1. Why Law Matters | 法律为何重要

Every society needs rules to function fairly and peacefully. Law creates a balance between protecting individual rights and maintaining order. The Rule of Law is a fundamental principle of the UK constitution. It means that everyone – citizens, politicians, police officers and even the monarch – must obey the law. No person is above the law. This prevents the abuse of power and ensures fairness. According to Professor A.V. Dicey, the Rule of Law has three main ideas: nobody can be punished unless they break the law; everyone is equal before the law; and the constitution is a result of ordinary law, not a special political document. The formula reminds us that the law is the highest authority.

Common law develops when judges decide real disputes and their reasons become precedents. For example, the famous case Donoghue v Stevenson (1932) created the modern law of negligence. The person bringing the case is the claimant, and the other party is the defendant. The usual outcome is compensation (damages). Criminal law, on the other hand, involves offences against the state as a whole, such as theft, assault or murder. The state, represented by the Crown Prosecution Service, brings the case against the defendant, and if found guilty, the defendant may be punished by a fine, community order or imprisonment. One of the cornerstones of English criminal law is the presumption of innocence. Every person accused of a crime is considered innocent until the prosecution proves guilt. The burden of proof lies with the prosecution, and the standard of proof is ‘beyond reasonable doubt’, which means the jury or magistrates must be sure of guilt. This protects individuals from wrongful conviction and reflects the idea that it is better to let a guilty person go free than to punish an innocent one.

To secure a conviction in most criminal cases, two essential elements must be proven. Actus reus is the guilty act – the physical action or omission that the law forbids. For theft, the actus reus is taking someone else’s property. Mens rea is the guilty mind – the required mental state, such as intention or recklessness. For theft, the mens rea is the intention to permanently deprive the owner of that property. Both elements must occur together for a defendant to be found guilty. This is the most important ‘formula’ of criminal liability. Some very minor offences are strict liability, where mens rea is not required, but these are exceptions.
