1. Crime Formula | 犯罪公式
Crime = Actus Reus (Guilty Act) + Mens Rea (Guilty Mind) – Defence
For most criminal offences, the prosecution must prove that the defendant carried out a voluntary physical act (actus reus) and had the required mental state (mens rea), such as intention or recklessness. If a valid defence exists – for example, self-defence or insanity – the defendant may be acquitted even if both elements are present. This formula is the bedrock of criminal liability in common law systems.
犯罪 = 犯罪行为 + 犯罪意图 – 抗辩理由

2. Negligence Formula | 过失公式
Negligence = Duty of Care + Breach of Duty + Causation + Damage
In the civil law of tort, a claim in negligence requires four ingredients. First, the defendant must owe a duty of care to the claimant (e.g., a driver to other road users). Second, the defendant must breach that duty by failing to act as the ‘reasonable person’ would. Third, the breach must cause the harm (causation). Fourth, the claimant must have suffered actual damage that is not too remote. All four must be established on the balance of probabilities.
过失 = 注意义务 + 违反义务 + 因果关系 + 损害

3. Murder Formula | 谋杀公式
Murder = Unlawful Killing + Malice Aforethought
Murder is the most serious homicide offence. The actus reus is the unlawful killing of a reasonable creature in being (a human being born alive) under the Queen’s peace. The mens rea, known as malice aforethought, means an intention to kill or to cause grievous bodily harm (GBH). It does not require actual ill will or premeditation. Partial defences, such as diminished responsibility or loss of control, can reduce a murder conviction to voluntary manslaughter.
谋杀 = 非法杀人 + 恶意预谋

4. The ‘But For’ Test | “若非”检验
But for the defendant’s act or omission, would the harm have occurred?
To establish factual causation, courts apply the ‘but for’ test. If the damage would have happened anyway, the defendant’s conduct is not a factual cause. Example: ‘But for the defendant’s negligent driving, the collision would not have happened.’ This test is used in both criminal and civil contexts. In some complex cases, the courts also consider legal causation to ensure the defendant’s act was a substantial and operating cause of the result.

5. Reasonable Person Test | 合理人标准
The standard of care is that of the ordinary and prudent ‘reasonable person’.
In negligence, breach is measured against an objective standard: how would a reasonable person have behaved in the same circumstances? The test ignores individual characteristics such as inexperience or clumsiness. For instance, a learner driver is judged by the standard of a competent and experienced driver – not by what a reasonable learner would do (Nettleship v Weston). The reasonable person is not a genius but an average, careful member of society.
注意标准是普通而谨慎的“合理人”标准。

Binding Contract = Offer + Acceptance + Consideration + Intention to Create Legal Relations
- Offer: A clear and definite proposal made by one party (the offeror) to another.
- Acceptance: Unconditional agreement to all terms of the offer, communicated to the offeror.
- Consideration: Something of value exchanged between the parties, e.g. money for goods, or a promise for a promise.
- Intention: Both parties must intend their agreement to be legally binding. Social and domestic arrangements usually lack this intention.
具有约束力的合同 = 要约 + 承诺 + 约因 + 设立法律关系的意图
- 要约:一方(要约人)向另一方发出的明确且确定的提议。

7. Precedent Formula | 先例公式
Judicial Precedent = Ratio Decidendi (binding) + Obiter Dicta (persuasive)
When judges decide a case, the legal reasoning essential to the decision is called the ratio decidendi. This creates a binding precedent that lower courts in the same hierarchy must follow. Remarks made ‘by the way’ that do not form part of the core reasoning are obiter dicta. While not strictly binding, obiter can be highly persuasive and may be adopted in later cases. The Supreme Court (formerly the House of Lords) binds all courts below it, while the Court of Appeal binds itself and lower courts.

When interpreting Acts of Parliament, judges apply well-established approaches, often described as rules:
- The Literal Rule: Words are given their ordinary, dictionary meaning, even if the result seems harsh. (e.g., Whitely v Chappell – a dead person could not ‘vote’).
- The Golden Rule: The court can depart from the literal meaning if it leads to an absurd result. (e.g., Re Sigsworth – a son who murdered his mother could not inherit her estate).
- The Mischief Rule: The court examines the gap or ‘mischief’ in the old law that the statute was intended to remedy, and interprets the words to suppress that mischief. (Heydon’s Case).
- Purposive Approach: A broader, modern method that looks at the overall purpose of the legislation, often used with EU-derived and human rights laws.

9. The Rule of Law | 法治原则
Rule of Law = Government under law; no individual or institution is above the law.
This constitutional principle demands that laws be clear, publicly accessible, applied equally to all, and adjudicated by independent courts. It prohibits arbitrary power and ensures that government actions must have legal authority. Citizens can know in advance what conduct will attract legal sanctions, and judges safeguard fundamental rights without favour.
法治 = 政府依法律行事;任何个人或机构均不凌驾于法律之上。
这一宪制原则要求法律明确、公开、平等适用于所有人,并由独立法院裁决。它禁止专断权力,确保政府行为须有法律依据。公民能事先知晓何种行为将招致法律制裁,而法官不偏不倚地维护基本权利。
10. Separation of Powers | 权力分立
Separation of Powers: Legislature (makes law) + Executive (implements law) + Judiciary (interprets law)
To prevent the concentration of power, the state’s functions are divided among three branches. Parliament (the legislature) creates statutes; the Government and public bodies (the executive) apply and enforce the law; and courts (the judiciary) resolve disputes and interpret the law. Each branch acts as a check and balance on the others, preserving individual liberty and democratic accountability.
权力分立:立法机关(制定法律)+ 行政机关(执行法律)+ 司法机关(解释法律)
为防止权力集中,国家职能被划分给三个分支。议会(立法机关)制定法律;政府及公共机构(行政机关)适用和执行法律;法院(司法机关)解决争议并解释法律。各部门相互制衡,从而维护个人自由与民主问责。
