The Main Powers of the House of Lords |

📚 The Main Powers of the House of Lords |

The House of Lords, as the upper chamber of the UK Parliament, plays a vital revising and scrutinising role in the legislative process. Although it is not elected and its powers are limited by statute and convention, it remains an influential body that can challenge the government, improve legislation, and hold the executive to account.

1. Legislative Revision and Amendment |

The House of Lords spends much of its time examining bills that have been passed by the House of Commons. It can propose amendments to improve the quality of legislation, close loopholes, and clarify ambiguous wording. Because many peers are experts in fields such as law, medicine, science, and business, their scrutiny often leads to more workable and coherent laws.

Unlike the Commons, where party discipline is strong and government majorities usually prevail, the Lords contains a large number of crossbenchers and independent peers. This means that amendments are often considered on their merits rather than purely along party lines, making the revising role particularly effective.

2. Suspensive Veto and the Parliament Acts |

The House of Lords no longer has an absolute veto over primary legislation. Under the Parliament Acts of 1911 and 1949, the Lords can only delay most bills passed by the Commons for up to one year. If the Commons passes the same bill again in the following session, it can receive royal assent without the consent of the Lords.

This suspensive veto means that the Lords can force the government and the Commons to reconsider controversial measures, but it cannot permanently block the elected chamber’s will. The provision gives the Lords a real but limited power to encourage compromise and public debate.

3. Money Bills and Financial Restrictions |

Under the Parliament Act 1911, the House of Lords has virtually no power over ‘money bills’, which are bills solely concerned with taxation or public expenditure. The Speaker of the House of Commons certifies whether a bill is a money bill, and such bills can receive royal assent after only one month, even without the Lords’ approval.

This restriction reflects the democratic principle that taxation and public spending must be controlled by the elected chamber. The Lords may debate money bills but cannot amend or delay them in any meaningful way, which preserves the financial supremacy of the House of Commons.

4. Scrutiny of Secondary Legislation |

Secondary legislation, also known as delegated legislation, includes statutory instruments made by ministers under powers granted by an Act of Parliament. The House of Lords has a Secondary Legislation Scrutiny Committee that examines these instruments and can draw attention to those that are politically or legally important, or that may have unintended consequences.

Although the Lords cannot amend statutory instruments, it can pass a motion to regret them or, in rare cases, vote to reject them. This scrutiny function is increasingly significant because a large volume of law is now made through delegated powers rather than full parliamentary bills.

5. Debates and Private Members’ Bills |

The House of Lords provides a forum for high-quality debate on a wide range of national and international issues. Peers with specialist knowledge can raise matters that may not be prioritised in the Commons, and their debates often attract media attention and influence public opinion.

Peers can also introduce private members’ bills, which are bills not part of the government’s legislative programme. While these bills rarely become law without government support, they can raise awareness of important social issues and sometimes lead to changes in government policy.

6. Investigative Committees and Government Accountability |

The House of Lords has a number of select committees that conduct detailed inquiries into policy areas such as the economy, the constitution, international relations, science and technology, and the environment. These committees take evidence from ministers, civil servants, experts, and the public, and publish authoritative reports.

Because committee members are often less constrained by party politics than MPs, their reports can be highly critical of the government and are respected for their independence. This scrutiny helps to hold the executive to account between elections and can influence government policy.

7. Constitutional Safeguard and Checks on the Commons |

The House of Lords is often described as a constitutional safeguard because it can delay legislation that might threaten fundamental rights, the rule of law, or the balance of the constitution. It can act as a check on a government with a large majority in the Commons, preventing hasty or ill-considered constitutional changes.

Although the Lords cannot ultimately block a determined government, its ability to force delay and public scrutiny means that controversial constitutional reforms are often debated more thoroughly. This role is especially important in the absence of a written constitution in the UK.

8. Judicial Functions: Past and Present |

Historically, the House of Lords served as the highest court of appeal in the United Kingdom through its Appellate Committee, made up of the Law Lords. This judicial role lasted for centuries until the Constitutional Reform Act 2005 established a separate Supreme Court, which began operating in 2009.

Since 2009, the House of Lords no longer has a judicial function, and the Law Lords became the first justices of the Supreme Court. However, the Lord Speaker and other parliamentary officers still perform certain ceremonial duties linked to the old judicial role.

9. Relationship with the House of Commons |

The House of Lords is subordinate to the elected House of Commons in all matters of legislation and finance. By convention, the government is accountable to the Commons, and the Prime Minister and most senior ministers sit in the lower house. The Lords must ultimately give way to the will of the Commons.

There are also conventions that govern the relationship between the two houses, such as the Salisbury Convention, which states that the Lords should not block legislation that was promised in the governing party’s election manifesto. This convention reinforces the democratic legitimacy of the Commons.

10. The Future of the House of Lords |

The powers and composition of the House of Lords remain subjects of ongoing political debate. Many groups argue for an elected or partially elected second chamber, while others defend the current appointed model for its expertise and independence. Proposals for reform have included reducing the size of the house, introducing term limits, and removing hereditary peers.

Despite repeated calls for reform, no major constitutional change has been achieved since 1999, when most hereditary peers were removed. The House of Lords continues to function as a revising and scrutinising chamber, but its long-term future remains uncertain.
