1. What is Law? | 什么是法律?

Law is a set of rules created by the state to regulate behaviour. These rules are enforceable by courts and apply equally to everyone within a society. Without law, there would be no clear way to resolve disputes or protect individual freedoms.

法律是由国家制定的一套行为规则。这些规则由法院强制执行,平等地适用于社会中的每一个人。没有法律,就没有明确的途径来解决纠纷或保护个人自由。


2. Sources of Law | 法律的来源

In the English legal system, which CAIE focuses on, there are two main sources of law: legislation (statutes passed by Parliament) and common law (decisions made by judges in previous cases, also known as precedent). Occasionally, EU law and international treaties also influence domestic law, but Parliament remains supreme.

3. Criminal vs Civil Law | 刑法与民法

Criminal law deals with offences against the state, such as theft or assault. The aim is to punish the offender and protect society. Civil law, on the other hand, resolves disputes between individuals or organisations, such as contract disagreements or family matters. The outcome is usually compensation, not punishment.

刑法处理的是针对国家的犯罪行为,例如盗窃或袭击,目的是惩罚犯罪者并保护社会。而民法解决的是个人或组织之间的纠纷,如合同争议或家庭事务,结果通常是赔偿,而非惩罚。

4. The Court System | 法院体系

The English court structure is hierarchical. Magistrates’ courts deal with less serious criminal cases, while the Crown Court handles serious offences. In civil matters, the County Court hears small claims, and the High Court deals with larger or more complex cases. Appeals go to the Court of Appeal and, ultimately, the Supreme Court.

英国的法院体系是等级分明的。治安法院处理较轻微的刑事案件,而刑事法院审理严重犯罪。民事案件中,郡法院审理小额索赔,高等法院处理数额较大或更复杂的案件。上诉案件则由上诉法院审理,最终可上诉至最高法院。

5. Legal Professionals | 法律专业人员

Lawyers in England and Wales are mainly divided into solicitors and barristers. Solicitors typically provide legal advice, prepare documents, and may represent clients in lower courts. Barristers specialise in courtroom advocacy and are often instructed by solicitors for trials. Judges are appointed from experienced barristers or solicitors.

英格兰和威尔士的律师主要分为事务律师和出庭律师。事务律师通常提供法律咨询、准备文件,并可在下级法院代表客户。出庭律师专精于法庭辩护,通常由事务律师委托参与庭审。法官则从经验丰富的出庭律师或事务律师中任命。


6. The Rule of Law | 法治原则

The rule of law is a fundamental principle stating that no one is above the law, and everyone must obey it. It ensures that laws are clear, public, and applied equally. Key features include an independent judiciary, fair trials, and access to justice for all citizens.

7. Fundamental Rights | 基本权利

In the UK, many basic rights are protected by the Human Rights Act 1998, which incorporates the European Convention on Human Rights into domestic law. These include the right to life, freedom from torture, the right to a fair trial, and respect for private and family life. These rights can only be restricted in very limited circumstances.

8. How a Law is Made | 法律如何制定

A proposed new law is called a bill. It must pass through several stages in both the House of Commons and the House of Lords before receiving Royal Assent. Once approved, it becomes an Act of Parliament and is enforceable as statute law.

10. Justice and Fairness | 正义与公平

Justice means that everyone receives fair treatment according to the law. In a fair legal system, decisions are impartial, processes are transparent, and everyone has the opportunity to present their case. Year 7 students are encouraged to think about what fairness means in different situations, from the playground to the courtroom.
