1. What Is Law? | 什么是法律?

Law is a set of rules created by the state that applies to everyone in society. It tells us what we can and cannot do, and it is enforced by authorities such as the police and courts.

法律是由国家制定的一套适用于社会所有人的规则。它告诉我们什么可以做,什么不可以做,并由警察和法院等当局强制执行。

Laws are different from moral rules or school rules because breaking the law can lead to official punishments, such as fines, community service or imprisonment.

In Northern Ireland, as in the rest of the UK, the legal system is based on common law traditions and statute law passed by Parliament and the Northern Ireland Assembly.

Without laws, there would be chaos. Laws provide a clear standard of behaviour so that people know what is expected of them and can live safely.

Laws protect our fundamental rights. For example, the law ensures everyone has the right to a fair trial, the right to own property and the right to free speech, within limits.

They also provide a peaceful way to solve disputes. Instead of taking matters into our own hands, we can go to court and let impartial judges decide the outcome.

Laws change as society changes. This means the legal system must be flexible enough to deal with new technologies and social attitudes while still protecting citizens.

3. Sources of Law | 法律的来源

The two main sources of law in Northern Ireland are statute law (also called legislation) and common law (also called case law or judge-made law).

Statute law is made by Parliament at Westminster and by the Northern Ireland Assembly for devolved matters such as education, health and justice (policing). An Act of Parliament is the highest form of law.

Common law develops through decisions made by judges in previous cases. When a higher court sets a legal principle, lower courts must follow it – this is called the doctrine of precedent.

Other sources include European Union law (which applied before Brexit but some retained EU laws remain) and international treaties such as the European Convention on Human Rights.

4. The Court System in Northern Ireland | 北爱尔兰的法院体系

The court system in Northern Ireland has several levels, from local magistrates’ courts to the Supreme Court of the United Kingdom. The table below summarises the main courts and their roles.

Court Key Role
Magistrates’ Court Hears minor criminal cases and some family matters; no jury.

High Court Handles major civil cases and judicial reviews; has supervisory role.
Court of Appeal Hears appeals from the Crown Court and High Court.
Supreme Court (UK) The final court of appeal for all civil cases and most criminal cases.

It is important to know that not all cases go to trial. Many disputes are settled through negotiation, mediation or early guilty pleas.
