1. What is Law? |
Law is a set of rules made and enforced by society to govern behaviour. It sets out what people can and cannot do, provides ways to settle disputes, and protects individual rights. Law comes from various sources, such as Acts of Parliament, judges’ decisions, and international agreements. For beginners, it is helpful to see law as a framework that keeps order and promotes fairness in everyday life.
2. Why Do We Need Laws? |
Laws serve vital purposes: they maintain order, protect safety and property, and ensure justice. Without law, there would be no clear way to resolve conflicts, and people would not know what behaviour is acceptable. In a community, laws also reflect shared moral values and allow society to function smoothly. Even young people benefit from understanding that rules at school mirror the wider legal order.
3. Sources of Law |
In the English legal system, laws come from several key sources. The main source is legislation – Acts of Parliament and delegated legislation. Another important source is case law, where judges create precedents through their decisions. European Union law and international treaties also play a part, though their influence has changed since Brexit. Recognising these sources helps you understand where legal rules originate.
4. The English Legal System |
The legal system of England and Wales is based on the adversarial model: two sides present their cases before an impartial judge. The judge acts like a referee, ensuring fair procedure. A central feature is the doctrine of precedent, which means lower courts must follow decisions of higher courts in similar cases. This creates consistency and predictability in the law.
5. Criminal vs Civil Law |
Criminal law deals with offences against society, such as theft or assault. The state prosecutes the defendant, and if found guilty, the punishment may be a fine or imprisonment. The standard of proof is ‘beyond reasonable doubt’. Civil law, by contrast, resolves disputes between individuals or organisations. The aim is usually compensation, and the standard of proof is lower – ‘on the balance of probabilities’.
A single incident can give rise to both criminal and civil cases. For example, an assault may lead to a criminal prosecution and a civil claim for damages. Learning to distinguish these two types early on is a foundational skill for young law students.
6. The Court Structure |
The court system is arranged in a hierarchy. At the base are Magistrates’ Courts for minor cases. Above them are the Crown Court (serious crimes) and the High Court, which has three divisions: Queen’s Bench, Chancery, and Family. The Court of Appeal hears appeals, and the Supreme Court is the final court of appeal for all UK cases. Specialist tribunals also handle areas like employment and immigration.
7. Law Making: Parliament |
Parliament is the supreme law-making body in the UK. It consists of the House of Commons, the House of Lords, and the Monarch. A proposed law – called a bill – must pass through both Houses and receive Royal Assent to become an Act. This process allows thorough debate and scrutiny. Parliament can also delegate law-making powers to ministers or local authorities, creating statutory instruments.
