📚 Year 11 CAIE Law: A Quick Guide to Memorising Key Legal Terms | CAIE Year

Mastering legal vocabulary is essential for success in the CAIE Year 11 Law syllabus. This guide breaks down the most frequently examined terms into easy-to-remember explanations, pairing each concept with its Chinese equivalent and a memory aid where possible.

1. Core Criminal Law Concepts |

A crime generally requires two foundational elements: actus reus and mens rea. Actus reus is the guilty act, the physical conduct that constitutes a prohibited behaviour. It can be an action, a failure to act (omission) in certain duties, or a state of affairs. For example, picking up a wallet that does not belong to you and walking away is the actus reus of theft. Think of ‘actus’ as ‘action’ and ‘reus’ as the ‘result’ of that action.

犯罪通常需要两个基本要素:actus reus(犯罪行为)和 mens rea(犯罪意图)。

Mens rea is the guilty mind—the mental element of a crime. It refers to the defendant’s state of mind at the time of the act, such as intention, recklessness, or knowledge. In murder, the mens rea is ‘malice aforethought’, meaning an intention to kill or cause grievous bodily harm. A simple memory hook: ‘mens’ resembles ‘mental’, and ‘rea’ sounds like ‘reason’; together they form the mental reason for the act.

Some offences are ones of strict liability, where there is no need to prove mens rea for at least part of the actus reus. These are usually regulatory crimes such as selling alcohol to a minor or speeding. Even if the defendant made an honest mistake, they are still guilty. The term ‘strict’ itself reminds you that the law is applied strictly, without looking at the accused’s intention.

Memory Aid
Act → Action, Reus → Result
Mens → Mental, Rea → Reason
No ‘Mental’ required — law is strict

2. Civil Law and Tort Essentials |

Tort is a civil wrong that is not a crime or a breach of contract. It occurs when one person’s conduct causes harm or loss to another, giving the injured party the right to claim compensation. Common torts include negligence, trespass and nuisance. The word comes from Latin ‘tortus’ meaning twisted or wrong, so you can think of a tort as a ‘twisted’ action that leads to a civil remedy.

Negligence is the most important tort in the CAIE syllabus. It requires four elements: the defendant owed a duty of care to the claimant; that duty was breached; the breach caused damage; and the damage was not too remote (foreseeable). The neighbour principle from Donoghue v Stevenson established that you must take reasonable care to avoid acts that could foreseeably harm your neighbour.

The duty of care is the legal obligation to avoid acts that could harm others. The ‘neighbour’ is anyone who is closely and directly affected by your actions. Once a duty is established, the court asks whether the defendant fell below the standard of care of a reasonable person. Causation links the breach to the harm — using the ‘but for’ test for factual causation — and remoteness ensures the type of damage was a foreseeable consequence.

3. Court and Trial Terminology |

In a civil case, the person who brings the action is the claimant (formerly called the plaintiff). The party being sued is the defendant. In criminal proceedings, the state is represented by the prosecution, and the accused person is also called the defendant. Remember: claimant claims, defendant defends.

记住:claimant(索赔人)提出要求,defendant(被告)进行辩护。

The jury is a group of citizens (12 in a Crown Court) who decide the facts and give a verdict — guilty or not guilty in a criminal trial. The judge decides questions of law and, after a guilty verdict, delivers the sentence. In a civil trial, the jury is rarely used; instead the judge gives a judgment on liability and the amount of damages.

Key Task
Claimant/Plaintiff 原告 Starts a civil lawsuit
Defendant 被告 Defends against a claim or charge
Prosecution 控方 Presents the criminal case on behalf of the state
Jury 陪审团 Decides facts; returns a verdict
Judge 法官 Decides law; gives sentence/judgment

4. Sources of Law |

Statute (or Act of Parliament) is law made by Parliament. It is the highest form of law in England and Wales — courts must apply it. A statute is often called legislation. The CAIE syllabus expects you to know that judges interpret statutes using rules such as the literal rule, golden rule and mischief rule. Think of a statute as a ‘statue’ of rules, standing firm and unchanging until Parliament amends it.

Common law is judge-made law, developed through decisions in courts. When a higher court decides a point of law, that decision forms a precedent that lower courts must follow. This is called stare decisis, a Latin phrase meaning ‘to stand by things decided’. The binding part of a judgment is the ratio decidendi — the legal reason for the decision. Other comments are obiter dicta (‘things said by the way’), which are not binding but may be persuasive.

To remember the difference: the ratio is the ‘reason’ that binds you; obiter is ‘orbit’ — it circles around but does not hold anyone. Stare decisis sounds like ‘stay decision’, which helps trigger the meaning of letting the decision stand.

5. Key Legal Personnel and Roles |

Barristers are specialist advocates who present cases in higher courts. They usually wear wigs and gowns in Crown Court and appeal courts. Solicitors are the first point of contact for clients; they give legal advice, prepare documents and may represent clients in lower courts like the Magistrates’ Court. A simple separator: barristers ‘speak in bars’ (courtrooms with a bar), while solicitors ‘solicit’ or seek out clients’ needs.

Magistrates are volunteers who hear less serious criminal cases and some civil matters in the Magistrates’ Court. They are not legally qualified but receive training and are advised by a legal clerk. A judge is a legally qualified professional who presides over more serious cases in the Crown Court and higher courts. The jury, as covered earlier, consists of lay people from the community who decide facts in criminal trials.

6. Principles of Liability |

Fault is a core idea: liability in both criminal and civil law generally depends on some blameworthy conduct. In crime, fault is reflected through mens rea; in tort, it often appears through a breach of the standard of care. The law asks whether the defendant can be held responsible for the harm.

Causation links the defendant’s conduct to the result. Courts apply the ‘but for’ test for factual causation: but for the defendant’s act, would the harm have occurred? Then they examine legal causation — was the defendant’s act a substantial and operating cause of the harm? For instance, if a victim is stabbed and later dies from an unrelated infection, the chain of causation may be broken.

Remoteness of damage limits how far liability extends. The damage must be of a type that was reasonably foreseeable. Under the ‘Wagon Mound’ test, if the harm was too remote — unforeseeable — the defendant is not liable. The term ‘
