1. Understanding the Anatomy of a Case | 理解案例的解剖结构

Every reported law case follows a standard structure: the case name (e.g. Donoghue v Stevenson), the court that decided it, the date, a summary of the material facts, the legal issue(s) raised, the arguments of the parties, the decision (judgment), and the judge’s reasoning (ratio decidendi and obiter dicta). Recognising these parts is the first step in effective analysis.

2. Distinguishing Ratio Decidendi and Obiter Dicta | 区分判决理由与附带意见

The ratio decidendi (‘reason for deciding’) is the binding legal principle that comes from the case. It is the essential legal reasoning applied to the material facts. Obiter dicta (‘things said by the way’) are comments or observations made by the judge that are not strictly necessary for the decision. While obiter are not binding, they can be persuasive, especially if they come from a senior court.

A classic example is the neighbour principle in Donoghue v Stevenson. The specific ratio was that a manufacturer owes a duty of care to the ultimate consumer. Lord Atkin’s wider statement about loving your neighbour was obiter, but it became highly influential in the development of negligence law.

A frequent mistake in case analysis is blending facts with legal issues. Facts are the events that happened: who did what, when, and where. The legal issue is the question of law that the court must answer, such as ‘Did the defendant owe a duty of care?’ or ‘Was the contract formed by an advertisement?’ Practise by listing the key facts and then phrasing the issue as a neutral question.

For instance, in Carlill v Carbolic Smoke Ball Co, the fact was that the company advertised a reward and Mrs Carlill used the product and caught influenza. The legal issue was whether the advertisement constituted a unilateral offer that could be accepted by performance.

4. Applying Legal Principles to New Scenarios | 将法律原则应用于新情境

Once you have identified the ratio of a case, test your understanding by applying it to a hypothetical set of facts. AQA exam questions often present a scenario and ask you to advise on liability. This requires you to match the material facts of the precedent to the new scenario and determine if the legal outcome should be the same.

5. Using Precedent: Binding vs. Persuasive | 使用先例:约束性与说服力

The doctrine of judicial precedent (stare decisis) relies on a court hierarchy. A decision of the Supreme Court binds all lower courts. The Court of Appeal is bound by the Supreme Court and its own decisions (with limited exceptions). High Court decisions bind courts below but not themselves. Magistrates’ and Crown Courts are bound by all higher courts.

If a precedent is persuasive but not binding, such as a decision from a court in another jurisdiction (e.g. Scotland or Australia) or an obiter dictum from a senior judge, you may argue that the court should follow it, but you must acknowledge it is not compelled to do so. Use phrases like ‘highly persuasive though not binding’ in your analysis.
