It explains the uncodified UK constitution, the structure and powers of Parliament, the role of the Prime Minister and Cabinet, the judiciary, and the relationship between the three branches of government.

1. The Nature and Sources of the UK Constitution | 英国宪法的性质与渊源

The UK constitution is often described as uncodified and unentrenched. This means it is not written in one single legal document and can be changed by ordinary Acts of Parliament, unlike the codified constitutions of the United States or France.

英国宪法常被描述为“不成文”和“非刚性”。这意味着它并非写在一部单一法律文件中,而且可以通过普通议会立法加以修改,这与美国或法国的成文宪法不同。

Its main sources are statute law, common law, conventions, authoritative works, and historical documents such as Magna Carta 1215 and the Bill of Rights 1689. Statute law includes key Acts such as the European Communities Act 1972, the Human Rights Act 1998, and the Constitutional Reform Act 2005.

2. Constitutional Principles: Parliamentary Sovereignty, Rule of Law, and Conventions | 宪法原则:议会主权、法治与宪政惯例

A. V. Dicey identified two key constitutional principles: parliamentary sovereignty and the rule of law. Parliamentary sovereignty means Parliament can make or unmake any law, and no Parliament can bind its successors. However, EU membership, devolution, and the Human Rights Act have placed practical limits on this concept.

The rule of law requires that everyone is subject to the law, that laws are fairly applied, and that rights are protected by independent courts. Conventions are non-legal rules of political practice, such as the monarch always giving royal assent to bills passed by Parliament, and the Prime Minister being an MP.

3. Constitutional Reform Since 1997 | 1997年以来的宪法改革

The Labour governments from 1997 to 2010 introduced major constitutional changes. These included devolution to Scotland, Wales, and Northern Ireland, the removal of most hereditary peers from the House of Lords, the Human Rights Act 1998, the Freedom of Information Act 2000, and the creation of the Supreme Court under the Constitutional Reform Act 2005.

These reforms were often described as piecemeal rather than part of a fully codified constitution. They shifted power away from Westminster in some areas, strengthened rights protection, and increased judicial independence, but left parliamentary sovereignty formally intact.

4. The Structure and Functions of Parliament | 议会的结构与职能

The UK Parliament is bicameral, consisting of the House of Commons and the House of Lords. The House of Commons is directly elected by first-past-the-post across 650 constituencies, while the House of Lords is unelected and made up of life peers, 92 hereditary peers, and 26 bishops.

Parliament has five main functions: legislation, scrutiny of the executive, representation, debate, and the recruitment of ministers. These functions are shared between the two chambers, but the Commons has greater democratic legitimacy and financial privileges.

5. The House of Commons: Representation and Scrutiny | 下议院:代表与审查

The House of Commons exercises its scrutiny role through Prime Minister’s Questions, select committees, debates, and votes on legislation. Departmental select committees shadow each government department and can call ministers and civil servants to give evidence.

However, the effectiveness of scrutiny is limited by the government’s majority, party discipline, and the payroll vote. Backbench revolts can occur, but strong party whips usually ensure that government legislation is passed.

6. The House of Lords: Role and Reform Debates | 上议院:作用与改革辩论

The House of Lords acts as a revising chamber. It cannot veto public money bills, and under the Parliament Acts 1911 and 1949 it can only delay most bills for one year. It uses its independence and expertise to scrutinise legislation and government policy.

7. The Prime Minister and Cabinet | 首相与内阁

The Prime Minister is the head of government and holds office through being the leader of the largest party in the House of Commons. The Cabinet consists of senior ministers appointed by the Prime Minister and heads most government departments.

首相是政府首脑,通过担任下议院最大政党领袖而执掌权力。内阁由首相任命的高级大臣组成,负责大多数政府部门。

A key debate is whether the UK has cabinet government or prime ministerial government. In theory, the Cabinet makes major decisions collectively, but in practice a strong Prime Minister can dominate policy making, especially with a large parliamentary majority.

8. Prime Ministerial Power: Patronage, Prerogative, and Limitations | 首相权力:任命权、特权与限制

The Prime Minister has significant powers, including patronage, control of the Cabinet agenda, leadership of the governing party, and the use of royal prerogative powers. The prerogative includes powers relating to foreign affairs, military action, and appointments, though some powers have been placed on a statutory basis.

首相拥有重要权力,包括任命权、对内阁议程的控制、执政党领袖地位以及王室特权的使用。王室特权包括外交事务、军事行动和任命等权力,不过部分权力已被置于成文法基础上。

However, prime ministerial power is limited by the Cabinet, the party, Parliament, the media, and events. For example, Margaret Thatcher faced Cabinet and party opposition over the poll tax, Tony Blair was criticised over the Iraq War, and Theresa May struggled to pass her Brexit deal.

9. The Judiciary and Judicial Independence | 司法机构与司法独立

The UK judiciary interprets and applies the law, ensures the rule of law, and protects the rights of citizens. Judges hear criminal and civil cases, and senior judges can review the lawfulness of government action through judicial review.

Judicial independence is protected by security of tenure, guaranteed salaries, independent appointments through the Judicial Appointments Commission, and the separation of judiciary from the legislature under the Constitutional Reform Act 2005. Judges cannot be dismissed simply because the government dislikes their rulings.

10. Judicial Review and the Supreme Court | 司法审查与最高法院

Judicial review is a process by which courts examine whether public bodies have acted lawfully. Grounds for review include illegality or ultra vires, procedural impropriety, and irrationality. If a public body acts beyond its legal powers, the court can quash the decision.

司法审查是法院检查公共机构是否依法行事的程序。审查理由包括违法或越权、程序失当以及不合理性。如果公共机构超越其法律权限行事,法院可以撤销该决定。

The Supreme Court, established in 2009, is the final court of appeal for all civil and criminal cases in the UK, except Scottish criminal cases. It has made significant rulings in Miller v Secretary of State for Exiting the European Union (2017) and Miller II (2019), which clarified that the executive could not use prerogative powers to trigger Article 50 or prorogue Parliament without lawful authority.

The UK has a fusion of powers rather than a strict separation. The executive is drawn from the legislature, and the government can normally rely on its majority in the House of Commons. Nevertheless, Parliament can check the government through votes of no confidence, select committees, and backbench rebellions.

英国实行权力融合而非严格分权。行政机关成员来自立法机关,政府通常可以依靠其在下议院的多数席位。然而,议会仍可通过不信任投票、专门委员会和后座议员反叛来制约政府。

The judiciary also checks the executive through judicial review and through declarations of incompatibility under the Human Rights Act 1998. These mechanisms illustrate the tension between parliamentary sovereignty and the protection of individual rights.

12. Devolution and Local Government | 权力下放与地方政府

Devolution has created the Scottish Parliament, the Welsh Senedd, and the Northern Ireland Assembly. These bodies have different powers, and the UK Parliament remains legally sovereign. Devolution is therefore asymmetric, with Scotland enjoying greater legislative powers than Wales.

权力下放设立了苏格兰议会、威尔士议会和北爱尔兰议会。这些机构拥有不同的权力,而英国议会仍在法律上拥有主权。因此,权力下放是不对称的,苏格兰的立法权力大于威尔士。

Local government in England operates through county councils, district councils, unitary authorities, and combined authorities with elected mayors. Local authorities deliver services such as education, housing, and social care, but they are limited by central government funding and Acts of Parliament.
