The UK constitution is often described as “unwritten” or more accurately uncodified because it has developed over centuries through statutes, common law, conventions and authoritative works rather than being set out in a single document. Understanding its development is central to Edexcel A-Level Politics, as it explains how parliamentary sovereignty, the rule of law and the balance of power have evolved in response to political, social and legal change.

1. What is a Constitution? | 什么是宪法?

A constitution sets out the fundamental rules by which a state is governed. It establishes the powers and duties of key institutions, defines the relationship between the state and the individual, and provides legitimacy for the exercise of political authority.

Most modern states have a codified constitution, meaning the main rules are written in one document. The UK is unusual because its constitution is not codified and has evolved incrementally.

2. The Uncodified Nature of the UK Constitution | 英国宪法的非法典化性质

The UK constitution is often called “uncodified” rather than “unwritten” because much of it is written down, but across many different sources. These include statute law, common law, conventions, royal prerogative and authoritative works such as Erskine May and Dicey’s Introduction to the Study of the Law of the Constitution.

The Bill of Rights 1689 was a direct outcome of the Glorious Revolution. It limited the powers of the monarchy, established the supremacy of Parliament, and required that laws and taxation could only be made with parliamentary consent.

5. The Act of Settlement 1701 and Constitutional Monarchy | 《王位继承法》1701 与君主立宪制

The Act of Settlement 1701 further entrenched parliamentary control over the crown by determining the line of succession and requiring the monarch to be a Protestant. It also strengthened judicial independence by protecting judges from arbitrary dismissal, although their formal security of tenure came later.

6. Parliamentary Sovereignty and the Parliament Acts 1911/1949 | 议会主权与 1911/1949 年《议会法》

Parliamentary sovereignty is a core principle of the UK constitution, associated especially with A. V. Dicey. It means that Parliament can make or repeal any law, and no other body can override legislation passed by Parliament.

The European Communities Act 1972 incorporated EU law into UK law and gave European law precedence over conflicting domestic legislation. This created a major qualification to parliamentary sovereignty, because Parliament appeared to bind its successors while the UK remained a member of the EU.

8. Human Rights Act 1998 and the Rule of Law | 1998 年《人权法》与法治

The Human Rights Act 1998 incorporated the European Convention on Human Rights into UK law. It enables UK courts to hear human rights cases, and requires public authorities to act compatibly with Convention rights unless primary legislation makes that impossible.

Since 1997, devolution has transferred significant powers from Westminster to the Scottish Parliament, the Welsh Senedd and the Northern Ireland Assembly. This has made the UK constitution more decentralised while remaining formally unitary, because Westminster retains legal sovereignty and can in theory repeal the devolution statutes.
