In WJEC IGCSE/GCSE Law, knowing the content is not enough: examiners award marks for how you use legal rules, apply them to facts and evaluate competing arguments. This guide explains the answer techniques and marking standards that can turn a pass-level answer into a top-band response.

1. Understand the WJEC Assessment Objectives | 理解 WJEC 评分目标

WJEC Law papers are marked against three broad assessment objectives. AO1 tests knowledge and understanding of legal rules, concepts and sources. AO2 tests the application of law to problem scenarios. AO3 tests analysis, evaluation and reasoned judgement.

Each question type combines these objectives in different proportions. A ‘describe’ question is mostly AO1, an ‘advise’ problem question is mainly AO2, and a ‘discuss’ or ‘evaluate’ question requires strong AO3. Top answers address the dominant objective instead of writing everything they know.

  • AO2 Application – using the facts of the question to show whether a rule is satisfied.

2. Read the Command Word First | 先读指令词

Before writing, highlight the command word. ‘State’ requires a brief factual answer; ‘describe’ requires detail but no evaluation; ‘explain’ requires a reason or legal mechanism; ‘discuss’ and ‘evaluate’ require argument, balance and a conclusion.

动笔前,先圈出指令词。‘State’ 要求简短的事实回答;‘describe’ 要求详细描述但无需评估;‘explain’ 要求给出理由或法律机制;‘discuss’ 和 ‘evaluate’ 要求论证、正反平衡并得出结论。

Many students lose marks not because they lack legal knowledge, but because they answer a different command word. For example, if the question says ‘state two sources of law’, a long paragraph on statutory interpretation wastes time and earns little credit.

3. Use IRAC or PEE Structure | 使用 IRAC 或 PEE 结构

For problem and essay answers, use a clear legal structure. IRAC stands for Issue, Rule, Application, Conclusion. PEE stands for Point, Evidence, Explanation. Both force you to state the law, prove it with authority and apply it to facts.

Strong answers introduce the issue, name the relevant legal rule, cite a case or statute, apply the rule to the exact facts, and finish with a clear conclusion. A weak answer skips straight from ‘the law is…’ to ‘therefore…’ without application.

Example: Issue: Did Alex owe a duty of care to Ben? Rule: Under Donoghue v Stevenson, a duty arises where harm is reasonably foreseeable, there is proximity and it is fair, just and reasonable. Application: Alex drove too close to Ben’s car in wet conditions, so harm was reasonably foreseeable. Conclusion: Therefore, Alex likely owed a duty of care.

4. Cite Cases and Statutes Accurately | 准确引用案例与法条

Examiners do not reward case names alone; they reward the legal principle attached to the case. For example, write ‘Donoghue v Stevenson established the neighbour principle for duty of care in negligence’ instead of only naming the case.

When using a statute, link it to its legal elements. A strong answer might say: ‘Under s.1 Theft Act 1968, theft requires dishonesty, appropriation, property belonging to another, and intention to permanently deprive. Here, Alex appropriated the phone by taking it from the table.’

  • Use the full case name on first mention, then short form: Donoghue v Stevenson (1932).
  • Link statutory sections to elements: Theft Act 1968 s.1 defines theft as dishonestly appropriating property belonging to another with intention to permanently deprive.
  • Use criminal case examples for mens rea and actus reus: R v Cunningham (1957) for subjective recklessness; R v Miller (1983) for actus reus by creating a dangerous situation.

5. Master the Problem Question Method | 掌握情境题答题方法

For scenario questions, do not simply describe the law. Apply each legal test to the named person. If the question asks whether Alex is guilty of theft, check each element of s.1 Theft Act 1968 against Alex’s actions.

情境题不要只描述法律。要把每个法律要件套用到题目中的人物上。如果题目问 Alex 是否构成盗窃,就应把《1968 年盗窃法》第 1 条的各要件与 Alex 的行为逐一对照。

Use the facts as your evidence. Phrases like ‘Here, Alex appropriated the phone when he took it from the table because…’ show AO2 application. Avoid writing: ‘The law says appropriation is…’ without explaining how Alex’s act fits that definition.

把事实当作证据。像‘本案中,Alex 从桌上拿走手机,就实施了占有行为,因为……’这样的表述可以体现 AO2 的应用能力。不要只写‘法律规定占有是指……’,却不说明 Alex 的行为如何符合该定义。

If there are two parties, advise each separately. For example, consider Alex’s liability first, then consider Mia’s possible defence. This makes your answer easier for the examiner to follow.

6. Evaluation Questions Require Balance | 评估题需要正反平衡

Evaluation questions ask for a judgement, not a list. Start with a clear view, give arguments for and against, support each with authority, then return to your view in the conclusion.

评估题要求你作出判断,而不是罗列观点。先提出明确立场,分别给出支持和反对论据,并为每一论据提供依据,最后在结论中回到你的立场。

For example, if evaluating jury trial, discuss both secrecy and democratic participation, then conclude with which is stronger in the given context. Use connectives like ‘however’, ‘on the other hand’ and ‘in conclusion’ to show the examiner your structure.
