In IGCSE WJEC Law, many learners lose marks not because they lack knowledge, but because they carry everyday assumptions into legal questions. Legal terms often have precise meanings that differ from ordinary usage, and examiners frequently test exactly these differences.

Law is made by state institutions and is enforceable through courts and sanctions; morality comes from beliefs, religion and conscience, and is enforced informally by social pressure.

The real distinction lies in the purpose of the case and the legal consequences, not in who the parties are. Criminal law deals with conduct that the state has defined as an offence against society, and the case is normally brought by a public prosecutor, such as the Crown Prosecution Service.
