1. Actus Reus Elements | 犯罪行为构成要素

The actus reus of a crime is made up of three possible components: conduct, circumstances, and consequences. Not every offence requires all three; the formula depends on whether the crime is a conduct crime or a result crime.

For result crimes, the prosecution must also prove causation linking the conduct to the consequence. For conduct crimes, only the act and circumstances need to be shown. Omissions can satisfy the actus reus only where a legal duty to act exists (e.g. statutory duty, contractual duty, special relationship).

Recklessness The defendant foresaw a risk of the consequence and unreasonably took that risk (R v Cunningham for subjective recklessness).
Negligence The defendant failed to meet the standard of the reasonable person; rarely used in criminal law (e.g. gross negligence manslaughter).

Strict liability offences require no proof of any mens rea; the act alone suffices, though the prosecution must still prove the act was voluntary. An example is the offence of driving with excess alcohol.

3. Causation Rules | 因果关系规则

For result crimes, the prosecution must prove both factual causation and legal causation. The ‘formula’ is:

  • Factual causation (the ‘but for’ test): but for the defendant’s conduct, would the consequence have occurred? If the answer is no, factual causation is established (R v White).
  • Legal causation: the defendant’s act must be the operating and substantial cause of the consequence. The chain of causation can be broken by a novus actus interveniens – a free, voluntary and informed act of a third party or an unforeseeable natural event.

The thin skull rule states that the defendant must take the victim as they find them; a pre-existing vulnerability does not break the chain of causation (R v Blaue). To determine whether an offence is one of strict liability, the courts apply the following tests derived from the Gammon criteria.

  • The starting presumption is that mens rea is required.
  • This presumption can be displaced if the statute concerns a matter of social concern (e.g. public safety).

  • The four factors were reaffirmed in B v DPP.

The defence of due diligence applies to some strict liability offences created by statute (e.g. the Trade Descriptions Act 1968). The burden of proof shifts to the defendant to show they took all reasonable steps to avoid committing the offence.

5. Negligence: The Caparo Test | 过失侵权:Caparo测试

The tort of negligence requires the claimant to prove three elements: a duty of care, breach of that duty, and damage caused by the breach. The modern ‘formula’ for finding a novel duty of care is the Caparo three-stage test (Caparo Industries plc v Dickman).

  • Fair, just and reasonable: the court must be convinced that imposing a duty would be fair, just and reasonable in the circumstances.

Under the Occupiers’ Liability Act 1957, an occupier owes a ‘common duty of care’ to all lawful visitors. The ‘formula’ under s.2(2) is a duty to take such care as in all the circumstances of the case is reasonable to see that the visitor will be reasonably safe in using the premises for the purposes for which they are invited or permitted to be there.

  • Children require a higher standard of care because they are less able to appreciate risks.

8. Partial Defences to Murder: Diminished Responsibility and Loss of Control | 谋杀的部分辩护:减轻责任与失控

If a defendant successfully pleads either diminished responsibility (s.2 Homicide Act 1957, as amended) or loss of control (ss.54–55 Coroners and Justice Act 2009), the charge is reduced from murder to voluntary manslaughter. Each defence has its own ‘formula’.

Diminished Responsibility formula:

  • It substantially impaired the defendant’s ability to (a) understand the nature of their conduct, (b) form a rational judgment, or (c) exercise self-control.
  • It provides an explanation for the killing (i.e. a causal link).

Loss of Control formula:

  • The defendant must lose self-control (a subjective test).
  • The loss of control must be triggered by a qualifying trigger: (a) fear of serious violence from the victim, or (b) things said or done which constituted circumstances of an extremely grave character and caused the defendant to have a justifiable sense of being seriously wronged, or (c) a combination of both.
  • A person of the defendant’s sex and age, with a normal degree of tolerance and self-restraint and in the circumstances of the defendant, might have reacted in the same or a similar way (an objective test).
  • The defence cannot be used if the defendant acted out of a considered desire for revenge.

失控公式:

9. Theft: The Five Elements | 盗窃罪:五要素

Theft is defined under s.1 Theft Act 1968. The ‘formula’ combines five elements that must all be proved.

Theft = Appropriation + Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive

  • Appropriation (s.3): any assumption of the rights of an owner, including keeping or dealing with property as owner. Can occur even with the owner’s consent (R v Gomez).
  • Property (s.4): includes money, real property, personal property, things in action, and other intangible property; wild plants and wild creatures are generally excluded unless taken for commercial purposes.
  • Belonging to Another (s.5): the property must be in the possession or control of another, or the defendant must be under an obligation to deal with it in a particular way.
  • Dishonesty (s.2): now tested by the common law test in Ivey v Genting Casinos: (a) what was the defendant’s actual state of knowledge or belief as to the facts? (b) was the defendant’s conduct dishonest by the standards of ordinary decent people?
  • Intention to Permanently Deprive (s.6): an intent to treat the property as one’s own to dispose of regardless of the owner’s rights; can include conditional intents and borrowing that amounts to outright taking.

Robbery and burglary are aggravated forms of theft, building upon the basic theft ‘formula’ with additional elements.

Robbery (s.8 Theft Act 1968):

  • The force or threat must be used in order to steal; if it is used only to escape, it is not robbery (R v James).
