For s20, the actus reus is a wound (breaking all layers of skin) or inflicting GBH (really serious harm, R v Martin). The mens rea is maliciously, meaning intention or subjective recklessness as to some harm – not necessarily serious harm (R v Savage; R v Parmenter). For s18, the act is wounding or causing GBH, but the mens rea is specific intent – intention to cause GBH or intention to resist/prevent lawful apprehension with an ulterior intent to cause GBH. This ladder of mens rea is where students stumble; they often try to apply s18 when the factual scenario only shows recklessness, which limits liability to s20.

For basic intent crimes (manslaughter, s20, assault), voluntary intoxication is no defence because getting voluntarily intoxicated itself is reckless. Involuntary intoxication is a defence to any crime if the defendant lacked the necessary mens rea (R v Kingston – but note the disinhibition trap). Students often wrongly plead voluntary intoxication to battery and lose all marks.

Also, the Criminal Justice and Immigration Act 2008 s76 clarifies that a householder may use disproportionate force so long as it is not grossly disproportionate, yet many candidates still treat the householder provision as a ‘blank cheque’ and fail to explain the limits.

Another common slip is to ignore partial defences like loss of control if raised by the facts, or to discuss a defence twice without concluding whether it would succeed.
