4. Statutory Interpretation | 法律解释

Judges often need to interpret statutes to apply them to specific facts. There are three main rules of interpretation: the literal rule, the golden rule, and the mischief rule.

  • Literal rule: words are given their plain ordinary dictionary meaning, even if the result is absurd.

  • Mischief rule: the court looks at the defect or “mischief” that the statute was intended to remedy, and interprets the statute to suppress that mischief.

Judges may also use internal and external aids, such as the long title of an Act, dictionaries, or reports of law reform bodies.

5. Judicial Precedent | 司法先例

The doctrine of judicial precedent, or stare decisis, means that courts follow earlier decisions. The key elements are ratio decidendi (the legal reasoning behind a decision) and obiter dicta (other remarks made by the judge).
