1. Actus Reus and Mens Rea | 犯意与犯罪行为

Most crimes require both a guilty act (actus reus) and a guilty mind (mens rea), as expressed in the maxim ‘actus non facit reum nisi mens sit rea’ – the act itself does not make a man guilty unless his mind is also guilty.

Actus reus can be an act, an omission (where a duty of care exists, e.g. R v Pittwood), or a state of affairs. The act must be voluntary.

Mens rea includes intention (direct or oblique – see R v Woollin), recklessness (R v Cunningham) and, for some offences, negligence or knowledge. Transferred malice allows mens rea to shift from an intended victim to an unintended one (R v Latimer).

2. Causation | 因果关系

For result crimes, the prosecution must prove that the defendant’s act was both the factual and legal cause of the consequence. Factual causation is established using the ‘but for’ test (R v White). Legal causation requires the defendant’s act to be the substantial and operating cause of the harm, with no intervening act (novus actus interveniens) breaking the chain.

Intervening acts can be natural events, acts of a third party (e.g. R v Pagett) or the victim’s own actions. The egg-shell skull rule (R v Blaue) provides that a defendant must take the victim as they find them, including their physical or religious vulnerabilities.

3. Strict Liability | 严格责任

Strict liability offences require no proof of mens rea for at least part of the actus reus. They are predominantly regulatory or quasi-criminal matters where the imposition of duty is in the public interest (Sweet v Parsley, Gammon v A-G of Hong Kong). The presumption of mens rea can be displaced if the statute concerns a grave social concern or if the offence is truly criminal in nature.

4. Offences Against the Person | 侵害人身罪

The Offences Against the Person Act 1861 creates a ladder of non-fatal offences. Assault is causing another to apprehend immediate unlawful force, while battery is the intentional or reckless application of unlawful force. Section 47 ABH (actual bodily harm) requires assault or battery resulting in harm more than trivial. Section 20 GBH requires wounding or inflicting grievous bodily harm with malice (intention or recklessness as to some harm). Section 18 GBH is the most serious: wounding or causing GBH with intent to cause GBH or to resist arrest.

The term ‘grievous’ has been defined as ‘really serious harm’ (DPP v Smith). Consent can be a defence to assault and battery but not to ABH or GBH unless the activity falls within a recognised exception (e.g. surgery, sport, rough horseplay).

Theft is defined in s.1 Theft Act 1968: the dishonest appropriation of property belonging to another with the intention to permanently deprive. Appropriation (R v Morris, R v Gomez) includes any assumption of the rights of the owner, even with consent. Property includes money, personal items, intangible property and things in action, but not land in most circumstances.

Dishonesty is assessed by the Ivey v Genting Casinos test: the tribunal of fact determines (a) what was the defendant’s actual state of knowledge or belief as to the facts, and (b) was the conduct dishonest by the standards of ordinary decent people. Intention to permanently deprive covers cases where the defendant treats the thing as their own regardless of the owner’s rights.

6. General Defences | 一般抗辩理由

Criminal defences can negate the actus reus, mens rea or provide a justification/excuse. Insanity (M’Naghten Rules) requires a defect of reason from disease of the mind, causing the defendant not to know the nature and quality of the act or that it was wrong. Automatism is an involuntary act caused by an external factor, which provides a complete defence if the defendant had a total loss of voluntary control.

Intoxication: voluntary intoxication is only a defence to crimes of specific intent if it prevents the defendant forming the intent (DPP v Majewski). Involuntary intoxication may be a defence to any crime. Self-defence allows reasonable force to be used to protect oneself, another, or property; necessity is assessed on the facts as the defendant honestly believed them to be (R v Gladstone Williams).

Duress by threats or circumstances is available for all crimes except murder and some treason cases. The defendant must reasonably fear death or serious injury, have showed reasonable steadfastness, and the threat must be immediate.

7. Negligence: Duty of Care | 过失侵权:注意义务

To establish negligence, a claimant must prove duty of care, breach, causation and damage. The neighbour principle from Donoghue v Stevenson forms the foundation: one must take reasonable care to avoid acts or omissions which one can reasonably foresee would be likely to injure one’s neighbour – persons closely and directly affected.

要成立过失侵权,原告须证明注意义务、违反义务、因果关系及损害。Donoghue v Stevenson 案确立的邻人原则是其基石:一个人应当采取合理注意,以避免可合理预见会伤害邻人(即与其有密切且直接关联之人)的行为或不作为。

The modern three-stage test from Caparo v Dickman requires: (i) reasonable foreseeability of damage, (ii) proximity between claimant and defendant, and (iii) that it is fair, just and reasonable to impose a duty. In existing duty relationships (e.g. doctor/patient, driver/road user) the test is easily satisfied, but novel situations must be analysed carefully.

Caparo v Dickman 案确立的现代三段检验标准要求:(i)损害的可合理预见性,(ii)原告与被告间的接近性,以及(iii)施加义务是公平、公正且合理的。在已有的义务关系(如医生/患者、司机/道路使用者)中,该检验标准容易满足,但新型情形则须审慎分析。


8. Negligence: Breach and Causation | 过失侵权:违反与因果关系

Breach occurs when the defendant falls below the standard of the reasonable man (Blyth v Birmingham Waterworks). The court considers the likelihood of harm, the seriousness of the potential injury, the social value of the activity and the cost and practicality of precautions (Latimer v AEC). Expert evidence may be required in professional negligence, applying the Bolam test: a professional who acts in accordance with a practice accepted as proper by a responsible body of professional opinion is not negligent.

Causation mirrors criminal causation but in the civil context: the ‘but for’ test and the requirement that the damage not be too remote (The Wagon Mound). The defendant will be liable for damage of a type that was reasonably foreseeable, even if the precise manner or extent was not.

9. Occupiers’ Liability | 占有人责任

The Occupiers’ Liability Act 1957 governs liability to lawful visitors. An occupier has a common duty of care to ensure that visitors will be reasonably safe in using the premises for the purposes for which they are invited or permitted. Children require a higher degree of care (Glasgow Corp v Taylor). The Act also allows an occupier to discharge the duty by providing adequate warnings, and to expect that persons exercising a calling (e.g. window cleaners) will guard against their own special risks.

The Occupiers’ Liability Act 1984 imposes a more limited duty towards trespassers. Liability arises only if the occupier is aware of the danger and the risk, has reasonable grounds to believe that a trespasser may come into the vicinity, and may be expected to offer some protection. The duty is to take such care as is reasonable in all the circumstances to see that the trespasser does not suffer injury on the premises by reason of the danger concerned.

10. Contract Formation | 合同成立

A binding contract requires offer, acceptance, consideration, intention to create legal relations and capacity. An offer is a clear expression of willingness to be bound on stated terms; it must be distinguished from an invitation to treat, which is an invitation to make offers (e.g. goods on display in a shop: Pharmaceutical Society v Boots).

具有拘束力的合同要求要约、承诺、对价、受法律约束的意图及缔约能力。要约是明确表示愿意按所述条款受约束;须与要约邀请(即邀请他人发出要约)区分开,例如商店中陈列的商品(Pharmaceutical Society v Boots 案)。

Acceptance must be unequivocal and communicated, except where the postal rule (Adams v Lindsell) applies. Silence cannot amount to acceptance (Felthouse v Bindley). Consideration must be sufficient but need not be adequate; it can be executory or executed but not past (Re McArdle). Intention to create legal relations is presumed in commercial agreements and rebutted in social/domestic contexts.

Minors (those under 18) generally lack full capacity; contracts for necessaries are enforceable, but voidable at the minor’s option in certain cases.

11. Contract Terms and Misrepresentation | 合同条款与虚假陈述

Terms may be express or implied. The court distinguishes between representations (inducements to contract) and terms (promises) by applying the objective test of intention. Once a term is identified, it is classified as a condition (a major term, breach of which allows repudiation of the contract and damages) or warranty (a minor term, breach gives rise to damages only). The modern approach also recognises innominate terms, where the remedy depends on the seriousness of the breach (Hong Kong Fir Shipping).

Misrepresentation is a false statement of fact that induces a party to enter the contract. It can be fraudulent, negligent or innocent, affecting the availability of damages. The Misrepresentation Act 1967 s.2(1) imposes liability for negligent misrepresentation unless the maker proves reasonable grounds to believe the truth. Rescission is available subject to bars (lapse of time, affirmation, impossibility).

12. Remedies in Contract and Tort | 合同与侵权救济

The primary remedy for breach of contract is damages, designed to place the claimant in the position they would have been in if the contract had been performed. Expectation loss is the normal measure; reliance loss may be awarded when expectation is too speculative. Damages must be mitigated, be within the rule of remoteness (Hadley v Baxendale: damages arising naturally or within the parties’ contemplation), and not penal.

Equitable remedies such as specific performance and injunctions are discretionary and available only when damages are inadequate. In tort, the aim is to restore the claimant to their pre-tort position. Damages in negligence therefore compensate for actual physical injury, property damage and reasonable consequential losses, including loss of earnings. For personal injury, damages may include general damages for pain and suffering and special damages for quantifiable losses.
