1. The Nature of Law | 法律的本质

The concept of law cannot be studied in isolation; it is deeply connected to morality, justice and societal values. In Eduqas AS Law, you are expected to examine the relationship between legal rules and moral rules, and to understand that law does not always mirror moral standards. Some actions may be legal but widely seen as immoral, while other morally ‘right’ acts are not required by law.

Justice is another foundational concept. Formal legal rules often aim to deliver ‘justice according to law’, but this may not always lead to a just outcome in the moral sense.

2. Sources of Law: Legislation | 法律渊源:立法

Under the doctrine of parliamentary sovereignty, Parliament is the supreme law-making body. It can enact, amend or repeal any law it wishes, and no court can strike down an Act of Parliament. This principle remains central to the unwritten UK constitution, though it has been modified by EU membership (now repealed) and devolution.

Judicial precedent, rooted in the doctrine of stare decisis (‘let the decision stand’), obliges courts to follow the legal principles established in previous cases. The binding part of a judgment is the ratio decidendi – the legal reason for the decision. Any remarks made by the judge that are not essential to the outcome are obiter dicta, and these may later be followed as persuasive precedent.

A robust hierarchy of courts determines which decisions are binding on others. The Court of Appeal is bound by the Supreme Court and generally binds itself, subject to certain exceptions set out in Young v Bristol Aeroplane Co Ltd.

Precedent provides certainty and consistency, but it can also cause rigidity and complexity. When a higher court overturns a past decision, this is known as reversing; when the same court or a higher court disapproves of a precedent in a different case, it is overruling. Law reports published by bodies like the ICLR ensure that ratio decidendi can be identified accurately.

4. Statutory Interpretation | 法定解释

When judges apply legislation, they must interpret the words used by Parliament. Four main approaches have been developed: the literal rule, the golden rule, the mischief rule and the purposive approach. Each reflects a different balance between respecting parliamentary sovereignty and achieving a just outcome in the individual case.

The literal rule requires courts to give words their plain, ordinary meaning, even if the result seems absurd. In Whiteley v Chappell, a statute making it an offence to impersonate ‘any person entitled to vote’ was held not to apply to a dead man, as a dead person was not entitled to vote. The golden rule mitigates the harshness of the literal rule: it allows a court to choose an alternative meaning where the literal meaning would produce an absurdity that Parliament could not have intended, as in Re Sigsworth where a son was prevented from inheriting his mother’s estate after murdering her.

The mischief rule, originating from Heydon’s Case, asks what problem the statute was designed to remedy, and interprets the words so as to suppress the mischief. Smith v Hughes shows judges reading ‘in a street’ to include a balcony, because the Act aimed to stop prostitutes soliciting publicly. The purposive approach goes further, looking at the broader purpose of the legislation, even if the words do not clearly reveal it. This is widely used when interpreting EU-derived law and the Human Rights Act 1998.

5. Law Reform | 法律改革

Law must evolve to keep pace with social, technological and economic change. A variety of bodies contribute to law reform in England and Wales. The Law Commission, established by the Law Commissions Act 1965, is the primary independent body responsible for keeping the law under review and recommending reform.

The Law Commission researches areas of law, consults widely and produces final reports with draft Bills. However, government failure to implement reports – for example, on criminal law codification – has been a persistent criticism.

Nevertheless, judicial reform is constrained by the cases that come before the courts and cannot overhaul whole areas of law in the way Parliament can.

The Supreme Court, created by the Constitutional Reform Act 2005, is the final court of appeal for all UK civil cases and for criminal cases from England, Wales and Northern Ireland. Its decisions bind all lower courts. The Judicial Committee of the Privy Council hears appeals from some Commonwealth countries and its judgments are persuasive but not binding on English courts.

Judges are appointed by the Judicial Appointments Commission and must be independent and impartial.

Reforms such as allowing judge-only trials in complex fraud cases have been debated but not fully implemented.

The system has undergone significant reform, most notably through the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO), which removed many areas of law from the scope of legal aid, including most family law, housing and employment matters.

9. Law of Tort: Introduction and Negligence | 侵权法:介绍与过失

Tort law governs civil wrongs that cause harm, providing remedies such as damages to the injured party. The most important tort for AS is negligence, which requires the claimant to prove that the defendant owed a duty of care, breached that duty, and thereby caused actionable damage.

The modern duty of care was established in Donoghue v Stevenson, where Lord Atkin set out the ‘neighbour principle’: one must take reasonable care to avoid acts or omissions which can reasonably foresee would injure one’s neighbour. Today, the approach in Caparo Industries plc v Dickman dominates: a duty exists if there is foreseeability of damage, a relationship of proximity, and it is fair, just and reasonable to impose a duty.

A breach occurs when the defendant falls below the standard of the ‘reasonable man’, an objective test. Factors such as the likelihood of injury, the seriousness of the risk, the cost of prevention and the social utility of the activity are weighed, following cases like Bolton v Stone. Causation requires proof of both factual causation (‘but for’ test) and legal causation (the damage must not be too remote, with the test in The Wagon Mound establishing foreseeability of the type of damage).

10. Occupiers’ Liability | 占有人责任

Occupiers’ liability governs the duty owed by those who control premises towards visitors and trespassers. It is governed by two statutes: the Occupiers’ Liability Act 1957 (for lawful visitors) and the Occupiers’ Liability Act 1984 (for trespassers). Both establish a common duty of care, but the content differs.

Under the 1957 Act, an occupier owes a duty to take such care as is reasonable to see that the visitor is reasonably safe in using the premises for the purposes for which he is invited or permitted. The duty can be satisfied by adequate warnings. The 1984 Act imposes a duty on occupiers in respect of trespassers if they are aware of the danger, know that a trespasser may come into the vicinity, and the risk is one the occupier could reasonably be expected to offer some protection against.

The 1984 Act was tested in Ratcliff v McConnell, where the court considered whether the occupier should have been aware of the risk of students diving into an unlocked pool at night.

11. Defences and Remedies in Tort | 侵权抗辩与救济

Defendants in a tort claim may raise various defences. In negligence, common defences include contributory negligence, where the claimant’s own carelessness contributed to the harm, and volenti non fit injuria (consent), where the claimant voluntarily accepted the risk. A complete defence bars the claim entirely, while contributory negligence reduces damages.
