Furthermore, David may be liable for battery, which is the direct or indirect infliction of unlawful personal force (Collins v Wilcock). If the stone had hit Peter, it would clearly be battery. Here the stone missed, but battery can be indirect (DPP v K). However, no physical force was actually inflicted, so battery is unlikely. Instead, consider whether causing psychiatric harm amounts to actual bodily harm (ABH). Under s.47 OAPA 1861, ABH is any hurt or injury calculated to interfere with the health or comfort of the victim. ‘Bodily harm’ includes recognised psychiatric illness (R v Chan-Fook). Peter suffered severe shock and required treatment, so ABH may be present. The assault is the base offence that caused this harm. Thus, David may be liable for ABH under s.47.

Here, Carly could have cleaned the spill quickly, so the sign alone might not discharge her duty.

In conclusion, Carly is likely in breach of her duty, and Eric can claim damages, though possibly reduced for his own fault.
