 治安法官与法官相同

Some students think ‘magistrate’ and ‘judge’ are interchangeable terms. In fact, magistrates are volunteer members of the community who sit in Magistrates’ Courts, dealing with less serious criminal cases and some civil matters like family cases. They are not legally qualified but receive training and are assisted by a legal adviser. Professional judges, on the other hand, are legally qualified practitioners who preside over higher courts – Crown Court, High Court, Court of Appeal and Supreme Court – and handle more serious cases. District judges are legally qualified and sit in Magistrates’ Courts, but they are still distinct from lay magistrates. AQA expects you to know the difference between lay magistrates and professional judges.
