What Is the Legal Basis for Home Education in England? |

📚 What Is the Legal Basis for Home Education in England? |

Home education in England is not a loophole, a grey area or a quiet act of rebellion. It is a lawful educational route that rests on one deceptively simple statutory sentence: parents must cause their child to receive an efficient full-time education suitable to the child’s age, ability, aptitude and any special educational needs – “either by regular attendance at school or otherwise”. Those final three words, “or otherwise”, are the whole legal foundation of home schooling in England.

This article sets out the statutory provisions, the case law, the duties of local authorities, the limits of their powers, and the reforms now moving through Parliament. It is written for A-Level Law, Sociology of Education and Citizenship students, and for families who need the position stated accurately.

1. The Core Principle: A Duty to Educate, Not a Duty to School |

English law draws a sharp distinction between education and schooling. The state legislates for the former and merely provides the latter as one delivery mechanism among others. Parliament never enacted a duty to send a child to school; it enacted a duty to secure an education.

Four consequences follow directly from that distinction:

  • The duty-holder is the parent, not the child and not the school.
  • The standard is educational adequacy, not institutional attendance.
  • The choice of method belongs to the parent in the first instance.
  • The state’s role is supervisory and reactive, not directive.

Be careful with terminology, because examiners reward precision. “Elective home education” (EHE) describes a parent’s positive choice to educate at home. “Education otherwise than at school” (EOTAS) usually describes provision arranged or funded by a local authority when a child cannot attend a mainstream school. They are not the same thing, and the legal frameworks differ.

2. Section 7 of the Education Act 1996: The Statutory Foundation | 《1996

Everything begins with section 7 of the Education Act 1996. Its substance is unchanged since the Education Act 1944, section 36, and it reads in essence as follows: “The parent of every child of compulsory school age shall cause him to receive efficient full-time education suitable (a) to his age, ability and aptitude, and (b) to any special educational needs he may have, either by regular attendance at school or otherwise.”

The provision is a layered test, and it is worth compressing it into a single revision line:

s.7 EA 1996 → efficient + full-time + suitable (age, ability, aptitude, SEN) → by regular attendance at school OR otherwise

Two points are commonly misunderstood. First, “parent” includes any person with parental responsibility and, in practice, anyone with care of the child. Second, the section imposes a duty of outcome qualified by reasonableness – the parent must cause the education to happen, not merely intend it.

Compulsory school age. The duty bites only during compulsory school age, which in England runs from the start of the term following the child’s fifth birthday until the last Friday in June of the school year in which the child turns sixteen. Raising the Participation Age requires young people to continue in education or training until eighteen, but it does not require attendance at school, and it does not reimpose the section 7 duty.

Devolution note. Section 7 governs England. Scotland, Wales and Northern Ireland operate under separate statutory frameworks, so always check the jurisdiction before citing authority.

3. “Efficient” and “Suitable”: How the Courts Define the Threshold | “高效”与”适当”:法院如何界定门槛

Because section 7 uses abstract words, the courts have supplied the working definitions. In Harrison & Harrison v Stevenson (1982), the court held that education is “efficient” if it achieves what it sets out to achieve, and “suitable” if it is appropriate to the child’s age, ability and aptitude. The test is functional, not formal.

In R v Secretary of State for Education and Employment, ex parte Talmud Torah Machzikei Hadass School Trust (1985), Woolf J gave the classic formulation: education is suitable if it primarily equips a child for life within the community of which he is a member, rather than the way of life of the country as a whole, provided it does not foreclose the child’s options in later years to adopt some other form of life if he wishes to do so.

在 R v Secretary of State for Education and Employment, ex parte Talmud Torah Machzikei Hadass School Trust(1985)案中,Woolf 法官给出了经典表述:如果教育主要能使孩子在其所归属的社群中生活,而非必须符合整个国家的生活方式,即属”适当”——前提是这种教育不会封闭孩子日后若愿意选择其他生活方式的可能性。

From those authorities, the following negative propositions follow. Home educators in England are not required to:

  • follow the National Curriculum or any prescribed syllabus;
  • employ qualified teachers or hold any teaching qualification;
  • keep school hours, terms or a fixed timetable;
  • sit public examinations such as GCSEs or A-Levels;
  • replicate the structure, subjects or ethos of a school;
  • obtain anyone’s permission before beginning.
  • 遵循国家课程或任何指定教学大纲;
  • 聘用具备资质的教师或持有任何教学资格;
  • 采用学校的作息时间、学期制度或固定课表;
  • 参加 GCSE、A-Level 等公开考试;
  • 复制学校的结构、科目设置或教育理念;

What is required is that the education is real, identifiable, progressing and appropriate
