📚 How the Constitution Has Changed Since 1997 | 1997年以来英国宪法如何演变

The United Kingdom has no single codified constitution, but since 1997 a series of reforms under Labour, coalition and Conservative governments have significantly reshaped its constitutional arrangements. This article examines the key changes, their motives and their consequences for the UK constitution.

1. The Uncodified Constitution Before 1997 | 1997年之前的未成文宪法

Before 1997 the UK constitution was traditionally described as uncodified, flexible and based on parliamentary sovereignty, the rule of law and constitutional conventions. Major sources included statute law, common law, royal prerogative and works of authority such as Erskine May.

There had been constitutional changes before 1997, such as UK entry into the European Communities in 1973, but the election of Tony Blair’s Labour government marked a more systematic programme of constitutional reform. Many of these reforms were intended to modernise institutions, decentralise power and strengthen rights.

2. Devolution to Scotland, Wales and Northern Ireland |

The most radical constitutional change after 1997 was devolution. Following referendums in 1997, the Scotland Act 1998 created a Scottish Parliament with primary legislative powers over areas such as health, education and criminal justice, while reserved matters remained at Westminster.

The Government of Wales Act 1998 initially gave the Welsh Assembly only executive powers, but the Government of Wales Act 2006 and later legislation moved Wales towards a reserved-powers model with primary law-making authority. In Northern Ireland, the Belfast Agreement and the Northern Ireland Act 1998 established a power-sharing Assembly and Executive.

Devolution created an asymmetrical settlement, with different institutions and powers in each nation. It also introduced proportional representation for devolved elections, contrasting with Westminster’s first-past-the-post system.

3. The Human Rights Act 1998 | 1998

The Human Rights Act 1998 incorporated the European Convention on Human Rights into UK domestic law. It allows UK courts to hear human rights cases without applicants having to go to the European Court of Human Rights in Strasbourg.

Under section 3, courts must interpret legislation so far as possible in a way compatible with Convention rights. If a higher court finds that an Act of Parliament is incompatible, it may issue a declaration of incompatibility under section 4, but this does not automatically strike down the Act because parliamentary sovereignty remains.

The Act strengthened individual rights and gave judges a more prominent constitutional role. However, it has also been controversial, with some politicians arguing that it has shifted power from elected ministers to unelected judges.
