Let us first analyse whether Alex is liable for theft. The actus reus requires three elements: appropriation, property, and belonging to another. Under s.3, appropriation is any assumption of the rights of the owner. Alex assumed the right to possess the jeans by taking them from the shelf and concealing them (R v Morris). They are tangible personal property (s.4) and belonged to the store (s.5). The actus reus of theft is clearly made out.

The mens rea of theft has two parts: dishonesty and intention to permanently deprive. For dishonesty, we apply the Ivey test: first, identify Alex’s actual state of knowledge — he knew the jeans belonged to the store and that he was not permitted to take them without payment. Second, would ordinary decent people consider his conduct dishonest? Concealing unpaid goods in a backpack and bypassing tills would certainly be seen as dishonest by the standards of reasonable and honest people. Thus dishonesty is likely satisfied.

Intention to permanently deprive: Alex took the jeans, concealed them and ran out. He treated the property as his own to dispose of, which is evidence of intention under s.6 (R v Lavender). There are no facts suggesting he intended to return them. Therefore, the mens rea of theft is established. Theft is complete as soon as the dishonest appropriation with intent occurs — here, when he passed the last till point.

Alex might argue he acted under duress of circumstance, claiming he was desperate and needed the jeans to attend a job interview. Duress of circumstances requires an immediate threat of death or serious injury, and that a reasonable person would have responded in the same way. Economic desperation is not a threat of death and falls far short of the test in R v Martin. This defence would fail.

Under R v Hale, force used to escape can still satisfy ‘immediately after’ and may be considered as part of the continuing appropriation. However, OCR candidates should note the uncertainty and argue both views. The push clearly caused bruising, which is sufficient for force. Whether Alex used it ‘in order to steal’ is debatable, but if appropriation is seen as ongoing until he left the store, the force could amount to robbery. A safer conclusion is that Alex is liable for theft and a separate assault/battery, rather than robbery.

One major error is confusing the roles of actus reus and mens rea. For example, stating that ‘intention to permanently deprive’ is part of the actus reus of theft is factually wrong and loses credit. Always check the definition of each element in the statute.
