Federalism is a core concept in the study of US government and politics, and it is central to the Edexcel A-Level Politics specification. It describes the division of sovereignty between a national government and regional governments, each with its own sphere of constitutional authority. Understanding federalism requires examining how power is allocated, how conflicts are resolved, and how the balance between national and state authority has shifted over time.

1. Defining Federalism | 联邦制的定义

Federalism is a system of government in which sovereignty is constitutionally divided between a central or federal government and regional governments such as states or provinces. Each level of government has powers that the other cannot unilaterally abolish, creating a system of shared and separate authority. This is different from a unitary system, where any regional powers are granted by the centre and can be removed by the centre.

In the United States, the term ‘federal government’ usually refers to the national government in Washington, D.C., but federalism as a concept covers the entire constitutional arrangement between the national government and the fifty state governments. The Constitution establishes both levels as co-existing authorities with direct relationships to the people.

Federalism is therefore not merely administrative decentralisation. It is a constitutional guarantee that states retain meaningful powers and that the national government is limited to the powers delegated to it.

2. Constitutional Division of Powers | 宪法上的权力划分

The US Constitution establishes federalism through the separation of powers between the federal government and the states. This amendment is often cited by those who argue for a limited national government and robust state autonomy.

The design was a compromise between those who wanted a strong central government and those who wanted to preserve the independence of the former colonies. The result was a compound republic in which sovereignty is shared and divided.

3. Dual Sovereignty | 双重主权

A defining feature of federalism is dual sovereignty: the federal government and state governments are each sovereign in their own spheres. Citizens are subject to two sets of laws, two court systems, and two levels of taxation. This dual system can be seen in everyday life, such as when a person files both federal and state income tax returns.

4. The Supremacy Clause and Reserved Powers | 最高条款与保留权力

Article VI of the Constitution contains the Supremacy Clause, which makes the Constitution, federal laws, and treaties the supreme law of the land. This means that when federal and state laws conflict, federal law prevails provided it is constitutional. The Supremacy Clause ensures that the national government can act effectively within its delegated powers without being blocked by individual states.

The Constitution grants different categories of power. Enumerated powers are explicitly listed, such as the power to coin money, declare war, and regulate interstate commerce. These are found mainly in Article I, Section 8, and they define the core authority of the national government.

Implied powers derive from the Necessary and Proper Clause, allowing Congress to make laws needed to carry out its enumerated powers.
