If he genuinely believed it was free, that might remove dishonesty. However, the fact that he used a knife secretly and hid it in his bag suggests he knew it was not a free sample. Eating the cake also shows an intention to permanently deprive, as you cannot give back a slice once eaten. Conclusion: A court would probably find Leo guilty of theft because his behaviour points to dishonesty. This walkthrough shows how mens rea can be proved by surrounding circumstances, not just by what a person says.

Recklessness means foreseeing a risk and carrying on anyway. A teacher had warned against shooting towards the buildings; by ignoring that warning, Rory took an obvious risk. A reasonable person would realise that a hard shot missing the goal could hit a window. Therefore, Rory’s action was at least reckless. Conclusion: Rory could be found guilty of criminal damage, even though he did not want the window to break. This highlights that recklessness can be enough for some offences.

This is a breach of duty. That breach directly led to Jamila’s fall and broken arm, which is a recognised form of harm. The school’s argument that Jamila should have spotted the danger is weak, because children cannot be expected to notice every hazard, especially when a staff member already knew. Conclusion: The school is likely to be found negligent and would have to compensate Jamila. This case demonstrates how civil law focuses on compensating the injured person rather than punishing the wrongdoer.
