6. Key Principles of Criminal Law | 刑法基本原则

To establish criminal liability, the prosecution must usually prove two elements: actus reus (the guilty act) and mens rea (the guilty mind). The actus reus can be a positive act, an omission (where there is a legal duty to act), or a state of affairs. The mens rea varies by offence and can include intention, recklessness, or negligence. Strict liability offences require only the actus reus – no mens rea is needed.

Assault is the causing of another to apprehend immediate unlawful force, while battery is the actual application of unlawful force. ABH requires proof of some injury interfering with health or comfort.

Defences such as consent, self-defence, and lawful correction may be available, and candidates should apply them to scenario-based questions.

The tort of negligence requires the claimant to prove that the defendant owed them a duty of care, breached that duty, and caused damage which is not too remote. The modern concept of duty of care stems from the neighbour principle in Donoghue v Stevenson and the three-part test in Caparo v Dickman: foreseeability of harm, proximity, and whether it is fair, just and reasonable to impose a duty.

The defence of contributory negligence may reduce damages, and volenti non fit injuria (consent) may provide a complete defence.

Acceptance must be unconditional and communicated to the offeror; silence cannot constitute acceptance.

A breach of condition entitles the innocent party to terminate the contract and claim damages, while breach of warranty gives rise to damages only.

Public authorities must act in a way compatible with Convention rights, and courts can issue a declaration of incompatibility if primary legislation conflicts.

In the IGCSE exam, candidates may be asked to discuss how these rights are balanced against other interests, using case law such as A v Secretary of State for the Home Department.
