📚 KS3 WJEC Law: Case Analysis Practice | KS3 WJEC

In KS3 WJEC Law, being able to analyse a legal scenario is just as important as remembering the rules. This article will walk you through a clear, step-by-step method for breaking down cases, spotting the legal issues, applying the law and reaching a strong conclusion. You will also find a worked example and practical tips designed to build your confidence for classroom tasks and assessments.

1. Understanding What a Legal Case Is | 理解什么是法律案例

A legal case is a story that raises a question about rights, duties or wrongdoings. In your lessons, cases can be real or made up, but they always contain facts that need to be examined through the lens of the law. Learning to read the facts carefully is the first step in any case analysis.

In KS3 WJEC Law, cases are often short and based on situations you might meet in daily life, such as borrowing a friend’s belongings, getting hurt in the playground or making a promise to pay for something. Your job is to work out whether any law has been broken and who might be legally responsible.

Treat every case like a detective puzzle. Read the facts twice before you start writing. Highlight any words that suggest a disagreement, a loss or a broken promise. The more you practise, the quicker you will become at spotting what is legally important.

2. The IRAC Method: An Overview | IRAC

The IRAC method is a powerful tool used by law students and legal professionals to organise their case analysis. IRAC stands for Issue, Rule, Application and Conclusion. It gives you a clear structure, making sure you do not skip any important step.

In an exam or class exercise, following IRAC shows your teacher that you can think like a lawyer. You will earn marks for naming the correct issue, quoting or summarising the right legal rule, explaining how the rule works with the facts and stating a logical result. IRAC turns a messy set of facts into a neat, persuasive answer.

Even at KS3 level, using IRAC will make your writing clearer and more professional. It stops you from simply telling the story back to the examiner. Instead, you use the story as evidence to support your legal reasoning. Start thinking in IRAC order as soon as you read a case: ‘What is the complaint?’ ‘Which rule covers this?’ ‘How do the facts fit the rule?’ and ‘What should the outcome be?’

3. Step 1: Identifying the Issue |

The issue is the legal question that the case raises. It is often a yes-or-no question about whether a particular rule has been broken or whether someone has a legal right. For example, ‘Did Alex commit theft when he took the mobile phone?’ or ‘Is the school liable for Jamie’s injury?’

When you write the issue, phrase it simply and directly. Avoid mixing in the facts of the case – you will use those later. The issue should read like a headline that tells the reader exactly which area of law is being tested. Good issue statements begin with words like ‘whether’, ‘did’ or ‘is’.

Sometimes a case may have more than one issue. For example, a fight in the canteen might raise questions about both assault and self-defence. In such a situation, list each issue separately and then work through the IRAC steps for one issue at a time. This keeps your answer organised.

4. Step 2: Stating the Relevant Rule |

The rule is the law that applies to the issue you have identified. At KS3, you are not expected to remember every statute perfectly, but you should know the key elements of common legal areas such as theft, criminal damage, negligence in tort or the basics of contract formation. Always state the rule before you apply it.

When you write the rule, be precise. For instance, the definition of theft under the law is ‘the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it’. You could present this as a checklist of elements. Using a simple table can help you and the reader see whether each element is met.

Element (English)
Dishonestly appropriates
Property 财产
Belonging to another 属于他人
Intention to permanently deprive

If the rule comes from a case, you can briefly mention how it was established. For example, ‘In the tort of negligence, a duty of care exists where harm is reasonably foreseeable, there is proximity between the parties and it is fair, just and reasonable to impose a duty.’ Avoid long stories about the case – focus on the principle.

5. Step 3: Applying the Rule to the Facts |

Application is where the real analysis happens. Here you take each element of the rule and match it against what happened in the case. You need to show the reader exactly why a particular element is satisfied or not, using evidence from the facts. This is the most important section for earning high marks.

Do not simply repeat the rule and say ‘this applies’. Be specific. If the rule requires ‘dishonesty’, quote the part of the case where the defendant acted secretly or lied. If the rule requires ‘permanent deprivation’, point out whether the person intended to keep the item forever or return it later. Every conclusion you draw in this step must be backed by a fact.

It is helpful to use language like ‘Here, the facts show that…’, ‘This is because…’ or ‘The defendant’s action of leaving the scene without permission demonstrates…’. This phrase type links the law directly to the story. If an element is missing, explain why, for example, ‘There is no evidence that the defendant intended to keep the item, therefore the intention to permanently deprive is not made out.’

6. Step 4: Reaching a Conclusion |

The conclusion answers the issue question clearly. It is a short statement, usually only a couple of sentences, that sums up your findings. A good conclusion might be: ‘Therefore, Alex is likely to be found guilty of theft because all four elements are satisfied on the facts.’ or ‘Mila is not liable in negligence because the harm was not reasonably foreseeable.’

Your conclusion must flow logically from your application. Never introduce a brand new fact or rule at this stage. If your application showed that one element of theft was missing, your conclusion should state that the defendant is not guilty. Be consistent and confident.

In a WJEC assessment, stating a clear conclusion shows the examiner that you have completed the legal reasoning process. Even if your conclusion is different from the ‘model’ answer, marks can be awarded for a well-supported argument that follows the IRAC structure.

7. Worked Example: The Missing Phone |

Facts: During break, Sam left his brand new phone on a bench in the school playground. Alex saw the phone, picked it up, looked around and placed it quickly into their own bag. Later, when Sam approached and asked if anyone had seen the phone, Alex said, ‘No, I haven’t seen it.’ That evening, Alex took the phone home and began using it as their own.

Issue: Did Alex commit theft by taking Sam’s phone?

Rule: Theft is defined as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. All four elements must be proved: dishonest appropriation, property, belonging to another, and intention to permanently deprive.

Application: First, the phone is clearly ‘property’ and it ‘belonged to Sam’, satisfying the middle two elements. Second, Alex ‘appropriated’ the phone by picking it up and putting it into their bag – this is taking ownership without consent. Third, Alex acted dishonestly: they looked around before taking the phone and later lied by saying they had not seen it. A reasonable person would consider this behaviour dishonest. Finally, Alex took the phone home and used it as their own, showing a clear ‘intention to permanently deprive’ Sam of it. There is no evidence Alex planned to return the phone.

Conclusion: All four elements of theft are satisfied on the facts. Therefore, Alex is likely to be found guilty of theft.

8. Common Mistakes and How to Avoid Them | 常见错误及避免方法

One frequent mistake is writing a long summary of the facts instead of analysing them. Remember, the examiner already knows the story. Your job is to use only those facts that help prove or disprove a legal element. Skip the storytelling and move straight to the legal points.

Another mistake is mixing up criminal law and civil law language. In a WJEC Law paper, if the question asks ‘Is A guilty of theft?’, you are in criminal law and should use words like ‘guilty’ and ‘liable to punishment’. If the question asks ‘Is B entitled to compensation?’, you are in civil law and should talk about ‘liability’ and ‘damages’. Use the right vocabulary for the context.

Some students state the rule and then jump straight to the conclusion without proper application. This is often called a ‘gap in reasoning’. Always show the link between each rule element and the relevant facts. Even if the link seems obvious to you, write it down. That is where the analysis marks are located.

Finally, avoid using personal opinions like ‘I think it’s unfair’. Legal analysis is about what the law says, not about what you feel. Stick to the rule and the facts. If the outcome seems harsh, you may note that in a short evaluation sentence at the very end, but only after finishing the IRAC process.

9. Exam Tips for WJEC Case Analysis Questions | WJEC

Before you write anything, read the question carefully and underline the key instruction words. If the question says ‘Analyse whether’, it expects a full IRAC structure. If it says ‘State the legal principle’, you may only need to write the rule section. Following the question’s command precisely is an easy way to earn marks.

Time yourself when you practise. A typical KS3 case analysis question might give you around 15-20 minutes. Spend roughly 2 minutes spotting the issue, 3 minutes writing the rule, 7-8 minutes on application and 2 minutes on a clean conclusion. Practising under time pressure will make you much faster in the real assessment.

Use the language of the law with confidence. Short, technical phrases like ‘the defendant owed a duty of care’ or ‘the actus reus is present’ impress examiners. However, only use terms you truly understand. It is better to explain a simple idea clearly than to throw in a fancy word incorrectly.

Finally, leave two or three minutes at the end to check your work. Look for any elements of the rule you might have missed in the application. Correct spelling mistakes in legal terms. A polished answer always feels more persuasive to the reader.
